                        ORDER ORAL
\n           Passed on this 8th day of March 2010<\/p>\n
  Writ Petition under Article 226 of the Constitution of India<\/p>\n
1.   With the consent of learned counsel appearing for the<\/p>\n
     parties, the petition is heard finally.\n<\/p>\n
2.   By this petition, the petitioner seeks a direction to
\nthe respondent authorities to conduct written examination
\nfor the post of Shiksha Karmi Grade – II afresh for the
\npetitioner.\n<\/p>\n
3.   Learned counsel appearing for the petitioner submits
\nthat pursuant to the advertisement, the petitioner applied
\nfor the post of Shiksha Karmi Grade – II.  Admit card was
\nreceived by him to appear in the written examination on 6-
\n12-2009.   On the date of examination, in the question
\nbooklet the petitioner found some discrepancies and
\nimmediately he informed the same to the authorities
\nconcerned at the examination centre, but they have not
\ntaken any action.  The petitioner also submitted a
\nrepresentation dated 11-12-2009, which is still pending
\nconsideration.  Shri Deshmukh further submits that the
\naction of the respondent authorities is illegal, arbitrary
\nand in violation of Articles 14 and 16 of the Constitution
\nof                India.\n<\/p>\n
4.   On the other hand, learned counsel appearing for the
\nrespondents submit that the candidate ought to have
\nreported the discrepancies in the question booklet within
\n15 minutes after receipt of the same to the invigilator
\nwhereas in the instant case the petitioner has reported
\nabout the discrepancies in the question booklet after
\nlapse of more than one and half hours.  Even then also the
\nauthorities of the examination centre looked into the
\ngrievances of the petitioner and provided him another set
\nof question booklet.  At the time of inspection made by
\nthe flying squad also i.e. Tahsildar, Manendragarh, the
\npetitioner has not raised any objection.  Thus, the
\npetitioner is not entitled to any relief.\n<\/p>\n
5.   I have heard learned counsel appearing for the
\nparties, perused the pleadings and the documents appended
\nthereto.\n<\/p>\n
6.   Admittedly, on the top of question booklet
\ninstructions to candidates have been printed.  In clause 4
\nit is clearly provided that “if any discrepancy is found,
\nplease inform the invigilator and get the correct
\nbooklet.”  The petitioner was expected to comply with the
\ninstructions promptly.  If on perusal it was found that
\nthe questions were not printed properly in the question
\nbooklet, the petitioner ought to have brought into notice
\nof the invigilator before writing the answers.\n<\/p>\n
7.   By letter dated 6-12-2009 (Annexure – R\/1), the
\nCenter Superintendent of the examination centre informed
\nto the Controller, Professional Examination Board that the
\npetitioner has not raised the issue immediately, as the
\nexamination commenced at 11.00 a.m. and he raised the
\nissue at about 1.00 p.m. after having answered the
\nsubstantial questions of the question booklet.  It was
\nfurther informed by the invigilator vide letter dated 6-12-
\n2009 (Annexure – R\/2) that the petitioner pointed out the
\ndefects after about one and half hours.  At the time of
\ninspection made by the Tahsildar also the petitioner has
\nnot raised any objection, which is evident from inspection
\nnote (Annexure – R\/3).\n<\/p>\n
8.   It is well settled that the examination is not the
\nprocess of selection, but also the process of elimination
\nhaving regard to the large number of candidates appearing
\nfor limited seats available. The petitioner ought to have
\nraised the issue immediately before writing answers to the
\nquestions contained in the question booklet and, as such,
\nthe petition is not sustainable.\n<\/p>\n
9.   For the reasons mentioned hereinabove, the writ
\npetition fails and is hereby dismissed.\n<\/p>\n
10.  There will be no order asto costs.\n<\/p>\n
