PUBLIC PROSECUTOR for\nRespondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.B.PARDIWALA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 11\/05\/2011  \n \nORAL ORDER<\/pre>\n<p>\tRule.\n<\/p>\n<p>Learned APP, Mr Kodekar, waives service of notice of rule for and on<br \/>\nbehalf of State.\n<\/p>\n<p>2.\tThis<br \/>\nis an application under Section 439 of Criminal Procedure Code<br \/>\npraying for regular bail in connection with offence registered with<br \/>\nSahehra Police Station, vide C.R.No.I-223 of 2010  for the offences<br \/>\npunishable under Sections 306, 498A read with Section 114 of IPC.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned advocate Mr Kharadi for the applicant-accused and Mr Kodekar,<br \/>\nlearned APP for the State. Perused the FIR and papers of the<br \/>\nchargesheet.\n<\/p>\n<p>4.\tThe<br \/>\ncase against the accused-applicant is that of abetting commission of<br \/>\nsuicide by his wife. Prima-facie it appears from the nature of<br \/>\nallegations that the dispute in the family was very trivial. The<br \/>\ndeceased was married with the accused-applicant, and was unable to<br \/>\nclear her C.P. Ed. exams. This fact disturbed the accused-applicant<br \/>\nand other family members and in this regard some unwarranted remarks<br \/>\nwere being passed. This appears to be the main allegation. It also<br \/>\nappears from the FIR that time and again the deceased used to leave<br \/>\nthe matrimonial home and go to her parents house. It is evident from<br \/>\nthe FIR that every time she used to leave the house, the<br \/>\naccused-applicant, as husband, used to go to his in-laws house and<br \/>\nget back his wife. On the fateful day, it appears that the deceased<br \/>\ntook extreme step and committed suicide.\n<\/p>\n<p>5.\tHaving<br \/>\nregard to the case of the prosecution, the nature of the allegations<br \/>\nand other attending circumstances,  I am persuaded to exercise my<br \/>\ndiscretion in favour of the applicant-accused taking into<br \/>\nconsideration the following aspects :-\n<\/p>\n<p><span class=\"hidden_text\">(1)<\/span><\/p>\n<p>Investigation is over and chargesheet is filed;\n<\/p>\n<p>(2)\tPrima-facie,<br \/>\nthere does not appear to be any actual abetment at the end of the<br \/>\naccused-applicant. On plain reading of the charge-sheet papers, it<br \/>\nappears that it is not the case that a situation so alarming was<br \/>\ncreated that the deceased was left with no other option but to commit<br \/>\nsuicide;\n<\/p>\n<p>6.\tIn<br \/>\nthis view of the matter, the accused-applicant  is ordered<br \/>\nto be released on bail in connection C.R. No.I-223 of 2010 of Sahehra<br \/>\nPolice Station  on his executing a bond in the sum of Rs.15,000\/-<br \/>\n(Rupees fifteen thousand only) with solvent surety of the like amount<br \/>\nto the satisfaction of the lower Court and subject to the conditions<br \/>\nthat he shall,<\/p>\n<p>not<br \/>\n\ttake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>maintain<br \/>\n\tlaw and order;\n<\/p>\n<p>mark<br \/>\n\this presence before the concerned Police Station on every 2nd<br \/>\n\tand 4th Sunday of every month between 10:00 am to 2:00<br \/>\n\tpm:\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>furnish<br \/>\n\tthe address of his residence at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of  this<br \/>\n\tCourt;\n<\/p>\n<p>surrender<br \/>\n\this passport, if any, to the Lower Court immediately.\n<\/p>\n<p>7.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>8.\tBail<br \/>\nbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>9.\tRule<br \/>\nis made absolute.
