Justice K.T.SANKARAN\n\n Dated :18\/06\/2010\n\n O R D E R\n                       K.T.SANKARAN, J.\n                 ---------------------------------------------\n                   W.P.(C).No.2405 of 2008\n                 ---------------------------------------------\n              Dated this the 18th day of June, 2010\n\n\n\n                            JUDGMENT\n<\/pre>\n<p>     The petitioners were appointed as Senior Government<\/p>\n<p>Pleaders in the Lok Ayukta as per Ext.P2 order dated 4.9.2001.<\/p>\n<p>The rules governing the service of the Government Pleaders in<\/p>\n<p>Lok Ayukta were framed as per Ext.P1 dated 5.12.2000 (SRO<\/p>\n<p>No.1120 of 2000). The petitioners were appointed on a monthly<\/p>\n<p>remuneration of Rs.12,000\/- + Rs.2,500\/-, towards conveyance<\/p>\n<p>and telephone allowances.\n<\/p>\n<\/p>\n<p>     2.   Rule 3(1) of the Kerala Lok Ayukta Special Attorney<\/p>\n<p>and Senior Government Pleaders (Appointment and Conditions<\/p>\n<p>of Service) Rules, 2000 provides for the qualification for being<\/p>\n<p>appointed as Senior Government Pleader. A Senior Government<\/p>\n<p>Pleader should have not less than seven years of practice at the<\/p>\n<p>Bar.   Rule 7 provides for the duties of Senior Government<\/p>\n<p>Pleaders.\n<\/p>\n<p><span class=\"hidden_text\">WPC 2405\/2008                   2<\/span><\/p>\n<p>      3.   The petitioners submitted Ext.P6 representation dated<\/p>\n<p>15.2.2005 to the Government pointing out that at the time of the<\/p>\n<p>appointment of the petitioners, they were given the salary equal<\/p>\n<p>to the salary of Senior Government Pleaders in the High Court.<\/p>\n<p>Though the salary of the Senior      Government Pleaders and<\/p>\n<p>Government Pleaders in the High Court were enhanced, the<\/p>\n<p>petitioners were not given any enhancement of salary. It was<\/p>\n<p>requested in Ext.P6 that the salary may be enhanced to<\/p>\n<p>Rs.18,000\/- and allowances to Rs.2,500\/-. Ext.P6 representation<\/p>\n<p>was recommended by the Director General of Prosecution as per<\/p>\n<p>Ext.P6(a). He requested that the benefits declared in G.O.(MS)<\/p>\n<p>No.180\/04\/Law dated 16.11.2004 may be extended to the<\/p>\n<p>Government Pleaders who are working in the office of the<\/p>\n<p>Special Attorney to the Kerala Lok Ayukta also.          Ext.P6<\/p>\n<p>representation was rejected by Ext.P7 letter issued by the<\/p>\n<p>Government. The letter reads as follows:\n<\/p>\n<\/p>\n<blockquote><p>                &#8220;I am directed to invite your attention to<\/p>\n<p>           the reference cited and to inform you that the<\/p>\n<p>           nature of work of Government Pleaders and<\/p>\n<p>           that of Government Pleaders of Kerala Lok<\/p>\n<p><span class=\"hidden_text\">WPC 2405\/2008                   3<\/span><\/p>\n<p>           Ayukta have no comparison.   The number of<\/p>\n<p>           cases and urgency to deal with those cases in<\/p>\n<p>           the High Court are enormous and highly<\/p>\n<p>           demanding, whereas in the Lok Ayukta it is of a<\/p>\n<p>           routine nature. I am therefore to convey the<\/p>\n<p>           inability of  Government   to  consider    the<\/p>\n<p>           proposal for enhancement of remuneration of<\/p>\n<p>           the Senior Government Pleaders.&#8221;<\/p><\/blockquote>\n<p>     4.    The petitioners submitted Ext.P11 representation<\/p>\n<p>dated 30.3.2007 requesting to review the decision taken by the<\/p>\n<p>Government    in   Ext.P7  letter. The  Director   General  of<\/p>\n<p>Prosecution again gave a letter recommending the request made<\/p>\n<p>by the petitioners, as per Ext.P12 dated 3.4.2007.         