Justice K.SURENDRA MOHAN\n\n Dated :12\/01\/2011\n\n O R D E R\n                        R.BASANT &amp;\n               K.SURENDRA MOHAN, JJ.\n            -------------------------------------------\n                   WPC No.263 of 2011\n            -------------------------------------------\n           Dated this the 12th January, 2011\n\n                         JUDGMENT\n<\/pre>\n<p>Basant, J.\n<\/p>\n<p>      The petitioner has come to this Court with this<\/p>\n<p>petition for issue of directions under Article 226 of the<\/p>\n<p>Constitution to respondents 1 and 2 to oblige them to<\/p>\n<p>grant police protection to the petitioner against the<\/p>\n<p>culpable, violent and objectionable conduct of respondent<\/p>\n<p>No.3.\n<\/p>\n<p>      2.   The petitioner and respondent No.3 are<\/p>\n<p>neighbours. They reside in adjacent house. Relationship<\/p>\n<p>between them is strained. Earlier, the petitioner&#8217;s wife<\/p>\n<p>had come to this Court with a petition for police protection<\/p>\n<p>and by Ext.P3 judgment, another Bench of this Court had<\/p>\n<p>passed orders, the relevant portion of which is extracted<\/p>\n<p>below.\n<\/p>\n<blockquote><p>     &#8220;Learned Government Pleader, on instruction,<br \/>\n     submits that there is a case and counter case.<br \/>\n     Be that as it may, there will be a direction to<br \/>\n     the police to ensure that law and order is<br \/>\n     maintained. In case, there is a request by any<br \/>\n     of the parties to provide protection for life, the<br \/>\n     same shall be granted at the expense of the<br \/>\n     party requiring the same.\n<\/p><\/blockquote>\n<blockquote><p>          Writ Petition is disposed of as above&#8221;.<\/p><\/blockquote>\n<p>      3. Later, the wife of the petitioner came before this<\/p>\n<p>Court again to review and clarify Ext.P3 judgment. The<\/p>\n<p><span class=\"hidden_text\">WPC No.263\/2011             2<\/span><\/p>\n<p>  Bench which passed Ext.P3 judgment considered the<\/p>\n<p>  matter again and rejected the review petition, but made<\/p>\n<p>  further observations.      We extract below the relevant<\/p>\n<p>  portion of Ext.P5 judgment.\n<\/p>\n<blockquote><p>          &#8220;In the petition, the petitioner did not<br \/>\n          specifically raise any ground pointing out<br \/>\n          the error apparent on the face of the<br \/>\n          judgment dated 4.12.2009 for exercising<br \/>\n          the   power    to  review  the   judgment.<br \/>\n          Therefore, the prayer made in the review<br \/>\n          petition is rejected. However, it is made<br \/>\n          clear that this order will not and cannot<br \/>\n          stand in the way of respondents 1 and 2<br \/>\n          taking action in accordance with law<br \/>\n          against any of the parties to the writ<br \/>\n          petition.&#8221;<\/p><\/blockquote>\n<p>          According to the petitioner, now, not the wife of the<\/p>\n<p>  petitioner, but the petitioner has chosen to wear the<\/p>\n<p>  mantle of the petitioner in this petition. The crux of the<\/p>\n<p>  grievance of the petitioner is that in spite of Exts.P3 and<\/p>\n<p>  P5, respondent No.3 is continuing to indulge in<\/p>\n<p>  contumacious conduct.        A crime has been registered<\/p>\n<p>  subsequently. In these circumstances, fresh directions<\/p>\n<p>  may be issued, it is prayed.\n<\/p>\n<p>         4.   Notice   was   ordered   to  the   respondents.<\/p>\n<p>  Respondent No.3 has entered appearance. The prayer is<\/p>\n<p>  opposed by respondent No.3. Adequate safe guards have<\/p>\n<p><span class=\"hidden_text\">WPC No.263\/2011             3<\/span><\/p>\n<p>  already been made and directions issued in Exts.P3 and<\/p>\n<p>  P5 and it is not necessary to issue any further directions,<\/p>\n<p>  submits the learned counsel for the third respondent.<\/p>\n<p>  According to the third respondent, the boot is on the other<\/p>\n<p>  leg and it is the petitioner and his family members who<\/p>\n<p>  are indulging in objectionable and contumacious conduct.<\/p>\n<p>  The petition is without any merit. Sufficient directions<\/p>\n<p>  have already been issued in Exts.P3 and P5. No further<\/p>\n<p>  directions may be issued, it is prayed.<\/p>\n<p>         5. The learned Government Pleader, after taking<\/p>\n<p>  instructions, submits that Exts.P3 and P5 orders are being<\/p>\n<p>  scrupulously observed. The petitioner had subsequently<\/p>\n<p>  filed a private complaint against the third respondent<\/p>\n<p>  before the Magistrate. It was referred to the police for<\/p>\n<p>  investigation. In the investigation, the allegations were<\/p>\n<p>  found to be not true and the case was referred. Still later,<\/p>\n<p>  another      crime  was    registered.  That      is  Ext.P6.<\/p>\n<p>  Investigation was completed. Necessary action was taken<\/p>\n<p>  by the police and final report has already been filed. In<\/p>\n<p>  the perception of respondents 1 and 2, there is no threat<\/p>\n<p>  to the safety of the petitioner now and if at all there is any<\/p>\n<p>  such threat, necessary action under Exts.P3 and P5 can<\/p>\n<p><span class=\"hidden_text\">WPC No.263\/2011            4<\/span><\/p>\n<p>  and shall be taken. No further directions are necessary,<\/p>\n<p>  submits the learned Government Pleader.<\/p>\n<p>         6.    We   have   considered    all the   relevant<\/p>\n<p>  circumstances.     We are of the opinion that sufficient<\/p>\n<p>  specific directions have already been issued in Exts.P3<\/p>\n<p>  and P5. We record the submission of the third respondent<\/p>\n<p>  that the third respondent shall not in any way indulge in<\/p>\n<p>  contumacious conduct against the petitioner or his wife.<\/p>\n<p>  We record the submission of the learned Government<\/p>\n<p>  Pleader that if there is any request in terms of Exts.P3<\/p>\n<p>  and P5, necessary action shall be taken by the police. In<\/p>\n<p>  these circumstances, we are satisfied that it is not<\/p>\n<p>  necessary to invoke the jurisdiction under Article 226 of<\/p>\n<p>  the Constitution to arm the petitioner with any further<\/p>\n<p>  orders.
