The learned Trial Court has<br \/>\nby the preliminary decree impugned in present appeal, passed below<br \/>\nmentioned directions:\n<\/p>\n<p>\t A<br \/>\npreliminary decree is passed as under:\n<\/p>\n<p>\tIt<br \/>\nis hereby declared that partnership firm  Punjabhai Mohanbhai<br \/>\nPalkhiwala  shall stand dissolved from Kartak Sud 1, S. Y. 2035 to<br \/>\n18\/05\/1981.\n<\/p>\n<p>\tIt<br \/>\nis hereby declared that heirs of deceased plaintiff Sushilaben have<br \/>\n1\/4th share, jointly, and heirs of defendant No.1<br \/>\nPunjabhai Monhanlal have 3\/4th Share, jointly, in the<br \/>\npartnership firm  Punjabhai Mohanlal Palkhiwala  from Kartak Sud<br \/>\n1, S. Y. 2035 to 18\/05\/1981.\n<\/p>\n<p>\tIt<br \/>\nis ordered that the matter be sent to the Office of the Commissioner<br \/>\nfor Taking Accounts, Ahmedabad who shall be the receiver of the<br \/>\npartnership estate and effects in this suit and who shall get in all<br \/>\nthe outstanding boom-debts and claims of the partnership.\n<\/p>\n<p>\tIt<br \/>\nis ordered that the following accounts be taken by the Commissioner<br \/>\nfor Taking Accounts:\n<\/p>\n<p>An<br \/>\n\taccount of the credits, property and effects now belonging to the<br \/>\n\tsaid partnership.\n<\/p>\n<p>An<br \/>\n\taccount of the debts and liabilities of the said partnership.\n<\/p>\n<p>An<br \/>\n\taccount of all dealings and transactions of partnership firm.\n<\/p>\n<p>\tIt<br \/>\nis hereby ordered that the Commissioner for Taking Accounts shall,<br \/>\nafter taking accounts as stated above, submit his report to this<br \/>\nCourt within six months from today.\n<\/p>\n<p>\tThe<br \/>\nmatter is now adjourned to 29\/12\/2008 for passing final decree after<br \/>\nreceipt of the report from the Commissioner for Taking Accounts.\n<\/p>\n<p>\tThe<br \/>\nappellant herein has brought under challenge the said preliminary<br \/>\ndecree and the aforesaid directions to the limited extent so far as<br \/>\nthe learned Trial Court has appointed the Commissioner for Taking<br \/>\nAccounts as receiver of Shop No.19, Rangwala Market, Ahmedabad.<br \/>\nAfter making submissions to some extent by both the sides, a<br \/>\nconsensus has been arrived at.  Thus, on the basis of the consensus,<br \/>\nfollowing order is passed:\n<\/p>\n<p>\tThe<br \/>\ndirections issued by the learned Trial Court by virtue of the<br \/>\npreliminary decree dated 17\/6\/2008 shall be carried out and the<br \/>\nCommissioner for Taking Accounts appointed by the learned Trial Court<br \/>\nas receiver shall proceed to complete the exercise of Taking Accounts<br \/>\nin accordance with the directions.  Since, in view of the directions<br \/>\nthe appellant herein shall have to hand over the possession of the<br \/>\npremises in question it is suggested by the appellant that the<br \/>\nappellant may, in view of the fact that the appellant is carrying-on<br \/>\nits business activities from the said premises, hand over the<br \/>\npossession, symbolically but may continue to carry on its business<br \/>\nactivities.  The opponent has, therefore and without prejudice to<br \/>\ntheir rights and contentions, accepted the suggestion.  Hence it is<br \/>\nordered that the appellant shall hand over the symbolic possession of<br \/>\nthe premises in question to the  Commissioner for Taking Accounts<br \/>\nas a receiver.    The Commissioner will take the symbolic<br \/>\npossession after giving notice to both the sides and shall obtain<br \/>\nacknowledgment on the record taking symbolic possession.  Thereafter,<br \/>\nthe learned Commissioner shall proceed to complete the exercise of<br \/>\nTaking Accounts and submit the report to the learned Trial Court as<br \/>\nper the directions contained in the preliminary decree dated<br \/>\n17\/6\/2008.\n<\/p>\n<p>\tThe<br \/>\nappellant shall continue to discharge the obligation and liability<br \/>\ntowards payment of rent and all taxes until the final decree is<br \/>\npassed and the payments towards rent and taxes made subsequent to the<br \/>\ndate of preliminary decree will be subject to the directions that may<br \/>\nbe issued in the final decree.