SHAH\n\t\t\n\t\n\n \n\nDate\n: 03\/08\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.0.\tPresent<br \/>\nSpecial Criminal Application under Article 227 of the Constitution of<br \/>\nIndia has been preferred by the petitioner-original accused of<br \/>\nCriminal Case No.2618 of 2006 to quash and set aside the impugned<br \/>\norder dated 20.5.2011 passed by the learned Sessions Judge,<br \/>\nSabarkantha at Himatnagar passed in Criminal Revision Application<br \/>\nNo.61 of 2010 as well as order passed by the learned 2nd<br \/>\nAdditional JMFC, Himatnagar passed below Exh.69 in Criminal Case<br \/>\nNo.2618 of 2006 by which the application submitted by the petitioner<br \/>\nto refer\/ send the cheque in question to the Hand Writing Expert for<br \/>\nverification of the contents in the cheque in question has been<br \/>\nrejected.\n<\/p>\n<p>2.0.\tA<br \/>\ncriminal case has been instituted against the petitioner in the Court<br \/>\nof learned JMFC, Himatnagar for the offence punishable under Section<br \/>\n138 of the Negotiable Instruments Act, 1881 for return of the cheque<br \/>\nin question.  That during the course of the trial, the petitioner<br \/>\nsubmitted the application for referring \/ sending the cheque in<br \/>\nquestion to the Hand Writing Expert \/ FSL for verification of the<br \/>\ncontents in the cheque submitting that on the cheque the signature is<br \/>\nthat of the petitioner but the contents of the cheque in question is<br \/>\nnot written by him and is by some other persons. It was the case on<br \/>\nbehalf of the petitioner that blank cheque was given to the<br \/>\ncomplainant towards the security. That the learned trial Court by<br \/>\norder dated 10.6.2010 dismissed the said application by observing<br \/>\nthat the petitioner has entered into the settlement at Exh,69 and<br \/>\nagreed to pay the amount and the petitioner has not acted as per the<br \/>\nsame and that evidence on behalf of the complainant is over and that<br \/>\nthe petitioner has admitted the signature on the cheque. Being<br \/>\naggrieved and dissatisfied with the order passed by the learned trial<br \/>\nCourt passed below Exh.69 passed in Criminal Case No.2618 of 2006,<br \/>\nthe petitioner accused has preferred Criminal Revision Application<br \/>\nbefore the learned Sessions Court, Sabarkantha at Himatnagar being<br \/>\nCriminal Revision Application No.61 of 2010, which came to be<br \/>\ndismissed by the learned Sessions Judge, Sabarkantha at Himatnagar by<br \/>\nimpugned judgment and order dated 20.5.2011. Being aggrieved and<br \/>\ndissatisfied with the order passed by both the Courts below in<br \/>\nrejecting the application submitted by the petitioner to refer \/ send<br \/>\nthe cheque in question to the FSL, petitioner-accused has preferred<br \/>\nthe present Special Criminal Application under Article 227 of the<br \/>\nConstitution of India.\n<\/p>\n<p>3.0.\tShri<br \/>\nHavewalla, learned advocate for the petitioner has vehemently<br \/>\nsubmitted that both the Courts below have materially erred in<br \/>\nrejecting the application submitted by the petitioner to refer the<br \/>\ncheque in question to the FSL. It is submitted that as such from the<br \/>\nvery beginning the case on behalf of the petitioner was that the<br \/>\nblank cheque was given to the complainant as a security and the<br \/>\ncontents in the cheque in question are not written by the petitioner.<br \/>\nTherefore, it is submitted that a reasonable opportunity ought to<br \/>\nhave been given to the petitioner to defend himself. Relying upon the<br \/>\ndecision of the Hon&#8217;ble Supreme Court in the case of <a href=\"\/doc\/1006308\/\">T.Nagappa v.<br \/>\nY.R. Muraidhar<\/a> reported in<br \/>\n(2008) 5 SCC 633, it<br \/>\nis requested to allow the present Special Criminal Application.\n<\/p>\n<p>4.0.\tHeard<br \/>\nlearned advocate Shri Havewala, for the petitioner and<br \/>\nconsidered the impugned order passed by both the Courts below in<br \/>\nrejecting the application submitted by the petitioner -accused to<br \/>\nsend \/ refer the cheque in question to the FSL\/ Hand Writing Expert.<br \/>\nAt the outset, it is required to be noted that as such the petitioner<br \/>\nhas admitted the signature on the cheque in question. It is also not<br \/>\nin dispute that petitioner had in fact given the cheque in question<br \/>\nto the complainant. As held by this Court in the case of Hitenbhai<br \/>\nParekh Proprietor-Parekh Enterprise v. State of Gujarat reported<br \/>\nin 2009(3) GLH 742,<br \/>\nit will always be open for the holder of the cheque to fill in the<br \/>\nblanks in its own handwriting and there is an implied authority for<br \/>\nthe person receiving such cheque to complete it by filling blanks.<br \/>\nWhen a cheque has been issued and signed by the party there is always<br \/>\na presumption with respect to legal debt as per Section 139 of the<br \/>\nNegotiable Instruments Act, 1881. Of course, the same is rebuttable<br \/>\nby leading evidence that there was no debt for which the cheque was<br \/>\nissued and\/ or cheque amount has been repaid. When a pointed question<br \/>\nwas asked to the learned<br \/>\nadvocate for the petitioner that assuming that it is found that the<br \/>\ncontents in the cheque is not in the handwriting of the petitioner<br \/>\nand \/ or same is in the handwriting of the complainant what would be<br \/>\neffect on the merits of the case and \/ or still the petitioner is<br \/>\nrequired to rebut the presumption with respect to the debt, learned<br \/>\nadvocate for the petitioner has no answer. Under the circumstances<br \/>\nand more particularly when the petitioner has admitted the signature<br \/>\non the cheque and he has also admitted that the cheque in question<br \/>\nwas given to the original complainant, considering the decision of<br \/>\nthis Court referred to hereinabove, it cannot be said that both the<br \/>\nCourts below have committed any error and\/ or illegality in<br \/>\ndismissing the application submitted by the petitioner to refer\/ send<br \/>\nthe cheque to the FSL and\/ or Handwriting Expert.\n<\/p>\n<p>5.0.\tNow,<br \/>\nso far as reliance placed upon the decision of the Hon&#8217;ble Supreme<br \/>\nCourt in the case of T.Nagappa (Supra)<br \/>\nis concerned, on facts the said decision would not be of any<br \/>\nassistance to the petitioner. In the case before the Hon&#8217;ble Supreme<br \/>\nCourt the accused requested to refer the cheque in question for<br \/>\nexamination by the Director of FSL for determining the age of his<br \/>\nsignature and that is not the case here.
