This  appeal by special leave is  directed\tagainst\t the<br \/>\njudgment  of the Allahabad High Court dismissing the  appeal<br \/>\npreferred  by  the  three appellants herein  and  one  Badri<br \/>\nNarain (since dead) challenging the conviction and  sentence<br \/>\nrecorded against them under Section 302\/34 and 323\/34 of the<br \/>\nIndian\tPenal Code (hereinafter referred to as the &#8216;IPC&#8217;  by<br \/>\nthe Additional Sessions judge Gonda.\n<\/p>\n<p>2.The story as put forth by the prosecution was that on June<br \/>\n7,1978\tat or about 900 A.M. a heated alteration took  place<br \/>\nbetween\t Shyam Narain (the deceased) and his brother  Narain<br \/>\nDutt on the one hand and Badri Narain and his son Swami Nath<br \/>\n(since acquitted) on the other, over dismantling of the mend<br \/>\nwhich divided their respective agricultural plots.  At\tthat<br \/>\ntime Badri Narain was holding a spear and Swami Nath a kudal<br \/>\nwith  him.   While the altercation was\tgoing  on,the  three<br \/>\nappellants  reached there armed with lathis.  In  course  of<br \/>\nthe  altercation when Swami Nath attempted to  attack  Shyam<br \/>\nNarain\twith kudal the latter and Narain Dutt tried  to\t run<br \/>\naway  towards the village but could not succeed as the\tfive<br \/>\naccused\t persons, including the appellants, surrounded\tthem<br \/>\nand  started assaulting Shyam Narain with  their  respective<br \/>\nweapons.   On hearing the shouts of Shyam Narain and  Narain<br \/>\nDutt  when their brother Swami Dayal and his  son  Ramashish<br \/>\nreached there,the three appellants also assaulted them\twith<br \/>\nlathis.\t  As  a\t result of the\tbeating\t when  Shyam  Narain<br \/>\ndropped\t down  dead, the accused persons  ran  away.   Swami<br \/>\nDayal  then  went to the police station and  logged  an\t FIR<br \/>\nwhereupon a case was registered,which ended in a chargesheet<br \/>\nagainst all the five accused persons.\n<\/p>\n<p>3.To  bring  home  the charges\tlevelled  against  them\t the<br \/>\nprosecution rested its case<br \/>\n<span class=\"hidden_text\">555<\/span><br \/>\nprimarily  upon the ocular version of the incident as  given<br \/>\nout  by Swami Dayal (P.W.1), Jamil Khan (P.W.2)\t and  Narain<br \/>\nDutt (P.W.3). The learned trial judge, found that the  claim<br \/>\nof Jamil Khan and Narain Dutt that they were present at\t the<br \/>\ntime of the incident and, for that matter, had witnessed the<br \/>\nsame was wholly untenable and therefore left their  evidence<br \/>\nout of consideration.  As regards, Swami Dayal (P.W. 1)\t the<br \/>\nlearned judge observed that find of injury on his person, as<br \/>\ntestified  by the doctor (P.W.5) and his prompt\t lodging  of<br \/>\nthe F.I.R. lent sufficient corroboration to his testimony to<br \/>\nform the basis of conviction.  It having, however,  appeared<br \/>\nto the learned judge that Swami Nath was roped in because he<br \/>\nwas the son of Badri Narain though he did not participate in<br \/>\nthe  assault  he acquitted Swami Nath  while  recording\t the<br \/>\norder of conviction and sentences against the appellants and<br \/>\nBadri  Narain.\t The  High  Court  concurred  with  all\t the<br \/>\nfindings  recorded by the learned trial judge and  dismissed<br \/>\nthe appeal.\n<\/p>\n<p>4.   In view of the concurrent findings of fact we would not<br \/>\nhave,  ordinarily,  been justified to disturb the  same\t but<br \/>\nthen on perusal of the impugned judgments, we find that both<br \/>\nthe earned Courts below failed to consider that Swami  Dayal<br \/>\ndid  not  state in the F.I.R. that the three  appellant\t had<br \/>\nassaulted  the\tdeceased with lathis.  This  aspect  of\t the<br \/>\nmatter assumes importance for,it appears that in  concluding<br \/>\nthat  the  three appellant shared the  common  intention  of<br \/>\ncommitting the murder of Shyam Narain with Badri Narain\t and<br \/>\nfor that matter, convicting them under Section 302 with\t the<br \/>\naid  of\t Section 34 I.P.C.- while  convicting  Badri  Narain<br \/>\nunder  Section 302 I.P.C. simplicited  the trial  court\t was<br \/>\nmuch  influenced  by  the fact\tthat  the  three  appellants<br \/>\nassaulted  Shyam  Narain  with\tlathis\twhile  Badri  Narain<br \/>\nassaulted him spear resulting in his death,\n<\/p>\n<p>5.   From the testimony of Swami Dayal (P.W. 1.) we get that<br \/>\non the fateful morning when he was going towards their\tplot<br \/>\nalong  with his son Ramashish he saw accused Swami Nath\t and<br \/>\nBadri Narain having heated arguments with his brothers Shyam<br \/>\nNarain Dutt regarding the dismantling of the mend.  At\tthat<br \/>\ntime he found Badri Narain holding a spear and Swami  Narain<br \/>\na  Kudal but his brothers unarmed.  While they were  on\t the<br \/>\nplot and the arguments were going on the other three accused<br \/>\n(the  three  appellants herein) reached there  with  lathis.