\n<\/p>\n<p>\tIt<br \/>\nis clarified that the order permitting the appellant to continue to<br \/>\nbe in occupation of the premises in question (viz. Shop No.19,<br \/>\nRangwala Market, Ahmedabad) and\/or the direction to continue to pay<br \/>\nthe rent and taxes shall not give rise to any right or claim or<br \/>\nequity in favour of the appellant and on the basis of this order or<br \/>\nagreement\/consensus by the opponent the appellant shall not claim<br \/>\ncontrary to preliminary decree any right or equity in any manner<br \/>\nwhatsoever and it is understood that it is only by way of ad interim<br \/>\narrangement and by consensus that the appellant is permitted to<br \/>\ncontinue in occupation of the premises in question and the<br \/>\nCommissioner is asked to take only symbolic possession at this stage.\n<\/p>\n<p>\tIf<br \/>\nthe final judgment and decree is rendered against the present<br \/>\nappellant, then the appellant shall hand over the vacant possession<br \/>\nformally and in accordance with  the directions in the final decree.<br \/>\nHowever, it would not prejudice, in any manner, the appellant&#8217;s right<br \/>\nto carry out further proceedings including proceedings by way of<br \/>\nappeal against the final judgment and decree and\/or seek any interim<br \/>\nrelief during the pendency of appeal if entertained by the Court.<br \/>\nThe possession which shall be handed over formally after the final<br \/>\ndecree will, i.e. after the appeal is presented and any order of<br \/>\ninterim relief is passed, be subject to the order that may be passed<br \/>\nby the appellate Court.\n<\/p>\n<p>\tIn<br \/>\nview of the aforesaid direction and clarification in light of the<br \/>\nconsensus between the parties, any further order is not required.<br \/>\nHence the First Appeal stands disposed of as per the order in terms<br \/>\nof the consensus.  The parties will act as per the aforesaid<br \/>\ndirections and observations.\n<\/p>\n<p>\tThe<br \/>\nappellant shall file an undertaking to the aforesaid effect i.e. it<br \/>\nwill give symbolic possession to the Commissioner and that if the<br \/>\nfinal decree is passed against it, the appellant shall formally hand<br \/>\nover the actual possession of the premises in question which shall be<br \/>\nsubject to its right to file appeal and also the undertaking shall be<br \/>\nfiled subject to the order if any, that may be passed by appellate<br \/>\ncourt within two weeks before the learned Trial Court.  The<br \/>\nundertaking shall be signed and executed by all the<br \/>\nappellants\/interested persons stating clearly that they are in<br \/>\nexclusive possession of the suit premises in question (i.e. they have<br \/>\nnot inducted any one in the premises).\n<\/p>\n<p>\tLearned<br \/>\nadvocate Ms. Jani appearing for the appellant has submitted that the<br \/>\nappellant may hand over the symbolic possession of the premises in<br \/>\nquestion by way of addressing a communication to the effect that the<br \/>\nsymbolic possession is being handed over.  It would be open to the<br \/>\nappellant to address a communication to the said effect with the copy<br \/>\nto the opponents.  A copy of said communication, supported by<br \/>\naffidavit, will be placed on record before the Trial Court also.<br \/>\nWhen such communication is received by the learned Commissioner, he<br \/>\nshall pass necessary formal order taking the symbolic possession and<br \/>\nthen shall report to the learned Trial Court.\n<\/p>\n<p>\tLearned<br \/>\nSenior Counsel Mr. Nayak for the opponent has submitted that the<br \/>\nCivil Suit is almost 19 years old and now that the preliminary decree<br \/>\nis passed the Civil Court may expedite the hearing of the special<br \/>\nsuit.\n<\/p>\n<p>\tIt<br \/>\nis hoped that subject to its cause list, the learned Trial Court<br \/>\nshall endeavor to the Court complete the final hearing of the suit<br \/>\nwithin six months after receipt of this order.\n<\/p>\n<p>\tThe<br \/>\nFirst Appeal stands disposed of accordingly.\n<\/p>\n<p>(K.M.THAKER,<br \/>\nJ.) <\/p>\n<p>(ila)<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Vikrambhai vs Harishbhai on 8 April, 2010 Author: K.M.Thaker,&amp;Nbsp;
