JUSTICE ADITYA KUMAR TRIVEDI<\/p>\n<p>Aditya Kumar Trivedi, J. Petitioner, Dr. Jagat Kishore Sharan by<\/p>\n<p>way of institution of instant petition prayed for quashing of entire<\/p>\n<p>criminal proceeding including the FIR leading to Naugachhia<\/p>\n<p>P.S.Case No. 351 of 2007, G.R. No.888\/2007 registered under<\/p>\n<p>Sections 409,420 of the IPC.\n<\/p>\n<p>           2. From Annexure-1, the written report submitted by<\/p>\n<p>Dr. Santosh Kumar Jha, Medical Officer Incharge, Naugachhia in<\/p>\n<p>terms of direction vide letter no. 588(8) dated 15.10.2007 puts an<\/p>\n<p>allegation that Dr. Jagat Kumar Sharma, Medical Officer, who was<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>to retire on 31.01.1999 did not relinquish himself and continued in<\/p>\n<p>the service uptil 31.08.1999 and during intervening period he had<\/p>\n<p>withdrawn sum of Rs.1,02,848\/- in lieu of salary and other<\/p>\n<p>emoluments. When the matter came to knowledge of Civil Surgeon,<\/p>\n<p>Bhagalpur, he issued order to this effect and communicated vide<\/p>\n<p>Wireless message No. 3683 dated 13.10.1999. The aforesaid written<\/p>\n<p>report was submitted on 31.10.2007.\n<\/p>\n<p>            3. It has been submitted on behalf of the petitioner that<\/p>\n<p>non of the Sections, whereunder, the case has been registered nor<\/p>\n<p>any of the provisions of penal law is attracted against the petitioner<\/p>\n<p>because of the fact that it was obligatory on the part of the State<\/p>\n<p>Government\/Appointing Authority to communicate him with regard<\/p>\n<p>to his date of retirement and further directing him to hand over<\/p>\n<p>charge of his office to particular individual. Because of the fact that<\/p>\n<p>there have been lapses on the part of the Controlling Officers,<\/p>\n<p>therefore, to escape themselves from the lapses as indicated above,<\/p>\n<p>made the petitioner an scapegoat by launching a prosecution that too<\/p>\n<p>after such a long interval. This long intervening period is suggestive<\/p>\n<p>of the fact that petitioner has been victimized at the hands of his<\/p>\n<p>superior authority. Then submitted that just after retirement, a<\/p>\n<p>departmental proceeding ensued which concluded and as per finding<\/p>\n<p>of the departmental proceeding, the amount whatever been realized<br \/>\n<span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>by the petitioner as salary along with permissive emoluments have<\/p>\n<p>already been realized with penalty clause. Then submitted that the<\/p>\n<p>amount has not been digested nor allegation of misappropriation<\/p>\n<p>rather it was permissive monthly salary along with other benefits<\/p>\n<p>permissive to a Government servant which was credited in his<\/p>\n<p>account after having the pay bill passed by the Treasury for the<\/p>\n<p>relevant period during course of which petitioner had discharged his<\/p>\n<p>duty which he continued in good faith on account of non-<\/p>\n<p>correspondence at his controlling side. Nothing sort of criminal<\/p>\n<p>activity has been reported\/alleged against the petitioner. Apart from<\/p>\n<p>this, the conduct of the prosecution appears to be hit by Section-43<\/p>\n<p>Explanation (b) of the Bihar Pension Rules which prescribes the<\/p>\n<p>maximum period of four years for launching of prosecution after<\/p>\n<p>retirement, which period, as is evident, had already expired before<\/p>\n<p>commencement of the criminal prosecution. So submitted that it is a<\/p>\n<p>fit case wherein the reliefs so claimed by the petitioner are to be<\/p>\n<p>allowed.\n<\/p>\n<p>            4.   On the other hand, the State by filing counter<\/p>\n<p>affidavit submitted that petitioner could not exonerate himself from<\/p>\n<p>his liability because of the fact that he was well aware with regard to<\/p>\n<p>his date of birth, date of appointment and date of retirement. It was<\/p>\n<p>expected at his end that he should have asked for necessary<br \/>\n<span class=\"hidden_text\">                                 4<\/span><\/p>\n<p>instruction from his administrative controller on this score as well as<\/p>\n<p>seeking guideline to whom the charge has to be handed over.<\/p>\n<p>Intentional act of petitioner on this score withholding himself is<\/p>\n<p>indicative of the fact that he unsuccessfully, though succeeded for a<\/p>\n<p>few months in duping the Government by way of continuing in<\/p>\n<p>service and getting salary and other benefits withdrawn from the<\/p>\n<p>Treasury. So, petitioner had privilege of wrongful gain and by such<\/p>\n<p>action he put the State under wrongful loss. The aforesaid synonyms<\/p>\n<p>attract application of penal law. Also submitted that realization of<\/p>\n<p>amount by drawing a departmental proceeding will not exonerate the<\/p>\n<p>petitioner from criminal liability. Apart from this, it has also been<\/p>\n<p>submitted that from the conduct of the petitioner, there happens to<\/p>\n<p>be positive evidence with regard to embezzlement of Government<\/p>\n<p>money and so the penal provision whereunder case has been<\/p>\n<p>registered is equally applicable. Further submitted that the facts of<\/p>\n<p>the case did not attract application of Section 43 of the Bihar<\/p>\n<p>Pension Rules. So submitted that the instant petition is fit to be<\/p>\n<p>dismissed.\n<\/p>\n<p>             5. From the annexure-1, it is admitted fact that criminal<\/p>\n<p>prosecution was launched after more than 7 (seven) years of<\/p>\n<p>retirement of petitioner. So, now one has to see whether the<\/p>\n<p>aforesaid prosecution is found to be legally maintainable in light of<br \/>\n<span class=\"hidden_text\">                                 5<\/span><\/p>\n<p>presence of rule 43 of the Bihar Pension Rules ?