Justice ANTONY DOMINIC\n\n Dated :24\/06\/2008\n\n O R D E R\n                         ANTONY DOMINIC, J.\n\n              --------------------------------------------------------\n\n                        W.P.(C) 30657 of 2007\n\n              --------------------------------------------------------\n\n                         Dated: JUNE 24, 2008\n\n                                 JUDGMENT\n<\/pre>\n<p>     several reliefs are sought for in this writ petition on the<\/p>\n<p>basic allegation that in between the petitioner&#8217;s house (TC<\/p>\n<p>4\/904) and the 4th respondent&#8217;s house (TC 4\/902 &amp; 903), there is<\/p>\n<p>a canal maintained by the Minor Irrigation Department, the 5th<\/p>\n<p>respondent.     According to the petitioner, the 4th respondent<\/p>\n<p>covered the canal by putting slabs and has constructed a roof<\/p>\n<p>over the same connecting the same with his compound wall and<\/p>\n<p>is using that space as a room.             This construction, according to<\/p>\n<p>the petitioner, is not covered by any building permit and is thus<\/p>\n<p>unauthorised.\n<\/p>\n<p>     2. The 4th respondent has sworn to an affidavit contending<\/p>\n<p>that he has not made any unauthorised construction.                    According<\/p>\n<p>to him, the allegations to the contrary are all incorrect.                  But<\/p>\n<p>then, the office note of the Corporation produced along with the<\/p>\n<p>commission report as Ext.C7 and the counter statement filed by<\/p>\n<p>the Corporation suggests otherwise.                  The Corporation submits<\/p>\n<p>WP(C) 30657\/2007<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>that if there is any unauthorised construction, they will take<\/p>\n<p>appropriate action.\n<\/p>\n<p>     3.    As already noticed, while the petitioner is asserting<\/p>\n<p>that there is unauthorised construction and is drawing support<\/p>\n<p>from the Corporation, the 4th respondent is denying that<\/p>\n<p>statement.     Since this is a disputed question, I do not think it<\/p>\n<p>proper for this court to venture into an appreciation of the<\/p>\n<p>disputed findings of the Advocate Commissioner and to conclude<\/p>\n<p>on the issue one way or the other. Since rival allegations are<\/p>\n<p>made by the parties and in view of the limits of this court in a<\/p>\n<p>proceeding of this nature, I feel that what is appropriate is to<\/p>\n<p>direct the Corporation to conduct an inspection of the site in<\/p>\n<p>question and ascertain as to whether there is any unauthorised<\/p>\n<p>construction by the 4th respondent.     This necessarily shall be<\/p>\n<p>with notice to both the petitioner and the 4th respondent.<\/p>\n<p>     4.    Accordingly, I direct that the Secretary of the<\/p>\n<p>respondent Corporation shall cause an inspection of the<\/p>\n<p>premises of the petitioner and the 4th respondent conducted and<\/p>\n<p>ascertain whether there is any unauthorised construction made<\/p>\n<p>by the 4th respondent. This shall be done with notice to both<\/p>\n<p>WP(C) 30657\/2007<br \/>\n<span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>sides. If it is found that there is any unauthorised construction,<\/p>\n<p>the Secretary of the Corporation shall take appropriate action for<\/p>\n<p>remedying the situation. It is directed that this exercise shall be<\/p>\n<p>completed as expeditiously as possible, and at any rate, within<\/p>\n<p>eight weeks of production of a copy of this judgment.<\/p>\n<p>     5.
