Application No.11514\/2010 was withdrawn as the<br \/>\n\tchargesheet was filed and, therefore, the present application has<br \/>\n\tbeen filed after it has been rejected by the Sessions Court. He<br \/>\n\tfurther submitted that while giving history before the doctor, which<br \/>\n\tis annexed as Annexure-D at Page No.21, the victim has stated about<br \/>\n\tthe affairs and having married, for which, certificate is also<br \/>\n\tproduced at Page No.23 and there is also affidavit. He, therefore,<br \/>\n\tsubmitted that the present application may be allowed.\n<\/p>\n<p>Learned<br \/>\n\tA.P.P., Mr.Sejpal resisted the present application and submitted<br \/>\n\tthat the injury certificate clearly suggests that on 18.05.2010 how<br \/>\n\tshe was treated, which was found in the injury certificate. He<br \/>\n\tfurther submitted that though this statement has been given<br \/>\n\tsubsequently, she has changed her version and, therefore, it may not<br \/>\n\tbe ruled out that under the pressure, such statement\/history may<br \/>\n\thave been given before the doctor.\n<\/p>\n<p>In<br \/>\n\tview of the rival submissions, it is required to be considered<br \/>\n\twhether the present application can be entertained or not.\n<\/p>\n<p>It<br \/>\n\tis well accepted that this Court is not required to appreciate and<br \/>\n\tscrutinize the evidence in detail. However, for considering the<br \/>\n\tprima-facie case, relevant aspects like nature\/gravity of the<br \/>\n\toffence, manner in which it is alleged to have been committed, role<br \/>\n\tattributed, statement of the victim, injury certificate, medical<br \/>\n\tevidence etc. are relevant. In the facts of the present case, as it<br \/>\n\ttranspires from the history given by the victim stating in the<br \/>\n\tinjury certificate, she has stated about having married and having<br \/>\n\taffair and at the same time, as rightly submitted by learned A.P.P.<br \/>\n\tthat it also mentions about the injury caused to her immediately<br \/>\n\tafter the married on 18.05.2010, which is also mentioned. Moreover,<br \/>\n\tshe is married and she is admittedly major. Therefore, though<br \/>\n\tprima-facie case is suggested for the purpose of deciding the bail<br \/>\n\tapplication, having regard to the guidelines for the grant of bail,<br \/>\n\tthe present application deserves to be allowed.\n<\/p>\n<p>Accordingly,<br \/>\n\tpresent application stands allowed. The applicant is ordered to be<br \/>\n\treleased on regular bail in connection with I-C.R.No.212\/2010<br \/>\n\tregistered with Naroda Police Station on his executing a bond of<br \/>\n\tRs.5,000\/- (Rupees Five Thousand Only) with one solvent surety of<br \/>\n\tthe like amount to the satisfaction of the lower Court and subject<br \/>\n\tto the conditions that he shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p>(e)\tfurnish<br \/>\nthe address of his residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the Court.\n<\/p>\n<p>(f)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n<p>(g)\tmark<br \/>\nhis presence before concerned Police Station 1st day of<br \/>\nevery calender month between 11:00 AM and 2:00 PM till the trial<br \/>\ncommences.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extent.
