Hence,<br \/>\n\tpresent appeal challenging the judgment and award to the extent of<br \/>\n\tnot allowing the claim of the appellants in toto.\n<\/p>\n<p>Mr.Hiren<br \/>\n\tModi, learned advocate for the appellants, has submitted that the<br \/>\n\tTribunal erred in considering the income of the deceased as<br \/>\n\tRs.1500\/- instead of Rs.3000\/- per month; that the Tribunal ought<br \/>\n\tnot to have applied the ratio of notional income; that the Tribunal<br \/>\n\thas erred in not appreciating the fact that the deceased was working<br \/>\n\tin L&amp;T Company; that the Tribunal ought to have considered the<br \/>\n\tprospective income of the deceased as Rs.4500\/- instead of Rs.3000\/-<br \/>\n\tand even the multiplier of 15 ought to have been applied in the<br \/>\n\tpresent case. In view above submissions, it is prayed that the<br \/>\n\tappeal may be allowed.\n<\/p>\n<p>Having<br \/>\n\tconsidered the contentions raised by the learned counsel for the<br \/>\n\tappellants, averments made in the appeal and the documentary<br \/>\n\tevidence produced on record, it transpires that the Tribunal after<br \/>\n\ttaking into consideration all the relevant documents and evidence on<br \/>\n\trecord has partly allowed the petition filed by the appellants. It<br \/>\n\tis required to be noted that though the deceased was working a<br \/>\n\tPublic Limited Company, no documentary evidence is produced by the<br \/>\n\tappellants on record to show the same. Hence, the Tribunal has<br \/>\n\trightly considered the notional income of the deceased as<br \/>\n\tRs.15,000\/- per annum. Further, it is required to be noted that even<br \/>\n\tthe Tribunal has not deducted 1\/3rd expenses from the<br \/>\n\tannual income. Thus, it transpires that the prospective income is<br \/>\n\tincluded in the said amount. The Tribunal has awarded the said<br \/>\n\tamount after taking into consideration the evidence produced on<br \/>\n\trecord by the appellants.\n<\/p>\n<p>4.1\tSo<br \/>\nfar as the contention of the appellants as to applicability of<br \/>\nmultiplier is concerned, it is required to be noted that in the<br \/>\nPostmortem Note itself it is mentioned that the deceased was aged 45<br \/>\nyears. Further, no documentary evidence is produced by the appellants<br \/>\nas to the age of the deceased. Thus, the Tribunal has applied the<br \/>\nmultiplier of 13 looking to the fact that the deceased would have<br \/>\nworked for further 13 years in the said company.\n<\/p>\n<p>\tIn<br \/>\n\tview of aforesaid, I am of the opinion that the view taken by the<br \/>\n\tTribunal is just and proper. The Tribunal has assigned cogent and<br \/>\n\tconvincing reasons for arriving at the conclusion. Over and above<br \/>\n\tthe reasons assigned hereinabove, I adopt the reasons assigned by<br \/>\n\tthe Tribunal and do not find any illegality much less any perversity<br \/>\n\tin the findings recorded. I am in complete agreement with the<br \/>\n\tfindings recorded by the Tribunal. No case is made out to interfere<br \/>\n\twith the findings recorded by the Tribunal.
