L. Pandya, learned APP waives service of Rule on behalf of<br \/>\nthe respondent-State.  Learned advocate Mr.Shakil Qureshi is<br \/>\npermitted to file vakalatnama for complainant.\n<\/p>\n<p>2.\tThis<br \/>\nApplication is filed by the applicant under Section-438 Cr. P.C. in<br \/>\nconnection with CR No. I-131 of<br \/>\n2011 registered with Karelibaug Police Station,  Vadodara City<br \/>\nfor the offences punishable under Sections 465, 467, 468, 471 and<br \/>\n120-B of the Indian Penal Code.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate appearing for applicant has contended that present applicant<br \/>\nis husband of complainant.  He has contended that from the papers, it<br \/>\nis established that dispute is regarding property and said property<br \/>\nis purchased by him and only due to question of sell of it, present<br \/>\ncomplaint is filed by wife of applicant.  The applicant is not<br \/>\ninvolved in the present case.   There is no prima facie evidence to<br \/>\nclub the present applicant in the offence alleged against him.<br \/>\nLearned advocate has also contended that the documents are in custody<br \/>\nof police.\n<\/p>\n<p>4.\tLearned<br \/>\nAPP has vehemently opposed this application.  He has read the FIR and<br \/>\ncontended that from the documentary evidence, it is established that<br \/>\nthe applicant is involved in the offenece alleged and therefore, bail<br \/>\nmay not be granted to the applicant.  Learned counsel Mr. Shakil<br \/>\nQureshi also opposed this application by supporting the contentions<br \/>\nof learned APP.\n<\/p>\n<p>5.\tHeard<br \/>\nlearned Counsel for the parties and perused the record produced<br \/>\nbefore the Court in detail. Learned Counsel for the parties do not<br \/>\npress for reasoned order.  It appears that the dispute is between the<br \/>\nhusband and wife.  Even from the perusal of papers, it appears that<br \/>\nthe dispute is of civil nature and civil case is pending before civil<br \/>\ncourt.  Therefore, considering the facts of the case, I am inclined<br \/>\nto grant anticipatory bail to the applicant.\n<\/p>\n<p>6.\tIn<br \/>\nthe result, this application is allowed by directing that in the<br \/>\nevent of the applicant herein<br \/>\nbeing arrested pursuant CR No.I-131 of 2011, registered<br \/>\nwith Karelibaug Police Station, Vadodara City, the applicant shall be<br \/>\nreleased on Bail on his furnishing a Bond of Rs.10,000\/- (Rupees ten<br \/>\nthousand only) with one surety of like amount on condition that &#8211;\n<\/p>\n<p>a)\the<br \/>\nshall co-operate with the investigation and make himself available<br \/>\nwhenever required;\n<\/p>\n<p>b)\the<br \/>\nshall remain present before the Investigating Officer, Karelibaug<br \/>\nPolice Station, Vadodara, on 30th<br \/>\nSeptember, 2011 at 11.00 am.\n<\/p>\n<p>c)\the<br \/>\nshall not hamper the investigation in any manner nor shall directly<br \/>\nor indirectly make any inducement, threat or promise to any witness<br \/>\nso as to dissuade them for disclosing such facts to the Court or to<br \/>\nany Police Officer;\n<\/p>\n<p>d)\tAt<br \/>\nthe time of execution of Bond, he shall furnish his address to the<br \/>\nI.O. and the Court concerned and shall not change the residence till<br \/>\nthe final disposal of the case or till further orders;\n<\/p>\n<p>e)\tthat<br \/>\nhe will not leave India without the permission of the Court and, if<br \/>\nis holding a Passport, surrender the same before the trial Court<br \/>\nimmediately;\n<\/p>\n<p>f)\tIt<br \/>\nwould be open to the Investigating Officer to \tfile an application<br \/>\nfor remand, if considers it just and proper and the concerned<br \/>\nMagistrate would decide it on merits;\n<\/p>\n<p>g)\tthis<br \/>\norder will be operative if the applicant is arrested at any time<br \/>\nwithin a period of 90 days;\n<\/p>\n<p>h)\twithin<br \/>\na period of ten days from the date of arrest, the applicant shall<br \/>\napply for regular bail which application shall be decided by the<br \/>\ncompetent Court in accordance with law without being influenced by<br \/>\nthe fact that anticipatory bail was granted.\n<\/p>\n<p>7.\tLearned<br \/>\nadvocate for the applicant assured that applicant will appear before<br \/>\nconcerned police station as per direction of this Court.\n<\/p>\n<p>8.\tWith<br \/>\nthese directions, this Criminal Miscellaneous Application is disposed<br \/>\nof. Rule is made absolute.
