     The petitioner has approached this Court challenging<\/p>\n
the steps taken by the respondent bank for realisation of the<\/p>\n
amount due from the petitioner invoking the provisions<\/p>\n
under the SARFAESI Act. The case of the petitioner is that<\/p>\n
the default was not wilful or due to any deliberate<\/p>\n
negligence, but for some unforeseen circumstances in view<\/p>\n
the sudden down fall in the business. Despite the adverse<\/p>\n
circumstances, it is stated that the petitioner has taken<\/p>\n
earnest efforts to clear the entire liability and accordingly,<\/p>\n
various payments have been effected to the different loans<\/p>\n
at different points of time and also in compliance with the<\/p>\n
directions issued by this Court, while intercepting the<\/p>\n
coercive steps as per the interim orders.<\/p>\n
     2. The first respondent had filed a statement, stating<\/p>\n

that the amount paid by the petitioner at different points of<\/p>\n
time have been given credit to and the appropriation has<\/p>\n
been made as against the liability under different loan<\/p>\n
transactions. It is also brought to the notice of this Court<\/p>\n
that, besides the three ‘housing loans’ availed by the<\/p>\n
petitioner, there were three ‘business loans’ as well and<\/p>\n
that the proceedings were being pursued by the bank for<\/p>\n
realisation of the amount due under all these loan<\/p>\n
transactions.\n<\/p>\n
      3.     The learned counsel for the first respondent<\/p>\n
submits with reference to the contents of the statement<\/p>\n
that, after giving credit to the amount paid under the<\/p>\n
various loan transactions, a sum of about Rs.15.50 lakhs is<\/p>\n
outstanding under the ‘housing loans’, while a further sum<\/p>\n
of about Rs.10.80 lakhs is outstanding under the ‘business<\/p>\n
loan accounts’ as on 31\/12\/2009. It is further stated that, by<\/p>\n
virtue of the payments effected by the petitioner, the ‘over<\/p>\n
due’ amount          in the housing loan accounts has been<\/p>\n

liquidated. It is however added in paragraph 6 that the<\/p>\n
regularisation of the ‘business loan’ cannot be considered as<\/p>\n
the petitioner does not have any business as on date and<\/p>\n
further that the regularisation of the ‘housing loan’ can be<\/p>\n
considered,       once   the petitioner  clears  the    entire<\/p>\n
outstanding amount in the business loans completely.<\/p>\n
      4. After considering the facts and circumstances and<\/p>\n
in view of the admitted fact that the entire ‘over due’<\/p>\n
amounts under the ‘housing loans’ have been satisfied by<\/p>\n
the petitioner, the further stipulation made by the<\/p>\n
respondent to clear the business loans first, as a pre-<\/p>\n
condition to have the ‘housing loans’ regularised, does not<\/p>\n
appear to be correct or proper.       True, the loan facility<\/p>\n
provided by the bank to the petitioner is on the basis of a<\/p>\n
specific contract. However, the respondent bank, which is<\/p>\n
very much in the public sector, cannot impose unreasonable<\/p>\n
restrictions; particularly with regard to the liability of the<\/p>\n
persons concerned under the ‘housing sector’; which is<\/p>\n

being provided and implemented also in support of the<\/p>\n
policy of the Government to promote such welfare<\/p>\n
measures.\n<\/p>\n
      5. In the above circumstances, the ‘over due’ amount<\/p>\n
under the ‘housing loan accounts’ having been admittedly<\/p>\n
cleared by the petitioner, the respondent bank is directed to<\/p>\n
regularise the ‘housing loan’ accounts forthwith.<\/p>\n
      6. With regard to the liability of the petitioner under<\/p>\n
the three ‘business loans’, the outstanding amount is only<\/p>\n
about Rs.10.80 lakhs, with further interest and costs from<\/p>\n
1\/1\/2010. After hearing both the sides, this Court permits<\/p>\n
the petitioner to clear the said liability by way of ‘3’ equal<\/p>\n
instalments, the first of which shall be effected on or before<\/p>\n
the 25th February 2010 and the remaining 2 instalments<\/p>\n
shall be effected on or before the 25th of the succeeding<\/p>\n
months. Subject to the above, the recovery proceedings by<\/p>\n
the respondent bank shall be kept in abeyance for the time<\/p>\n
being. It is made clear that, if any default is made in<\/p>\n

clearing the liability as above, towards the ‘business loans’<\/p>\n
or if any 2 consecutive defaults are made with regard to the<\/p>\n
regular EMIs to be paid under the ‘housing loans’, the<\/p>\n
respondent bank will be at liberty to proceed with further<\/p>\n
steps for realisation of the entire amount in a lump sum, by<\/p>\n
pursuing such steps from the stage where it stands now.<\/p>\n
       The writ petition is disposed of as above.<\/p>\n
