MUKHOPADHAYA\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.B.PARDIWALA\n\t\t\n\t\n\n \n\nDate\n: 09\/05\/2011  \nORAL ORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE J.B.PARDIWALA)<\/p>\n<p>\tThis<br \/>\nis an application for restoration of First Appeal No.1921 of 2006<br \/>\nwhich was ordered to be dismissed for non-prosecution vide order<br \/>\ndated 25th September, 2007 passed by the Division Bench of<br \/>\nthis Court.\n<\/p>\n<p>\tIn<br \/>\nthe application for restoration, it has been averred that the<br \/>\nadvocate for the applicant, all of a sudden fell sick at 10.00<br \/>\nO&#8217;clock in the morning on 25th September, 2007 and<br \/>\ntherefore, he could not remain present when the matter was called out<br \/>\nbefore the Court. This fact has not been disputed. Inspite of the<br \/>\nfact that the respondents have been served, for the reasons assigned<br \/>\nin the application and being satisfied with the ground, we order<br \/>\nrestoration of First Appeal No. 1921 of 2006.\n<\/p>\n<p>\tFirst<br \/>\nAppeal No. 1921 of 2006 is restored to its original file. The<br \/>\napplication stands disposed of accordingly.
