Justice V.GIRI\n\n Dated :13\/10\/2008\n\n O R D E R\n                       V.GIRI, J\n                     -------------------\n                  W.P.(C).29819\/2008\n                     --------------------\n       Dated this the 13th day of October, 2008\n\n                     JUDGMENT\n<\/pre>\n<p>     Petitioner is the claimant in O.P.(MV).889\/2002<\/p>\n<p>on the files of MACT, Kottayam. Award was passed<\/p>\n<p>allowing the petitioner to recover an amount of<\/p>\n<p>Rs.1,16,300\/- with 6% interest from the date of filing<\/p>\n<p>the O.P till the date of realization of the amount. An<\/p>\n<p>amount of Rs.25,000\/- was disbursed to the petitioner.<\/p>\n<p>He then filed Ext.P2 application for release of the<\/p>\n<p>entire balance amount of Rs.1,19,513\/- kept in a fixed<\/p>\n<p>deposit. The same was disposed of under Ext.P3 by<\/p>\n<p>the following order.\n<\/p>\n<\/p>\n<blockquote><p>            &#8220;Premature release for purchasing<\/p>\n<p>       property. Allowed Rs.50,000\/-. Balance to<\/p>\n<p>       be released on production of copy of Sale<\/p>\n<p>       deed executed in the name of petitioner.&#8221;<\/p>\n<\/blockquote>\n<p>2.   I heard learned counsel for the petitioner.<\/p>\n<p>Respondents may not have subsisting interest over the<\/p>\n<p>W.P.(C).29819\/2008<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>subject matter. Therefore, no notice has been issued. I<\/p>\n<p>agree with the submission of the learned counsel for the<\/p>\n<p>petitioner that the request made by the petitioner is<\/p>\n<p>covered by a direction issued by the Supreme Court in<\/p>\n<p>Susamma v. KSRTC (1994 (1) KLT, 67). In the<\/p>\n<p>circumstances,     Ext.P3 order is set aside.   MACT,<\/p>\n<p>Kottayam, shall pass fresh order permitting an amount<\/p>\n<p>of Rs.1,15,000\/- to be released to the petitioner. The<\/p>\n<p>balance amount shall also be released, on the petitioner<\/p>\n<p>producing a registration copy of the sale deed, as<\/p>\n<p>undertaken by him.