The<\/p>\n<p>Government considered the matter and passed Ext.P13 order<\/p>\n<p>dated 28.11.2007 which reads as follows:\n<\/p>\n<\/p>\n<blockquote><p>                &#8220;As per the Government order read as 1st<\/p>\n<p>           paper    above,  Government   had   fixed     a<\/p>\n<p>           consolidated remuneration of Rs.12,000\/- plus<\/p>\n<p>           Rs.2,500\/-  p.m.  towards   Conveyance     and<\/p>\n<p>           Telephone Allowance to the Senior Government<\/p>\n<p>           Pleaders under the Special Attorney, Kerala<\/p>\n<p>           Lok Ayukta.\n<\/p><\/blockquote>\n<blockquote><p><span class=\"hidden_text\">WPC 2405\/2008                   4<\/span><\/p>\n<\/blockquote>\n<blockquote><p>                As per the representation read as 2nd<\/p>\n<p>           paper above, the Senior Government Pleaders,<\/p>\n<p>           Kerala Lok Ayukta have requested Government<\/p>\n<p>           to enhance their remuneration on par with that<\/p>\n<p>           of the Senior Government Pleaders of the<\/p>\n<p>           Hon&#8217;ble High Court of Kerala.\n<\/p><\/blockquote>\n<blockquote><p>                Government have examined the matter in<\/p>\n<p>           detail and are pleased to revise the monthly<\/p>\n<p>           consolidated   remuneration    of  the   Senior<\/p>\n<p>           Government     Pleaders   under   the   Special<\/p>\n<p>           Attorney, Kerala Lok Ayukta as Rs.15,000\/- +<\/p>\n<p>           Rs.2,500\/- as allowances with prospective<\/p>\n<p>           effect.&#8221;<\/p><\/blockquote>\n<p>      5.   The grievance of the petitioners is that though the<\/p>\n<p>salary of the Special Government Pleaders was enhanced to<\/p>\n<p>Rs.15,000\/- and allowances to Rs.2,500\/- as per Ext.P13, that was<\/p>\n<p>given only with prospective effect.      The contention of the<\/p>\n<p>petitioners is that at least the benefit of Ext.P13 should have<\/p>\n<p>been granted to the petitioners also.\n<\/p>\n<\/p>\n<p>      6.   It is pointed out that in 1996, the salary of the<\/p>\n<p>Government Pleaders and Senior Government Pleaders in the<\/p>\n<p><span class=\"hidden_text\">WPC 2405\/2008                    5<\/span><\/p>\n<p>High Court was Rs.7,000\/- and Rs.8,000\/- respectively. In the<\/p>\n<p>year 2000, it was enhanced as Rs.10,000\/- + Rs.2,500\/- and<\/p>\n<p>Rs.12,000\/-+Rs.2,500\/- respectively with effect from 1.1.1999 as<\/p>\n<p>per Ext.P15 G.O.(MS) No.363\/2000\/Law dated 26.6.2000. Their<\/p>\n<p>salary was enhanced to Rs.15,000+Rs.2,500\/- and Rs.18,000\/-+<\/p>\n<p>Rs.2,500\/- respectively with effect from 1.4.2004 as per Ext.P5<\/p>\n<p>G.O.(MS)No.180\/04\/Law dated 16.11.2004.\n<\/p>\n<\/p>\n<p>      7.   The contention of the petitioners is that though at the<\/p>\n<p>time of their appointment, they were treated at par with the<\/p>\n<p>Senior Government Pleaders of the High Court, and though from<\/p>\n<p>16.11.2004, the salary of the Senior Government Pleaders was<\/p>\n<p>enhanced to Rs.18,000\/- and the salary of the Government<\/p>\n<p>Pleaders was enhanced to Rs.15,000\/-, the salary of the<\/p>\n<p>petitioners continued at the rate of Rs.12,000\/- + Rs.2,500\/-. It<\/p>\n<p>is submitted that even if the Special Government Pleaders of<\/p>\n<p>Lok Ayukta are treated as equivalent to the Government<\/p>\n<p>Pleaders of the High Court, the petitioners should have been<\/p>\n<p>paid at least Rs.15,000\/- + Rs.2,500\/-.\n<\/p>\n<p><span class=\"hidden_text\">WPC 2405\/2008                    6<\/span><\/p>\n<p>     8.    