SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 25\/07\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>Present<br \/>\n\tpetition under sec.482 of the Code of Criminal Procedure  has been<br \/>\n\tpreferred by the petitioners\n<\/p>\n<p>\t&#8211; original accused  to quash and set aside the proceedings of<br \/>\n\tCriminal Case No.111 of 2011, pending in the court of learned<br \/>\n\tJudicial Magistrate (First Class), Vav.\n<\/p>\n<p>At<br \/>\n\tthe outset, it is required to be noted that after conclusion of the<br \/>\n\tinvestigation by the concerned police officer, chargesheet has been<br \/>\n\tfiled and the petitioners  &#8211; original accused are  chargesheeted for<br \/>\n\tthe punishable under sections 498(A), 323, 504 and 114 of Indian<br \/>\n\tPenal Code   as well as under<br \/>\n\tsections 3 and 7 of Dowry Prohibition Act.\n<\/p>\n<p>\tApart<br \/>\n\tfrom the above, even relevant chargesheet papers are also not<br \/>\n\tproduced on record on the basis of which the petitioners   are<br \/>\n\tchargesheeted.\n<\/p>\n<p>In<br \/>\n\tview of the above, the petitioners   have a remedy available<br \/>\n\tby way of submitting  an application before the<br \/>\n\tlearned trial court for discharge under<br \/>\n\tsection 227 of the Code of Criminal Procedure<br \/>\n\tand the same can be considered by the learned trial court in<br \/>\n\taccordance with law and on merits and considering the chargesheet<br \/>\n\tpapers the learned Magistrate would be in a position to appreciate<br \/>\n\tthe evidences which are produced on record along with the<br \/>\n\tchargesheet, present petition is not entertained and is dismissed<br \/>\n\twith above liberty.
