JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n\t\t\t\tDate\n: 21\/04\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\tAt<br \/>\nthe outset, Mr. Ravindra Shah, learned counsel states that he is not<br \/>\npressing the prayer made at paragraph-3(C) in the present<br \/>\napplication.\n<\/p>\n<p>2.\tThis<br \/>\napplication has been filed with a prayer to bring on record<br \/>\nrespondents Nos.2(A) to 2(E), who are the heirs and legal<br \/>\nrepresentatives of deceased-respondent No.2, Pannaben Jagmohandas<br \/>\nParikh and respondents Nos.3(A) to 3(C), who are<br \/>\nthe heirs and legal representatives of deceased-respondent No.3,<br \/>\nSanatkumar Muljibhai Shah, on the record of Special Civil Application<br \/>\nNo.22832 of 2005.\n<\/p>\n<p>3.\tRule<br \/>\nwas issued on 03.03.2010. The endorsement on the Board indicates that<br \/>\nnotice of Rule has been served upon respondents Nos.2\/1 to 2\/5 and<br \/>\nrespondents Nos.3\/1 to 3\/3, but none appears on their behalf.\n<\/p>\n<p>4.\tI<br \/>\nhave heard Mr. Ravindra Shah, learned counsel for the applicant and<br \/>\nperused the averments made in the application. It is averred therein<br \/>\nthat respondent No.2, Pannaben Jagmohandas Parikh expired on<br \/>\n18.08.2009 and a copy of the death Certificate is annexed as<br \/>\nAnnexure-A. Respondent No.3, Sanatkumar Muljibhai Shah expired on<br \/>\n23.12.2006, as per the copy of the death Certificate annexed as<br \/>\nAnnexure-B.  It is submitted by Mr. Ravindra Shah, and it is also<br \/>\naverred in the application, that the applicant learnt<br \/>\nabout the deaths of deceased  Pannaben Jagmohandas Parikh and<br \/>\nSanatkumar Muljibhai Shah, only on 5.12.2009, through a common friend<br \/>\nof the applicant, Shri Chandravadan J. Shah, and upon getting this<br \/>\ninformation, immediate steps have been taken to file the present<br \/>\napplication, on 07.01.2010.  It is further submitted that there is no<br \/>\ndelay in preferring the present application.\n<\/p>\n<p>5.\tHaving<br \/>\nheard the learned counsel for the applicant, and having perused the<br \/>\naverments made therein, the prayers made in the application deserve<br \/>\nto be granted.\n<\/p>\n<p>6.\tAccordingly,<br \/>\nthe application is partly allowed. respondents Nos.2(A) to 2(E) and<br \/>\nrespondents Nos.3(A) to 3(C) are directed to be brought on the record<br \/>\nof Special Civil Application 22832 of 2005, as the heirs and legal<br \/>\nrepresentatives of  deceased-respondent No.2, Pannaben Jagmohandas<br \/>\nParikh and  deceased-respondent No.3, Sanatkumar Muljibhai Shah,<br \/>\nrespectively.