On the basis of Ext.P11 representation dated<\/p>\n<p>30.3.2007, the Government enhanced the salary of the Senior<\/p>\n<p>Government Pleaders under the Special Attorney of Lok Ayukta<\/p>\n<p>as per Ext.P13 dated 28.11.2007. It is submitted that when the<\/p>\n<p>present Government took over, the petitioners resigned as per<\/p>\n<p>Ext.P9 letter dated 22.3.2007. However, they were directed to<\/p>\n<p>continue in service till the new Senior Government Pleaders<\/p>\n<p>were appointed.\n<\/p>\n<\/p>\n<p>     9.    The learned Special Government Pleader submitted<\/p>\n<p>that the qualification prescribed for Senior Government Pleaders<\/p>\n<p>in the High Court is ten years practice at the Bar out of which<\/p>\n<p>five years shall be in the High Court, going by Rule 5 of the<\/p>\n<p>Kerala Government Law Officers (Appointment and Conditions of<\/p>\n<p>Service) and Conduct of Cases Rules 1978.       As per the said<\/p>\n<p>Rules, qualification prescribed for Government Pleaders is seven<\/p>\n<p>years experience at the Bar out of which three years shall be in<\/p>\n<p>the High Court. The qualification for being appointed as Senior<\/p>\n<p>Government Pleader in the Lok Ayukta is seven years of practice<\/p>\n<p>at the Bar. It is also submitted that the Government Pleaders of<\/p>\n<p><span class=\"hidden_text\">WPC 2405\/2008                   7<\/span><\/p>\n<p>the High Court and the Senior Government Pleaders of Lok<\/p>\n<p>Ayukta cannot be treated on par and the nature of work and<\/p>\n<p>duties are quite different and distinct.    The workload of the<\/p>\n<p>Government Pleaders in the High Court is much higher than that<\/p>\n<p>of the Senior Government Pleaders in the Lok Ayukta. It is also<\/p>\n<p>submitted by the Special Government Pleader that the<\/p>\n<p>Government thought it fit to give only prospective effect to the<\/p>\n<p>enhancement of remuneration as per Ext.P13 order and that the<\/p>\n<p>Court cannot substitute its wisdom over the decision taken by<\/p>\n<p>the Government.\n<\/p>\n<p>     10. It is not disputed that from 16.11.2004, the<\/p>\n<p>Government Pleaders of the High Court were granted<\/p>\n<p>remuneration at the rate of Rs.15,000\/- +Rs.2,500\/- per month.<\/p>\n<p>At the time of appointment, the petitioners were given the same<\/p>\n<p>remuneration as that of the Senior Government Pleaders of the<\/p>\n<p>High Court.    Even if the salary equal to that of the Senior<\/p>\n<p>Government Pleaders of the High Court is not given to the<\/p>\n<p>Senior Government Pleaders of Lok Ayukta, it would appear to<\/p>\n<p>be reasonable that at least the petitioners could be provided the<\/p>\n<p>same benefit as would be available to the Government Pleaders<\/p>\n<p><span class=\"hidden_text\">WPC 2405\/2008                   8<\/span><\/p>\n<p>of the High Court, as is now done as per Ext.P13 order. The<\/p>\n<p>Government did not consider at least this request while<\/p>\n<p>disposing of Ext.P11 representation as per Ext.P13 order. Taking<\/p>\n<p>into account the present position of the Senior Government<\/p>\n<p>Pleaders in Lok Ayukta as per Ext.P13 order and the position of<\/p>\n<p>the petitioners at the time of their appointment and also taking<\/p>\n<p>into account all the other relevant facts and circumstances, it is<\/p>\n<p>only proper to direct the Government to reconsider the matter. A<\/p>\n<p>sympathetic consideration would not cause much financial<\/p>\n<p>burden to the Government in this regard. Let a final decision be<\/p>\n<p>taken by the Government within a period of three months from<\/p>\n<p>today.
