THE DISTRICT ENGINEER ZILA PARISHAD , EAST CHAMPARAN\n          AT MOTIHARI\n                              -----------\n<\/pre>\n<p>02.   25.02.2011             Heard learned counsel for the petitioner and<\/p>\n<p>                   learned counsel for the State.\n<\/p>\n<p>                             The petitioner is stated to be the Chairman<\/p>\n<p>                   of the Zila Parishad, Motihari, East Champaran. She is<\/p>\n<p>                   aggrieved by the communication dated 8.10.2009<\/p>\n<p>                   made    by     the   Deputy      Development-Cum-Chief<\/p>\n<p>                   Executive Officer of the Zila Parishad, informing her<\/p>\n<p>                   that insofar as the schemes and execution thereof<\/p>\n<p>                   under the National Rural Employment Guarantee<\/p>\n<p>                   Programme are concerned, the District Magistrate-<\/p>\n<p>                   Cum-District    Programme     Co-coordinator,   was   the<\/p>\n<p>                   competent authority to decide on issues and that she<\/p>\n<p>                   should not correspond with the Deputy Development-<\/p>\n<p>                   Cum-Chief Executive Officer.\n<\/p>\n<p><span class=\"hidden_text\">                      2<\/span><\/p>\n<p>           The controversy in the present case appears<\/p>\n<p>to be relating to the scope and extent for exercise of<\/p>\n<p>powers in a democracy at the grass root level by<\/p>\n<p>elected    functionaries     to   be    balanced   with   the<\/p>\n<p>regulatory power of the State in the particular nature<\/p>\n<p>of   the   present       scheme   funded   by   the   Central<\/p>\n<p>Government and by the State Government. Therefore<\/p>\n<p>the provisions of the Bihar Panchayat Raj Act, 2006<\/p>\n<p>shall have to be read subservient to the National Rural<\/p>\n<p>Employment Guarantee Act in view of Section 28 of the<\/p>\n<p>latter Act, keeping in mind the distinction under the<\/p>\n<p>former Act based on its own revenues. Where the<\/p>\n<p>Revenues for execution of the scheme came from the<\/p>\n<p>Central Government and State Government, surely the<\/p>\n<p>person who provides the Revenue retains the power for<\/p>\n<p>regulatory control in accordance with law.<\/p>\n<p>           If a priority list of works has been prepared<\/p>\n<p>by the Zila Parishad and if the priority serial is varied<\/p>\n<p>and any scheme desired by the Zila parishad is not<\/p>\n<p>approved by the funding authority, the petitioner has<\/p>\n<p>adequate remedy before the State Government under<\/p>\n<p>Section    19   of   the     National   Rural   Employment<\/p>\n<p>Guarantee Act. If so advised, the petitioner may<\/p>\n<p>represent before the State Government which shall be<\/p>\n<p>decided in accordance with law by a reasoned and<br \/>\n<span class=\"hidden_text\">                            3<\/span><\/p>\n<p>       speaking order.\n<\/p>\n<p>                 Since the matter relates to working of grass<\/p>\n<p>       roots   democracy       and   developmental   schemes   by<\/p>\n<p>       generating employment, the Court expects that the<\/p>\n<p>       State Government shall dispose off the objections, if<\/p>\n<p>       any, at the earliest so that in the tussle developmental<\/p>\n<p>       schemes are not hampered.\n<\/p>\n<p>                 The writ application stands disposed.<\/p>\n<pre>P.K.
