J.\n<\/p>\n<p>     Leave granted. Heard Counsel on both sides. This appeal<br \/>\nis preferred  against the  judgment and order dated 3.9.1993<br \/>\npassed in F.M.A.T. No. 1182 on the file of the High Court of<br \/>\nCalcutta.\n<\/p>\n<p>     The  first\t  respondent  was  in  the  service  of\t the<br \/>\nappellant Bank.\t A  charge-sheet  was  issued  on  11.5.1981<br \/>\nagainst him  calling upon the first respondent to show cause<br \/>\nagainst the charges brought against him. On receipt of reply<br \/>\nto the\tshow cause notice a regular departmental enquiry was<br \/>\nheld and  the Enquiry officer submitted a report. Thereafter<br \/>\nthe disciplinary  authority  accepting\tthe  enguiry  report<br \/>\nissued a  further show\tcause notice dated 13.8.1981 why the<br \/>\npunishment of  dismissal should\t bot be\t imposed upon him in<br \/>\nthe light  of the  enquiry report and findings thereon which<br \/>\nwere accepted  by him.\tIt must be noted that alongwith this<br \/>\nnotice, the copy of the enquiry report was also enclosed.\n<\/p>\n<p>     The first\trespondent challenged the issuance of second<br \/>\nshow  cause  notice  itself  by\t filling  a  writ  petition.<br \/>\nHowever, He  withdrew the  same as  before the writ petition<br \/>\ncould be  taken up  for hearing,  the final order dismissing<br \/>\nthe first respondent was passed by the Management.\n<\/p>\n<p>     The first\trespondent  then  challenged  the  order  of<br \/>\ndismissal by  moving the High Court under Article 226 of the<br \/>\nConstitution of\t India. A  learned Single  Judge of the High<br \/>\nCourt  by  order  dated\t 12.6.1986  set\t aside\tthe  enquiry<br \/>\nproceedings and\t consequently allowed the writ petition with<br \/>\nliberty to  proceed  against  the  first  respondent  afresh<br \/>\naccording to law.\n<\/p>\n<p>     The appellants  not satisfied  with the  crder  of\t the<br \/>\nlearned Single\tJudge preferred\t an appeal  to the  Division<br \/>\nBench in  F.M.A.T. No.\t1834\/1986.  The\t Division  Bench  by<br \/>\njudgment and order dated 29.1.1987 modified the order of the<br \/>\nlearned\t Single\t  Judge\t by   upholding\t  the\tdisciplinary<br \/>\nproceedings putto the state of issuance of second show cause<br \/>\nnotice. The learned Judges observed as follows :-\n<\/p>\n<blockquote><p>     &#8220;It would be open to the disciplinary<br \/>\n     authorities to proceed afresh and to<br \/>\n     decide whether a second show cause<br \/>\n     notice should be issued upon the writ<br \/>\n     petitioner against the penalty which may<br \/>\n     be proposed  to be imposed. In case such<br \/>\n     show cause notice is issued, the writ<br \/>\n     petitioner would be at liberty to submit<br \/>\n     his explanation. Upon consideration of<br \/>\n     the relevant matters, the disciplinary<br \/>\n     authorities will pass orders in<br \/>\n     accordance with law.&#8221;<\/p><\/blockquote>\n<p>     Inasmuch as  a copy of the enquiry report was available<br \/>\nwith  the   petitioner,\t the  disciplinary  authority  after<br \/>\nreferring the above said Division Bench judgment called upon<br \/>\nthe first  respondent to  submit his  explanation in writing<br \/>\nwithin one  month from\tthe date of receipt thereof. Inspite<br \/>\nof the\treminders given\t to the first respondent, he did not<br \/>\nchoose to give to the first respondent, he did not choose to<br \/>\ngive any  explanation dealing  with the findings rendered by<br \/>\nthe enquiry  officer accepted by the disciplinary authority.<br \/>\nOn the\tother hand,  the firs  respondent treated  the\tshow<br \/>\ncause notices  as not in conformity with the direction given<br \/>\nby the\tDivision Bench\tof the High Court while disposing of<br \/>\nF.M.A.T.  1834\t of  1986.   After  duly   considering\t the<br \/>\nrepresentations, authority imposed a penalty of dismissal by<br \/>\norder dated 7.3.1989.\n<\/p>\n<p>     The first\trespondent again  challenged  the  order  of<br \/>\ndismissal by  filing a\twrit petition and the learned Single<br \/>\nJudge found  that full opportunities were given to the first<br \/>\nrespondent to  offer any  explanation he wanted to offer and<br \/>\nhe was\tsatisfied with\tthe reasonable\topportunity given to<br \/>\nthe first respondent in the light of the observarions of the<br \/>\nDivision Bench referred to above. Consequently, he dismissed<br \/>\nthe writ  petition. The\t first respondent  aggrieved by\t the<br \/>\ndismissal of  the writ petition preferred  F.M.A.T. No. 1182<br \/>\nof 1992.