NO. 1530 OF 2010\n            = = = = = = = = = = = = = = =\n       Dated this the 22nd day of October, 2010.\n\n                     J U D G M E N T\n<\/pre>\n<p>     This appeal is preferred against the award of the<\/p>\n<p>Motor Accidents Claims Tribunal, Muvattupuzha in O.P.<\/p>\n<p>(MV)1189\/04. The claimant, a pillion rider, sustained<\/p>\n<p>injuries in a road accident and the Tribunal awarded him<\/p>\n<p>a compensation of Rs.43,300\/- and the insurance<\/p>\n<p>company has been exonerated from the liability.       It is<\/p>\n<p>against that decision challenging the quantum and<\/p>\n<p>exoneration of the liability the claimant has come up in<\/p>\n<p>appeal.\n<\/p>\n<p>     2.    Heard.    A perusal would reveal that the<\/p>\n<p>contention of the appellant is that the vehicle is covered<\/p>\n<p>by a comprehensive or package policy. The nature of<\/p>\n<p>the policy is not seen stated clearly in the written<\/p>\n<p>M.A.C.A. 1530 OF 2010<br \/>\n<span class=\"hidden_text\">                              -:2:-<\/span><\/p>\n<p>statement nor in the award.       What is stated is that no<\/p>\n<p>additional premium is collected and therefore the<\/p>\n<p>insurance company is not liable.        By virtue of the<\/p>\n<p>clarificatory circular issued by the Insurance Regulatory<\/p>\n<p>and Development Authority dated 16.11.2009 coupled<\/p>\n<p>with the two Division Bench decisions of this Court<\/p>\n<p>reported in <a href=\"\/doc\/135962\/\">New India Assurance Co. Ltd. v.<\/p>\n<p>Hydrose<\/a> (2008 (3) KLT 778) and <a href=\"\/doc\/1457758\/\">Mathew v. Shaji<\/p>\n<p>Mathew<\/a> (2009 (3) KLT 813) if it is a comprehensive<\/p>\n<p>or a package policy a pillion rider will be covered. So I<\/p>\n<p>think the matter requires reconsideration.      Since the<\/p>\n<p>matter requires reconsideration I direct the Tribunal to<\/p>\n<p>reconsider the quantum awarded and for this purpose<\/p>\n<p>both the sides are permitted to adduce evidence both<\/p>\n<p>documentary as well as oral, to substantiate their<\/p>\n<p>contentions. Irrespective of the finding I make it clear<\/p>\n<p>M.A.C.A. 1530 OF 2010<br \/>\n<span class=\"hidden_text\">                             -:3:-<\/span><\/p>\n<p>that the claimant will not be entitled to get any interest<\/p>\n<p>for the period from 14.3.08 till 6.8.10 because of the<\/p>\n<p>delay he has caused in filing the appeal.
