\tThe
\npresent application has been filed by the applicant original accused
\nfor suspension of sentence under sec. 389 of Cr.P.C. and for grant of
\nbail on the grounds set out in the application.\n<\/p>\n
2.\tThe
\napplicant original accused has been convicted in Special Case (GEB)
\nNo. 37\/2008 by the learned Special  Judge (GEB), Bhuj, vide judgment
\nand order dated  19.7.2010 recording conviction of the accused for
\nthe offence under sec. 135(1)(A) of the Electricity Act, 2003
\nimposing sentence of R.I. for 1 year & 6 months and fine of Rs.
\n1,52,652\/-, i\/d R.I for 6 months.\n<\/p>\n
3.\tLearned
\nadvocate Mr. Satta referred to the judgment and submitted that as per
\nthe findings given, the basic amount is Rs. 50,884.13  which is
\nassessed for the theft of energy and still the fine imposed is three
\ntimes higher and further it is also recorded that it is the first
\noffence.  He therefore submitted that considering the provisions of
\nsec. 389 of Cr.P.C., when he has deposited the basic amount, the
\npresent application may be allowed.\n<\/p>\n
4.\tLearned
\nAPP Mr. Poojari resisted the application.\n<\/p>\n
5.\tIn
\nview of rival submissions, it is required to be considered whether
\nthe present application can be entertained or not.\n<\/p>\n
6.\tAt
\nthe outset, it is required to be mentioned that the theft of energy
\nis considered as Rs. 50,884.13 and though it is also stated to be the
\nfirst offence, fine is imposed three times the amount which is a
\nmatter requiring consideration.  The submission made by the learned
\nadvocate that he has a good chance of succeeding in the appeal and it
\ncannot be this amount of fine for which he may have to remain in jail
\nrequires to be considered.\n<\/p>\n
Sec.\n<\/p>\n
\t135(1)  provides as under:\n<\/p>\n
“xxx\t\t\txxx\t\t\txxx<\/p>\n
\tProvided
\nthat in a case where the load abstracted, consumed, or used or
\nattempted abstraction or attempted consumption or attempted use –\n<\/p>\n
(i)\txxx\t\t\txxx\t\t\txxx<\/p>\n
(ii)\texceeds
\n\t10 Kilowatt, the fine imposed on first conviction shall not be less
\n\tthan three times the financial gain on account of such theft of
\n\telectricity ……”\n<\/p>\n
8.\tTherefore,
\nhaving regard to this provision what has been provided for is the
\npayment of fine. It is true that normally while passing an order of
\nsuspension of sentence, the fine is required to be paid. However,
\nthis is a case where, on the one hand, there is a legislative
\nprovision providing for imposition of fine, but, at the same time, it
\nresults in deprivation of life and liberty as provided under Art. 21
\nof the Constitution of India, because a person like the accused may
\nnot have the resources to deposit such huge amount of fine.\n<\/p>\n
9.\tThe
\npenology has two-fold object, (1) punishing the criminal for his
\ndeterrence, and (2) reformation.  This has a reference to the aspect
\nof sentence depending upon the nature of offence.  The present
\noffence though is theft of energy is more emphasising on the aspect
\nof economic offence for which the legislature has provided a higher
\nfine, but it will have to be considered in light of the criminal
\njurisprudence and penology with reference to the basic concept of
\nbail and Art. 21 of the Constitution of India.\n<\/p>\n
10.\tIt
\nis well accepted by catena of judicial pronouncements expressing the
\nunderlying principles laying down guidelines for grant of bail and
\nwhat are the relevant factors which are required to be considered.
\nIn the same way, sec. 389 of Cr.P.C. which provides for suspension of
\nsentence and releasing the accused on bail has to be considered in
\nlight of the guidelines with regard to the exercise of discretion
\nunder sec. 389.\n<\/p>\n
11.\tIt
\nis well accepted that the aspect of sentence and the fine is one
\nthing and the suspension of sentence under sec. 389 of Cr.P.C and
\nreleasing the accused on bail are different aspects.  The Hon’ble
\nApex Court in catena of judicial pronouncements has observed that
\nwhen there is a fixed term sentence, normally, the discretion has to
\nbe exercised referring to the scheme of sec. 389. The provisions of
\nsec. 389 and in particular sub-sec. (3), require recording of special
\nreasons for not suspending the sentence.\n<\/p>\n
12.\tThe
\nHon’ble Apex Court in a judgment in the case of Suresh
\nKumar & ors. v. State (NCT of Delhi) reported in
\n(2001) 10 SCC 338 has observed and quoted referring to the earlier
\njudgment in (1999) 4 SCC 421 :\n<\/p>\n
“When
\na convicted person is sentenced to a fixed period of sentence and
\nwhen he files an appeal under any statutory right, suspension of
\nsentence can be considered by the appellate court liberally unless
\nthere are exceptional circumstances.”\n<\/p>\n
13.\tCatena
\nof judicial pronouncements have emphasised on this aspect depending
\nupon the nature of offence and the sentence that in case of short
\nsentence or sentence for a lesser period, an application for
\nsuspension of sentence should be considered liberally.\n<\/p>\n
14.\tIt
\nis required to be mentioned that the word “sentence”
\nwould include the fine imposed inasmuch as the word “sentence”
\nneeds to be interpreted broadly to include both the sentence for
\nimprisonment as well as the fine.\n<\/p>\n
15.\tTherefore,
\nin the facts and circumstances, while maintaining the balance between
\nthe right of the accused and the prosecution, the present application
\ndeserves to be allowed.\n<\/p>\n
16.\tAccordingly,
\nthe present application stands allowed. The substantive sentence
\nimposed by the learned  Special  Judge (GEB), Bhuj vide judgment and
\norder dated  19.7.2010  shall remain under suspension till final
\nhearing and disposal of the appeal.\n<\/p>\n
17.\tThe
\napplicant is ordered to be released on bail on his furnishing a bond
\nof Rs. 10,000\/- (Rupees Ten thousand only) with one surety of the
\nlike amount to the satisfaction of the trial court and subject to the
\nconditions that the applicant shall:\n<\/p>\n
(a)\tnot
\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n
(b)\tnot
\nto try to tamper with the evidence or pressurize the prosecution
\nwitnesses or complainant in any manner.\n<\/p>\n
(c)\tmaintain
\nlaw and order.\n<\/p>\n
(d)\tsurrender
\nhis passport, if any, to the lower court, within a week.\n<\/p>\n
\tRule
\nis made absolute. D.S. permitted.\n<\/p>\n