\n<\/p>\n<p>     The learned  Judges after referring to the observations<br \/>\nof the previous Division Bench held as follows :-\n<\/p>\n<blockquote><p>     &#8220;There is nothing on record that the<br \/>\n     authority concerned had taken a decision<br \/>\n     pursuant to the liberty given by the<br \/>\n     earlier Division Bench with regard to<br \/>\n     whether second show cause notice<br \/>\n     requirement of giving show cause notice,<br \/>\n     if this is a part of the principles of<br \/>\n     natural justice cannot be curtailed or<br \/>\n     abridged by any order passed by the<br \/>\n     Court&#8230; As  we are of the view that the<br \/>\n     order of punishment was passed without<br \/>\n     issuing any second show cause notice,<br \/>\n     the order of punishment dated 7th March,<br \/>\n     1989 passed by the disciplinary<br \/>\n     authority cannot  stand and accordingly,<br \/>\n     the order\tof the learned trial Judge is<br \/>\n     set aside.&#8221;<\/p><\/blockquote>\n<p>     The  Division  Bench,  however,  gave  liberty  to\t the<br \/>\nappellants to  proceed afresh  only after  giving the second<br \/>\nshow cause notice against the proposed punishment.\n<\/p>\n<p>     Learned counsel  for  the\tappellant  after  taking  to<br \/>\nthrough\t the  paper  book  submitted  that  factually  after<br \/>\ndisposal of  the appeal\t by the\t Division Bench\t on Bench on<br \/>\nearlier occasion, show cause notices were given to the first<br \/>\nrespondent and\tit is  first respondent\t who failed to avail<br \/>\nthe opportunities  given to  him.  Therefore,  according  to<br \/>\nlearned counsel,  the assumption  of the learned Judges that<br \/>\nthere was  no further  show cause notice before the impugned<br \/>\npunishment was\timposed was  not correct  and therefore, the<br \/>\norder is liable to be set aside.\n<\/p>\n<p>     Learned counsel  appearing\t for  the  first  respondent<br \/>\nthough initially  denied that  the first respondent was ever<br \/>\nsupplied with  the report  of the  enguiry  officer,  subse-<br \/>\nquently admitted  the supply  of the  report of\t the enquiry<br \/>\nofficer. However,  he contended\t that the direction given by<br \/>\nthe Division  Bench on the earliel occasion. We do not think<br \/>\nthat we\t can accept  this contention  of the learned counsel<br \/>\nfor the\t first respondent.  We have  see factually the first<br \/>\nrespondent was supplied with the copy of the enquiry report.<br \/>\nHe was called upon to submit his explanation in the light of<br \/>\nearlier\t Division   Bench  judgment.  The  first  respondent<br \/>\ninstead of  submitting his  explanation found fault with the<br \/>\nform of\t notice and  raised contentions\t not relevant to the<br \/>\nissued.\n<\/p>\n<p>     In the  circumstances and\ton facts,  we are  satisfied<br \/>\nthat the  first respondent  was given reasonable opportunity<br \/>\nbefore imposing\t the penalty  of dismissal  and the Division<br \/>\nBench was  not justified  in  setting  aside  the  order  of<br \/>\ndismissal on  the sole\tground that there was no second show<br \/>\ncause notice issued before the impugned order was passed.\n<\/p>\n<p>     Though the\t question whether  second show\tcause notice<br \/>\nwas at all necessary having regard to the dated of dismissal<br \/>\norder and  having regard  to pronouncements  of this Court&#8217;s<br \/>\njudgment in  <a href=\"\/doc\/1190519\/\">Managing Director,\t ECIL, Hyderabad  and others<br \/>\nvs. B.\tKarunakar &amp;  Others<\/a> 1993  (4) SCC 727 was raised and<br \/>\nargued, we  do not propose to go into it in view of the fact<br \/>\nthat factually\ta second  show cause notice was give and the<br \/>\nfirst respondent  was  not  diligent  enough  to  avail\t the<br \/>\nopportunity.\n<\/p>\n<p>     In the  result, the  appeal is  allowed,  the  impugned<br \/>\njudgment and  order of the Division Bench dated 3.9. 1993 is<br \/>\nset aside  and that of the learned Single Judge is restored.<br \/>\nHowever, there will be no order as to costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India The West Bengal State &#8230; vs Paritosh Bagchi &amp; Others on 19 October, 1995 Equivalent citations: 1995 SCC (6) 562, 1995 SCALE (6)83 Author: V K.
