Sethi.\n\n\n\n\nJUDGMENT:\n<\/pre>\n<p>L&#8230;I&#8230;T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T..J<\/p>\n<p>SETHI,J.\n<\/p>\n<p>    Delay condoned.\n<\/p>\n<p>    Leave granted.\n<\/p>\n<p>    The\t appellant  filed  a suit  against  the\t respondents<br \/>\npraying\t for  a decree of permanent  injunction\t restraining@@<br \/>\n\t\tJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJ<br \/>\nthem,  their  agents and subordinates from  demolishing\t the@@<br \/>\nJJJJJJJJJJJJJJJJJJJJJJJJ<br \/>\ncompound  wall\tin the suit scheduled property.\t During\t the<br \/>\npendency  of  the  suit,   the\trespondents-defendants\twere<br \/>\nalleged to have entered the appellant&#8217;s house unauthorisedly<br \/>\nand  demolished the compound wall on north, east and western<br \/>\nside.\tThey  were also alleged to have damaged the gate  in<br \/>\nthe entrance.\n<\/p>\n<p>    In\tview  of the subsequent developments, the  appellant<br \/>\nfiled an application under Order 6 Rule 17 for the amendment<br \/>\nof  the plaint for adding paras 8(a) to 8(f) in his  plaint.<br \/>\nThe  trial  court  rejected  his  prayer  and  the  revision<br \/>\npetition  filed against that order was dismissed by the High<br \/>\nCourt  vide  order  impugned in this appeal, mainly  on\t the<br \/>\nground\tthat  the  amendment, if allowed,  would  result  in<br \/>\nintroducing  a new case and cause of action.  It was further<br \/>\nheld  that as the appellant was seeking recovery of damages,<br \/>\nthe  amendment\tcould not be allowed as it  would  allegedly<br \/>\nchange\tthe  nature of the suit.  It was also observed\tthat<br \/>\nthe amendment sought was barred by limitation.\n<\/p>\n<p>    After  referring to the judgments in Charan Das v.\tAmir<br \/>\nKhan  [AIR 1921 PC 50], <a href=\"\/doc\/908527\/\">L.J.  Leach &amp; Co.  Ltd.\t &amp; Anr.\t  v.<br \/>\nJardine\t Skinner &amp; Company<\/a> [1957 SCR 438], <a href=\"\/doc\/1350326\/\">Smt.Ganga Bai  v.<br \/>\nVijay  Kumar &amp; Ors.<\/a>  [1974 (2) SCC 393], <a href=\"\/doc\/306590\/\">M\/s.Ganesh  Trading<br \/>\nCo.   v.   Moji\t Ram<\/a>  [1978 (2) SCC 91]\t and  various  other<br \/>\nauthorities,  this  Court in <a href=\"\/doc\/191240985\/\">B.K.N.  Pillai v.\t P.Pillai  &amp;<br \/>\nAnr.<\/a>  [JT 1999 (10) SC 61] held:  &#8220;The purpose and object of<br \/>\nOrder  6  Rule 17 CPC is to allow either party to  alter  or<br \/>\namend  his pleadings in such manner and on such terms as may<br \/>\nbe  just.  The power to allow the amendment is wide and\t can<br \/>\nbe  exercised  at  any\tstage  of  the\tproceedings  in\t the<br \/>\ninterests of justice on the basis of guidelines laid down by<br \/>\nvarious\t High  Courts and this Court.  It is true  that\t the<br \/>\namendment  cannot be claimed as a matter of right and  under<br \/>\nall  circumstances.  But it is equally true that the  courts<br \/>\nwhile  deciding such prayers should not adopt hypertechnical<br \/>\napproach.   Liberal  approach  should be  the  general\trule<br \/>\nparticularly   in  cases  where\t the   other  side  can\t  be<br \/>\ncompensated  with  the costs.  Technicalities of law  should<br \/>\nnot  be permitted to hamper the courts in the administration<br \/>\nof  justice between the parties.  Amendments are allowed  in<br \/>\nthe   pleadings\t to  avoid   uncalled  for  multiplicity  of<br \/>\nlitigation.\n<\/p>\n<p>    If\tthe  aforesaid test is applied in the instant  case,<br \/>\nthe  amendment\tsought could not be declined.  The  dominant<br \/>\npurpose\t of  allowing  the  amendment  is  to  minimise\t the<br \/>\nlitigation.   The  plea\t that the relief sought\t by  way  of<br \/>\namendment   was\t  barred  by  time   is\t arguable   in\t the<br \/>\ncircumstances of the case, as is evident from the perusal of<br \/>\naverments made in paras 8(a) to 8(f) of the plant which were<br \/>\nsought to be incorporated by way of amendment.\tWe feel that<br \/>\nin  the\t circumstances\tof the case the plea  of  limitation<br \/>\nbeing  disputed could be made a subject matter of the  issue<br \/>\nafter allowing the amendment prayed for.\n<\/p>\n<p>    In view of the legal position, as noted hereinabove, the<br \/>\nimpugned  order is not sustainable.  Accordingly, the appeal<br \/>\nis  allowed  by\t setting  aside\t  the  impugned\t order\t and<br \/>\npermitting  the\t appellant-plaintiff  to  amend\t the  plaint<br \/>\nsubject to payment of costs of Rs.500\/-.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Ragu Thilak D.