\n<\/p>\n<p>            6. Rule 43 of Bihar Pension Rules has been brought in<\/p>\n<p>picture to command the conduct of the pensioners as well as it also<\/p>\n<p>brings inflexible situation by way of protecting the future interest of<\/p>\n<p>the pensioners so that they should not be victimized for his lapses, if<\/p>\n<p>any, committed during his service tenure having sword hanging over<\/p>\n<p>his neck for infinite period. For better appreciation, the Rule 43 is<\/p>\n<p>quoted below:-\n<\/p>\n<p>              &#8221; 43. (a) Future good conduct is an implied condition<br \/>\nof every grant of a pension. The Provincial Government reserve to<br \/>\nthemselves the right of withholding or withdrawing a pension or any<br \/>\npart of it, if the pensioner is convicted of serious crime or be guilty<br \/>\nof grave misconduct. The decision of the Provincial Government on<br \/>\nany question of withholding or withdrawing the whole or any part of<br \/>\na pension under this rule, shall be final and conclusive.\n<\/p>\n<p>              [(b) The State Government further reserve to themselves<br \/>\nthe right of withholding or withdrawing a pension or any part of it,<br \/>\nwhether permanently or for a specified period, and the right of<br \/>\nordering the recovery from a pension of the whole or part of any<br \/>\npecuniary loss caused to Government if the pensioner is found in<br \/>\ndepartmental or judicial proceeding to have been guilty of grave<br \/>\nmisconduct; or to have caused pecuniary loss to Government by<br \/>\nmisconduct or negligence, during his service including service<br \/>\nrendered on re-employment after retirement:\n<\/p>\n<blockquote><p>              Provided that-\n<\/p><\/blockquote>\n<blockquote><p>            (a)               such departmental proceedings, if not<br \/>\n                              instituted while the Government servant<br \/>\n                              was on duty either before retirement or<br \/>\n                              during re-employment;\n<\/p><\/blockquote>\n<blockquote><p>            (i) shall not be instituted save with the sanction of the<br \/>\n                 State Government ;\n<\/p><\/blockquote>\n<blockquote><p>            (ii ) shall be in respect of an event which took place not<br \/>\n                  more than four years before the institution of such<br \/>\n                  proceedings ; and\n<\/p><\/blockquote>\n<blockquote><p>            (iii) shall be conducted by such authority and at such<br \/>\n<span class=\"hidden_text\">                               6<\/span><\/p>\n<p>                place or places as the State Government may direct<br \/>\n                and in accordance with the procedure applicable to<br \/>\n                proceedings on which an order of dismissal from<br \/>\n                service may be made ;\n<\/p><\/blockquote>\n<blockquote><p>         (b) Judicial proceedings, if not instituted while the<br \/>\n                Government servant was on duty either before<br \/>\n                retirement or during re-employment, shall have<br \/>\n                been instituted in accordance with sub-clause (ii) of<br \/>\n                clause (a) ; and\n<\/p><\/blockquote>\n<blockquote><p>        (c)        the Bihar Public Service Commission, shall be<br \/>\n                consulted before final orders are passed.<br \/>\n     Explanation,- For the purpose of the rule-\n<\/p><\/blockquote>\n<blockquote><p>        (a) departmental proceeding shall be deemed to have been<br \/>\n            instituted when the charges framed, against the<br \/>\n            pensioner are issued to him or, if the Government<br \/>\n            servant has been placed under suspension from an<br \/>\n            earlier date, on such date ; and\n<\/p><\/blockquote>\n<blockquote><p>        (b) Judicial proceedings shall be deemed to have been<br \/>\n            instituted :-\n<\/p><\/blockquote>\n<blockquote><p>        (i) in the case of criminal proceedings, on the date on<br \/>\n            which a complaint is made or a charge-sheet is<br \/>\n            submitted, to a criminal court ; and\n<\/p><\/blockquote>\n<blockquote><p>       (ii) in the case of civil proceedings, on the date on which<br \/>\n            the complaint is presented, or as the case may be, an<br \/>\n            application is made to a civil Court &#8220;<\/p><\/blockquote>\n<p>           7. After close scrutiny of Rule 43 Explanation (b) (i) it<\/p>\n<p>is evident that the period of launching of criminal proceeding has<\/p>\n<p>been directed to commence from the date of filing of complaint or<\/p>\n<p>charge-sheet and the period thereof has to be counted in accordance<\/p>\n<p>with (a) as per sub Rule (ii) prescribing maximum period of four<\/p>\n<p>years from the date of retirement the period whereunder any kind of<\/p>\n<p>proceeding be it departmental, civil, criminal has to be launched.<\/p>\n<p>The State, during course of argument has admitted that prosecution<br \/>\n<span class=\"hidden_text\">                                              7<\/span><\/p>\n<p>          has been launched after stipulated period. Admittedly, vide order<\/p>\n<p>          dated 17.03.2009 only coercive step against the petitioner has been<\/p>\n<p>          stayed and not the investigation. Even during course of argument, it<\/p>\n<p>          has been submitted that no charge-sheet has been submitted that<\/p>\n<p>          means to say the investigation is lingering for the last four years<\/p>\n<p>          even after institution of case.\n<\/p>\n<p>                       8. From the written report itself (Annexure-1) it is now<\/p>\n<p>          no more remains under controversy that the institution of present<\/p>\n<p>          case was made beyond the period of four years and so the<\/p>\n<p>          proceeding in its inception was contrary thereto. As such the FIR<\/p>\n<p>          along with criminal prosecution is quashed.
