    Revision  petitioner  is  the  accused  and<\/p>\n
first    respondent    the    complainant    in<\/p>\n
C.C.108\/2005 on the file of Judicial First<\/p>\n
Class    Magistrate-I,     Haripad.    Revision<\/p>\n
petitioner was convicted and sentenced for the<\/p>\n
offence  under   section   138  of   Negotiable<\/p>\n
Instruments   Act.        Revision   petitioner<\/p>\n
challenged  the  conviction  before  Additional<\/p>\n
Sessions Court, Mavelikara in Crl.A.59\/2007.<\/p>\n
Learned   Additional    Sessions    Judge    on<\/p>\n
reappreciation  of   evidence   confirmed   the<\/p>\n
conviction and  modified the sentence to simple<\/p>\n
imprisonment   for    three   months   and    a<\/p>\n
compensation of Rs.1,00,000\/- and in default<\/p>\n
simple imprisonment for two months.    Revision<\/p>\n
is filed challenging the conviction.<\/p>\n

     2.      Learned counsel appearing for revision<\/p>\n
petitioner was heard.\n<\/p>\n
     3.     Learned counsel submitted that in view of<\/p>\n
the evidence on record and the concurrent findings<\/p>\n
of fact     revision petitioner is not challenging the<\/p>\n
conviction but sentence may be modified and time<\/p>\n
may be granted to the revision petitioner to pay<\/p>\n
the amount.\n<\/p>\n
     4.      On going through the judgments of the<\/p>\n
courts below, I find no reason to interfere with<\/p>\n
the conviction.\n<\/p>\n
     5.    The evidence of DW1 who was examined by the<\/p>\n
revision     petitioner   himself     establish   that<\/p>\n
revision     petitioner  borrowed  Rs.1,00,000\/-  from<\/p>\n
first respondent and towards its repayment issued<\/p>\n
Ext.P1 cheque which was dishonoured for want of<\/p>\n
sufficient funds.      It is also proved that first<\/p>\n
respondent     had  complied   with  all     statutory<\/p>\n
formalities provided under section 138 and 142 of<\/p>\n
Negotiable Instruments Act.     Conviction of revision<\/p>\n
CRRP 352\/2009              3<\/span><\/p>\n
petitioner for the offence under section 138 of<\/p>\n
Negotiable Instruments Act is perfectly legal.<\/p>\n
     6.     Then the only question is regarding the<\/p>\n
sentence.     The sentence modified by the learned<\/p>\n
Sessions Judge is simple imprisonment for three<\/p>\n
months and compensation which was        the amount<\/p>\n
covered by the dishonoured cheque with a default<\/p>\n
sentence.     So long as the sentence is not altered<\/p>\n
or    modified    against  the  interest  of   first<\/p>\n
respondent, it is not necessary to issue notice to<\/p>\n
first respondent.     As per   the modified sentence<\/p>\n
first respondent is entitled to a compensation of<\/p>\n
Rs.1,00,000\/-.\n<\/p>\n
     7.       Considering  the   entire  facts   and<\/p>\n
circumstances of the case, interest of justice will<\/p>\n
be met if the sentence is modified to imprisonment<\/p>\n
till rising of court     with a direction to pay the<\/p>\n
fine    on   realisation   to  first  respondent  as<\/p>\n
compensation.\n<\/p>\n
     Revision is allowed in part.      Conviction of<\/p>\n
CRRP 352\/2009             4<\/span><\/p>\n
revision petitioner for the offence under section<\/p>\n
138 of Negotiable Instruments Act is confirmed.<\/p>\n
Sentence     is modified.  Revision  petitioner  is<\/p>\n
sentenced to imprisonment till rising of court and<\/p>\n
a fine of Rs.1,05,000\/- and in default simple<\/p>\n
imprisonment for two months.     On realisation of<\/p>\n
fine, Rs.1,00,000\/- to be paid to first respondent<\/p>\n
as compensation under section 357(1)(b) of the Code<\/p>\n
of Criminal Procedure.     Revision petitioner is<\/p>\n
directed to appear before the Judicial First Class<\/p>\n
Magistrate-I, Haripad on 1.6.2009.<\/p>\n
