Learned<br \/>\n\tAPP Mr. A.J.Desai waives service of notice of rule on behalf of the<br \/>\n\tRespondent State.\n<\/p>\n<p>\tThe present<br \/>\n\tapplication has been filed by the Applicant accused under Section<br \/>\n\t439 of Criminal Procedure Code for grant of regular bail.\n<\/p>\n<p>\tThe Applicant<br \/>\n\taccused is charged with having committed offence under Sections 395,<br \/>\n\t397, 412, 414 and 120B of the Indian Penal Code, for which complaint<br \/>\n\thas been lodged being I-CR No. 148 of 2004 with Anand Town Police<br \/>\n\tStation.\n<\/p>\n<p>\tLearned advocate Mr.<br \/>\n\tJ.V.Japee for the Applicant accused has submitted that though the<br \/>\n\tpresent application is a successive bail application, as, earlier<br \/>\n\tthe bail application after the charge sheet was preferred by the<br \/>\n\tpresent Applicant accused, which was withdrawn.  He further<br \/>\n\tsubmitted that the Applicant is in jail for about 1 \u00bd year<br \/>\n\tand the other co-accused have been released, for which he referred<br \/>\n\tto the order.  He submitted that one Kantibhai Macwana, who was also<br \/>\n\tsimilarly situated like the present Applicant accused and who was<br \/>\n\talleged to have been absconding for four years, has been released on<br \/>\n\tbail, and therefore, on the ground of parity, the present Applicant<br \/>\n\taccused may also be released on bail.\n<\/p>\n<p>\tLearned advocate Mr.<br \/>\n\tJapee has also submitted that out of three cases, the Applicant<br \/>\n\taccused was in jail for some time and in two cases he has been<br \/>\n\tacquitted also.  Learned advocate Mr. Japee  therefore submitted<br \/>\n\tthat even if the trial is likely to commence, it will take some<br \/>\n\ttime, and therefore, as the Applicant accused is in jail for more<br \/>\n\tthan 1 \u00bd year, he may be released.\n<\/p>\n<p>\tLearned APP Mr.<br \/>\n\tA.J.Desai, on instructions, submitted that the trial is commend and<br \/>\n\tthe next date is 2nd July 2009, i.e. tomorrow.  Learned<br \/>\n\tAPP has also submitted that the present application cannot be<br \/>\n\tentertained in view of the fact that the Applicant accused was<br \/>\n\tabsconding for more than four years.  Learned APP further submitted<br \/>\n\tthat the Applicant accused, if is released, then his presence may<br \/>\n\tnot be secured and it would ultimately affect the trial itself,<br \/>\n\twhich is going on. Learned APP also submitted that admittedly he is<br \/>\n\tindulged in other offences also, and therefore, looking to his<br \/>\n\tconduct, the present application may not be allowed.\n<\/p>\n<p>\tIn view of the rival<br \/>\n\tsubmissions, it is required to be considered whether the present<br \/>\n\tapplication for bail can be entertained or not.\n<\/p>\n<p>\tIt is not in dispute<br \/>\n\tthat the Applicant accused is involved in the past in three<br \/>\n\toffences.  Though, it may not be the only circumstance, the fact<br \/>\n\tremains that he was absconding for about four years coupled with the<br \/>\n\tfact that the trial has now commenced and the next date is scheduled<br \/>\n\ton 2.7.2009.  It is in these circumstances, considering his conduct,<br \/>\n\tthe apprehension voiced by the leaned APP was justified that, if he<br \/>\n\tis released, he may jump the bail and it may affect the trial itself<br \/>\n\tand he may influence the witnesses also.\n<\/p>\n<p>\tAnother facet of the<br \/>\n\targument made by learned advocate Mr. Japee on the ground of parity<br \/>\n\tis misconceived inasmuch as it is well accepted that the parity<br \/>\n\twould not be claimed as of right and it is required to be granted<br \/>\n\treferring to various circumstances particularly in the present case<br \/>\n\tthe conduct of the present Applicant accused.  The submission that<br \/>\n\tthe Applicant accused is in jail for 1 \u00bd year and the trial<br \/>\n\tmay take some time and therefore the Applicant accused may be<br \/>\n\treleased on bail pending the trial, also cannot be accepted in light<br \/>\n\tof settled position of law as observed by the Hon&#8217;ble Apex Court in<br \/>\n\tcase of Kalyan Chandra Sarkar etc. v. Rajesh Ranjan alias Pappu<br \/>\n\tYadav and another reported in AIR 2005 SC 921.  