\n\t\t Rule. Learned APP, Mr.J.K.Shah, waives service
\nof notice of Rule on behalf of the State.\n<\/p>\n

\n\t\tThe accused-applicant pray for anticipatory bail in connection with
\noffences registered with Modasa Police Station, District
\nSabarkantha vide C.R.No.I- 22 of 2011 for offences punishable under
\nSections 292, 294, 328, 384, 354, 506(2) and 114 of the IPC and
\nsection 67 of the IT Act, 2000.\n<\/p>\n
3.\t\tOn
\n08.06.2011, the matter was adjourned for today, to enable learned APP
\nMr.Shah to seek necessary instructions as regards stage of
\ninvestigation and whether custodial interrogation of the present
\napplicant – accused is necessary or not. In response to this, Deputy
\nPolice Superintendent, Modasa Division, Modasa personally remained
\npresent today and informed that custodial interrogation of the
\naccused applicant is not required.\n<\/p>\n

\n\tHeard learned Senior Counsel Mr Nanavati for the accused-applicant
\nand Mr Shah, learned APP for the State. Perused the FIR. The parties
\ndo not press for a reasoned order.\n<\/p>\n

\n\t\tConsidering the role ascribed to the accused applicant and the
\nnature of allegations levelled against the accused-applicant in the
\nFIR, I am persuaded to exercise my discretion in favour of the
\naccused-applicant taking into consideration the following aspects :-\n<\/p>\n
(1)<\/span><\/p>\n
The offences are magistrate triable offences except Section 328,
\nwhich I am informed that I.O. had filed a report before the learned
\nMagistrate for deletion of the same due to deficient and complete
\nlack of evidence but the report has not been accepted by the learned
\nMagistrate for the present.\n<\/p>\n
(2)<\/span><\/p>\n
Investigation is practically over;\n<\/p>\n
(3)<\/span><\/p>\n
No past antecedents and no criminal history;\n<\/p>\n
(4)<\/span><\/p>\n
Accused is a boy aged about 22 years.\n<\/p>\n
(5)<\/span><\/p>\n
Prima facie it appears from the applications Exh.4 and 8 annexed with
\nthe paper book at pages 31 to 34, preferred by the Deputy
\nSuperintendent of Police, Modasa Division, Modasa before the JMFC,
\nModasa that investigating agency itself is in doubt as regards
\ngenuineness of the entire case of the prosecution more particularly
\nallegations which have been levelled by the first informant.\n<\/p>\n

\n\t\tI am of the view that the interest of the prosecution can be
\nsecured by imposing some stringent conditions.\n<\/p>\n

\n\t\tIn this view of the matter, accused-applicant  is ordered to be
\nreleased on anticipatory bail in the event of his arrest in
\nconnection with offences registered with Modasa Police Station,
\nDistrict- Sabarkantha vide C.R.No.I-22 of 2011 on his furnishing a
\nbond of Rs.10,000\/- (Rupees Ten Thousand Only) with solvent surety of
\nlike amount on following conditions that he:\n<\/p>\n
[A]
\nshall cooperate with the investigation and make himself available for
\ninterrogation whenever required.\n<\/p>\n
[B]
\nshall remain present at the concerned Police Station on
\n13th June, 2011 between 9 a.m. to 2 p.m ;\n<\/p>\n
[C]
\nshall not hamper the investigation in any manner nor shall directly
\nor indirectly make any inducement, threat or promise to any witness
\nso as to dissuade them from disclosing such facts to the Court or to
\nany Police Officer;\n<\/p>\n
[D]
\nshall at the time of execution of bond, furnish the address to the
\nInvestigating Officer and the Court concerned and shall not change
\nthe residence till the final disposal of the case or till further
\norders;\n<\/p>\n
[E]
\nwill not leave India without the permission of the Court and, if is
\nholding a Passport, shall surrender the same before the trial Court
\nwithin a week;\n<\/p>\n
[F]
\nIt would be open to the Investigating Officer to file an application
\nfor remand, if he considers it just and proper and the concerned
\nMagistrate would decide it on merits.\n<\/p>\n
[G)
\nshall not enter the revenue limits of Modasa town till the trial
\ncommences except for the purpose of marking presence at the Modasa
\nPolice Station.  However, it is clarified that applicant is student
\nstudying in M.Pharm (Quality Assurance) Sem- II.  He shall entire
\ntown of Modasa only for the purpose of appearing in the internal
\nexaminations which will be conducted by the College including theory
\nand practical examinations.\n<\/p>\n
(H)
\n It is assured by Mr.Nanavati, learned Senior Advocate appearing for
\nthe applicant accused that on the date when accused applicant shall
\nappear before the Investigating Officer for the purpose of
\ninterrogation, he shall hand over mobile which was alleged to have
\nbeen used  in commission of offence.\n<\/p>\n

\n\t\tIt would be open for the Investigating Agency to apply to the
\ncompetent Magistrate, for police remand of the applicant. The
\napplicant shall remain present before the learned Magistrate on the
\nfirst date of hearing of such application and on all subsequent
\noccasions, as may be directed by the learned Magistrate. This would
\nbe sufficient to treat the accused in the judicial custody for the
\npurpose of entertaining application of the prosecution for police
\nremand. This is, however, without prejudice to the right of the
\naccused to seek stay against an order of remand, if ultimately
\ngranted, and the power of the learned Magistrate to consider such a
\nrequest in accordance with law. It is clarified that the applicant,
\neven if remanded to the police custody upon completion of such period
\nof police remand, shall be set free immediately, subject to other
\nconditions of this anticipatory bail order.\n<\/p>\n
9.\t\tIt
\ngoes without saying that any observations touching the merits of the
\ncase are purely for the purpose of deciding
\n the question of grant of bail and shall not be construed as
\nan expression of the final opinion in the main matter.\n<\/p>\n

\n\t\tWith these directions, application is allowed. Rule is made
\nabsolute. Direct Service is permitted.\n<\/p>\n
