\nJudge and MACT, Chikmagalur. lpartly-allowing the icilpaijm “petition for ‘<\/p>\n
compensation and seeking enhancement _of cornplensation with
\ninterest at 9% Der annum. ‘     <\/p>\n

The apple-llailt,  in MV C No.253\/ 1995 on the
\nfile of Addl. I)listr_ict_  Accident Claims Tribunal at
\n this  Court, praying for enhancement of
\n  A. l<\/p>\n
 for the appellant submits that on<\/p>\n
vl7l__2.4;Vl995 l.lthe””lappella11t\/ claimant was travelling as a passenger in<\/p>\n
bearing registration No.KA~l6–5859 and the bus capsized<\/p>\n
 l”1=ash”Aland negligent driving of the driver of the bus and the<\/p>\n
L’<\/p>\n
claimant sustained injuries. He further submits that the Tribunal has
\nawarded a meagre conipensation of Rs.20,000\/– and he ,pra}l?s_V_l’or<\/p>\n
enhancement of con’1pensat.ion.\n<\/p>\n
3. Learned Counsel for respondent Ins’Ltrane_e,Conipany’ <\/p>\n
submits that the Tribunal has awarded adequate :1;_’<\/p>\n
4. The claimant has got hin’1self_:e2:an’1ined. and got’<\/p>\n
marked EXs.P 7 to P 29. is  is in the
\nevidence of the claimant that    forearm. left
\nhand, chest and left Collar  in M G Hospital.
\nChikmagalur, as   \u00a7{_=~ra\\,vrureport reveals that he<\/p>\n
has sustained:V:lfracttir’e’of ar\u00e9fn..l_above the elbow joint and steel rod
\nwas inserted. hit is ‘”th’e claimant that he was getting<\/p>\n
income of Rs..30,00’O”,’– per..n1ontl%’f..fi’on’1 agriculture, but on account of<\/p>\n
the.linji.i:ry”s.iist?ai.ne’d. by  is not able to do the work. which he<\/p>\n
was d’oi1’i\u00a75; earlier; >1  .\n<\/p>\n
5.”K\u20ac:eping friew that the claimant sustained fracture of<\/p>\n
v’3’\u20ac.l_bo\\\\rV joint  ilnderwent surgery and rods were implanted and<\/p>\n
subsevqluently. the Tribunal C aV\u20ac awarded reasonable<\/p>\n
compensation. Taking into consideration that the accident occurred
\nin the year 1995 and the claimant was a.n agriculturist by
\nprofession. the Tribunal could have awarded global compensation of
\nRs.5U.000\/\u00bb~. Thus. the Claimant is entitled <\/p>\n
Compensation of Rs.30,000\/ –.\n<\/p>\n
6. In the result, the Appeal is partly al.lotgv:ed;eapho.ld’inglth_atA;1t_i’ie<\/p>\n