The<br \/>\n\tHon&#8217;ble Apex Court, referring to to the similar submissions of the<br \/>\n\tright of the accused under Article 21 and the delay in trial and<br \/>\n\tdetention of the accused pending trial, has observed:\n<\/p>\n<p>\t 18.\tIt is trite<br \/>\n\tlaw that personal liberty cannot be taken away except in accordance<br \/>\n\twith the procedure established by law. Personal liberty is a<br \/>\n\tconstitutional guarantee. However, Article 21 which guarantees the<br \/>\n\tabove right also contemplates deprivation of personal liberty by<br \/>\n\tprocedure established by law. Under the criminal laws of this<br \/>\n\tcountry, a person accused of offences which are non bailable is<br \/>\n\tliable to be detained in custody during the pendency of trial unless<br \/>\n\the is enlarged on bail in accordance with law. Such detention cannot<br \/>\n\tbe questioned as being violative of Article 21 since the same is<br \/>\n\tauthorised by law. But even persons accused of non bailable offences<br \/>\n\tare entitled for bail if the Court concerned comes to the conclusion<br \/>\n\tthat the prosecution has failed to establish a prima facie case<br \/>\n\tagainst him and\/or if the Court is satisfied for reasons to be<br \/>\n\trecorded that in spite of the existence of prima facie case there is<br \/>\n\ta need to release such persons on bail where fact situations require<br \/>\n\tit to do so. In that process a person whose application for<br \/>\n\tenlargement on bail is once rejected is not precluded from filing a<br \/>\n\tsubsequent application for grant of bail if there is a change in the<br \/>\n\tfact situation. In such cases if the circumstances then prevailing<br \/>\n\trequires that such persons to be released on bail, in spite of his<br \/>\n\tearlier applications being rejected, the Courts can do so.\n<\/p>\n<p>\t19.\tThe<br \/>\n\tprinciples of res judicata and such analogous principles although<br \/>\n\tare not applicable in a criminal proceeding, still the Courts are<br \/>\n\tbound by the doctrine of judicial discipline having regard to the<br \/>\n\thierarchical system prevailing in our country. The findings of a<br \/>\n\thigher Court or a co-ordinate Bench must receive serious<br \/>\n\tconsideration at the hands of the Court entertaining a bail<br \/>\n\tapplication at a later stage when the same had been rejected<br \/>\n\tearlier. In such an event, the Courts must give due weight to the<br \/>\n\tgrounds which weighed with the former or higher Court in rejecting<br \/>\n\tthe bail application. Ordinarily, the issues which had been<br \/>\n\tcanvassed earlier would not be permitted to be reagitated on the<br \/>\n\tsame grounds, as the same would lead to a speculation and<br \/>\n\tuncertainty in the administration of justice and may lead to forum<br \/>\n\thunting.\n<\/p>\n<p>\tIn light of the<br \/>\n\taforesaid observations, such a contention is misconceived, as the<br \/>\n\tHon&#8217;ble Apex Court has clearly observed that the liberty of an<br \/>\n\tindividual is cherished, but it is subject to reasonable restriction<br \/>\n\tunder the criminal law justice system of the Country.  Further,<br \/>\n\tadmittedly, the Applicant accused had preferred Criminal Misc.<br \/>\n\tapplication No. 6069 of 2008 before this Court which was withdrawn<br \/>\n\tvide order dated 12.5.2008, and therefore, as the present<br \/>\n\tapplication is a successive bail application and there are no change<br \/>\n\tin the circumstances, it would not be justified to entertain the<br \/>\n\tpresent application in light of the observations made by the Hon&#8217;ble<br \/>\n\tApex Court as above.\n<\/p>\n<p>\tLearned advocate Mr.<br \/>\n\tJapee, after arguing at length has requested for withdrawal of the<br \/>\n\tapplication. Therefore, the permission has not been granted, and<br \/>\n\taccordingly, the present application stands rejected.  Rule<br \/>\n\tdischarged.\n<\/p>\n<p>(Rajesh H.
