Justice K.P.BALACHANDRAN\n\n Dated :28\/05\/2007\n\n O R D E R\n                   J.B.KOSHY &amp; K.P.BALACHANDRAN, JJ.\n\n                 -------------------------------------\n\n                         M.F.A.No.395 OF 2002\n\n                 -------------------------------------\n\n                          Dated 28th May, 2007\n\n\n\n                                 JUDGMENT\n<\/pre>\n<p>Koshy,J<br \/>\n        .\n<\/p>\n<p>              A   registered   headload   worker   working   in   the<\/p>\n<p>establishment of the sixth respondent (first respondent in the<\/p>\n<p>claim   petition)   sustained   fatal   injuries   during  the   course   of<\/p>\n<p>employment.        He   died   leaving   his   young   wife,   two   minor<\/p>\n<p>children and aged parents.  AW1, wife of the deceased, deposed<\/p>\n<p>before   the   Commissioner   that   monthly   income   of   the   deceased<\/p>\n<p>was more than Rs.4,000\/=.  In the claim application also it is<\/p>\n<p>stated that the monthly income was Rs.4,000\/=.   Ext.A7 is the<\/p>\n<p>identity   card   to   show   that   he   was   a   headload   worker<\/p>\n<p>permanently   employed   in   the   sixth   respondent&#8217;s   establishment.\n<\/p>\n<p>The   Commissioner   assessed   income   at   Rs.4,000\/=.     Taking   the<\/p>\n<p>undisputed age   of the deceased, the correct factor was taken<\/p>\n<p>and   calculated   compensation.     The   only   ground   taken   by   the<\/p>\n<p>insurance   company   in   this   appeal   is   that   the   Commissioner<\/p>\n<p>should not have taken Rs.4,000\/= as the monthly wages.   Since<\/p>\n<p>the deceased was a regular worker and even if Rs.150\/= per day<\/p>\n<p>was taken as the income, the monthly income will be more than<\/p>\n<p>Rs.4,000\/=.   The accident  occurred in  2001.   Even considering<\/p>\n<p>the   minimum   wages   for   a   manual   worker   in   Kerala,   Rs.4,000\/-\n<\/p>\n<p>assessed   by   the   Commissioner   as   monthly   income   is   not   high.\n<\/p>\n<p><span class=\"hidden_text\">MFA.395\/2002                        2<\/span><\/p>\n<p>In   any   event,   the   assessment   of   monthly   income   by   the<\/p>\n<p>Commissioner as Rs.4,000\/= cannot be taken as a substantial<\/p>\n<p>question   of   law.        Under   Section   30   of   the   Workmens&#8217;<\/p>\n<p>Compensation   Act,   an   appeal   will   not   lie   if   there   is   no<\/p>\n<p>substantial   question   of   law.