<br \/>\nAll  of\t them then started abusing Shyam Narain\t and  Narain<br \/>\nDutt.\tIn  the mean time Swami Nath attacked  Shyam  Narain<br \/>\nwith Kudal but as he retreated it did not hit him.  Then, as<br \/>\nShyam  Narain  and  Narain Dutt tried to  flee\ttowards\t the<br \/>\nvillage,  all  the  accused  person  attacked  Narain  Dutt.<br \/>\nAccording  to P.W 1, Badri Narain assaulted him\t with  spear<br \/>\nand  the  three appellants with the lathis.  He\t next  spoke<br \/>\nabout the assault on him and his son by the three appellants<br \/>\nand Badri Narain.  In the F.I.R.,however, the only role that<br \/>\nwas  ascribed by P.W. 1 to the three appellants relating  to<br \/>\nthe attack on Shyam Narain was that when he had ran  towards<br \/>\nthe  village they had also chased him along with  the  other<br \/>\ntwo  accused and surrounded him.  To put it  negatively,  in<br \/>\nthe  F.I.R.  he did not state that the appellants  had\talso<br \/>\nassaulted the deceased much less with lathis.\n<\/p>\n<p>6.   As already stated in relying upon the sole testimony of<br \/>\nP.W.1 both the learned courts below took into consider-\n<\/p>\n<p><span class=\"hidden_text\">556<\/span><\/p>\n<p>ation the fact that his testimony stood corroborated by\t the<br \/>\nF.I.R.\twhich  he  lodged with\tutmost\tdispatch.   In\tthat<br \/>\ncontext\t it was expected, in the fitness of things, that  if<br \/>\nreally\tthe  appellants\t had assaulted\tthe  deceased  Swami<br \/>\nDayal, P.W.1 would have certainly mentioned that fact in the<br \/>\nF.I.R.\tIn  view  of  this material  omission  it  would  be<br \/>\nhazardous  to place implicit reliance upon the statement  of<br \/>\nP.W.1 without any corroborating evidence that the appellants<br \/>\nhad along with Badri Narain assaulted Shyam Narain resulting<br \/>\nin his death; and to hold, as a corollary thereto, that they<br \/>\nshared die common intention with the other accused to commit<br \/>\nthe murder of Shyam Narain.\n<\/p>\n<p>7.   It was, however,urged on behalf of the respondents that<br \/>\neven  if  the  testimony  of  Swami  Dayal  that  the  three<br \/>\nappellants  assaulted the deceased could not be relied\tupon<br \/>\nas  he\tdid not attribute such role to them  in\t the  F.I.R.<br \/>\nstill  then  their conviction under Section  302  read\twith<br \/>\nSection 34 of the I.P.C. for committing the murder of  Shyam<br \/>\nNarain\tshould be upheld having regard to the fact that\t the<br \/>\nevidence  of  P.W.1  that  the\tappellants  had\t chased\t and<br \/>\nsurrounded  the deceased when he was attacked by  the  other<br \/>\naccused stood corroborated by the F.I.R. and that their such<br \/>\ncriminal acts, clearly established their common intention to<br \/>\ncommit the murder.\n<\/p>\n<p>8.   Undoubtedly  the  above  criminal\tacts  of  the  three<br \/>\nappellants, which must be held to be conclusively proved  in<br \/>\nview of the concurrent findings of the learned Courts below,<br \/>\nclearly indicate that they shared some common intention with<br \/>\nthe  other  accused but then the question is  whether  their<br \/>\ncommon\tintention  was to commit the  murder.\tBesides\t the<br \/>\nevidence  of  P.W.1 of their having assaulted  the  deceased<br \/>\nwith lathis- which we have found to be unacceptable-there is<br \/>\nno  other  evidence,  to  indicate,  that  they\t wanted\t the<br \/>\ndeceased  to  be  done away with.  It cannot  be  gain\tsaid<br \/>\nhowever,  that\ttheir acts facilitated the stabbing  of\t the<br \/>\ndeceased  by Badri Narain but there is noting whatsoever  to<br \/>\nindicate  that the appellants knew that he intended to\tkill<br \/>\nhim though they must have anticipated that he would  assault<br \/>\nthe  deceased  with the spear that he was carrying  In\tthat<br \/>\nview  of  the  matter we conclude  that\t though\t the  common<br \/>\nintention  of  the appellants to cause the  death  of  Shyam<br \/>\nNarain\thas  not  been\testablished  beyond  all  reasonable<br \/>\ndoubts,\t it  has been conclusively  established\t that  their<br \/>\ncommon intention, was to cause injuries to the deceased with<br \/>\ndeadly weapon, namely, spear.\n<\/p>\n<p>9.   In\t the result the conviction of the  appellants  under<br \/>\nSection 302 read with Section 34 IPC and the sentence of im-<br \/>\nprisonment  for life for causing the death of  Shyam  Narain<br \/>\nare  set aside and instead they are convicted under  Section<br \/>\n324  read  with\t Section 34 IPC and  sentenced\tto  rigorous<br \/>\nimprisonment  for  a  period  of  two  years  each.    Their<br \/>\nconviction under Section 323 read with Section 34 IPC  along<br \/>\nwith the sentence of one year each thereunder, is uphold  as<br \/>\nit does not suffer from any infirmity.\tThe sentences  shall<br \/>\nrun concurrently.
