(a) f’vPay_the sum of Rs.69,037\/– being the<\/p>\n
balance of Ex~\u00bbGratia\/Gratuity amount<\/p>\n
. due to the petitioner under the<\/p>\n
 Voluntary Retirement Scheme; the<\/p>\n
C sum of Rs.7,0375\/– being the excess<\/p>\n
amount deducted as per Annexure~E<\/p>\n
together with interest at such rate as
\nthis I-Ion’ble Court deems meet.\n<\/p>\n
(‘0) Pay interest at the rate as directed by
\nthis I-Ion’ble Court in W.P. 29760-\n<\/p>\n

4. The petitioner was working asa SLip_erintend.ent  f<\/p>\n
the Belgaum branch of the,a’first respondente\ufb01iorvporatjioni. <\/p>\n
On 5–9–2003, the first responideViitr~Oorporatiori iritroduced
\nthe Voluntary Retirement   \/l;nnei)l:iure–A. The<\/p>\n
petitioner opted for the vol.t1ntar_”\u00a7r  scheme. On<\/p>\n
28-1ad\u00bb2OO3;7.ipetitionerlsaiapplication was accepted and he
\nwas relieved from th effect from 31-10-2003. The<\/p>\n
petiti.0neriiiha._d ptit  service of 28 years and 10 months<\/p>\n
 zpw\ufb01tsilireiliieived. The Head Office of the first<\/p>\n
‘V’responrzieiz\ufb01i\ufb01oijporation had deducted a sum of<\/p>\n
’12g\u00a7’\u00a77,135’\/’\u00a7l__{instead of RS100\/–. On 31-10-2003, the<\/p>\n
}3e1g’anrn Office issued a statement as per Annexure~\u00bbE<\/p>\n
 _stat_.ing that the first respondent has to refund excess<\/p>\n
lgdeduction of Rs.7,035\/-. The petitioner contends, in all,<\/p>\n
7<\/span><\/p>\n
t.,\/<\/p>\n
he has to be paid a sum of Rs.5,67,240\/– and only a sum<\/p>\n
of Rs.4,98,203\/– has been paid, that too, in .three<\/p>\n
instalments. According to him, the first respondent.hasf.to’\u00ab 2<\/p>\n
pay a sum of Rs.69,037\/-~.\n<\/p>\n
5. The petitioner contends :that”the first <\/p>\n
has calculated the amount arbitrar_ily_\\ivithouti <\/p>\n
the details. it is also staiteq\u00e9’-\u00ab..ftV1e other  ‘had
\napproached this Court in l*\u00ab”;P..l$:1’o.f2’t9_76O~:762,’2004 and
\nthis Court directed the respondient  the claim.<\/p>\n
6. There.:i’s.__no  onpbfehalf of the first<\/p>\n
respondent;  se<:.og1\u00e9i–v.._respo11dent is only a formal<\/p>\n

\/’ u T he learned counsel for the petitioner contended<\/p>\n
that as again_:st’th’e claim of Rs.5,67,240\/–, only a sum of<\/p>\n
  haisiiiiibieen paid. He also submitted that<\/p>\n

 directed to pay the amount with interest.<\/p>\n

\nbeen disputed. .\u00ab.’Ilherefor—e,. itherepiirs  to disbelieve
\nthe claim    shows that the
\nfirst   a sum of Rs.7,035\/–\n<\/p>\n
towards _excess..deAd’utction”.’Therefore, it is proper to direct
\nthe. — first ilresitlpondent  pay the amount due to the<\/p>\n
  -lfkccosrdingly, the writ petition is allowed and<\/p>\n
the \ufb01rstihgrespondent is directed to pay a sum of<\/p>\n
