Shah, Assistant\nGovernment Pleader for the\nRespondents  \n====================================== \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BHAGWATI PRASAD\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BANKIM.N.MEHTA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 17\/02\/2010 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE BHAGWATI PRASAD)<\/p>\n<p>\tThis<br \/>\nappeal is directed against the judgment and order dated 15th<br \/>\nJuly 1996 passed by the learned Single Judge in Special Civil<br \/>\nApplication No.2015 of 1982 whereby the learned Single Judge rejected<br \/>\nthe petition filed by the petitioners.\n<\/p>\n<p>\tAfter<br \/>\nacceptance of the recommendations of Desai Pay Commission the same<br \/>\nwere given effect from 1st January 1973 and the same were<br \/>\ngiven legal form by framing Gujarat Civil Services (Revision of Pay)<br \/>\nRules, 1975.   The aforesaid Rules were published in the Gazette on<br \/>\n21st October 1975.   The appellants were appointed as<br \/>\nAssistants on or after 29th November 1975.   The effect of<br \/>\nrecommendations of the earlier Pay Commission came to an end on 31st<br \/>\nDecember 1973.    The petitioners therefore filed the petition before<br \/>\nthe learned Single Judge claiming the benefit based upon the<br \/>\nResolution dated 4th August 1969.     The petition was<br \/>\nrejected by the learned Single Judge holding that none of the legal<br \/>\nrights of the petitioners has been infringed.\n<\/p>\n<p>\tHeard<br \/>\nlearned counsel for the parties.   The appointment of the appellants<br \/>\nwas made admittedly after 21st October 1975 without the<br \/>\nRules specifying that a particular pay scale would be admissible to<br \/>\nthe Legal Assistants and the provisions for payment of advance<br \/>\nincrements, which was earlier in vogue was recalled by the subsequent<br \/>\nResolution.   The petitioners were appointed pursuant to the Rules,<br \/>\nwhich were published in the Gazette on 21st October 1975<br \/>\nand in these Rules there was no provision for making any advance<br \/>\nincrements.   While they were appointed, they were given the benefit<br \/>\nof higher start, but that was under misconception and error.   The<br \/>\nlearned Single Judge has noted that such higher start, as has been<br \/>\ngiven, was rightly withdrawn by the State authorities because, when<br \/>\nthe petitioners were appointed in the year 1975 there was no<br \/>\nprovision giving higher start and  Gujarat Civil Services (Revision<br \/>\nof Pay) Rules, 1975 did not make any provision.   In that view of the<br \/>\nmatter, calling of higher pay scale as higher start to the<br \/>\npetitioners has been held to be proper and we do not think any<br \/>\nillegality has been committed by the learned Single Judge.\n<\/p>\n<p>\tThe<br \/>\nappeal has no force.
