PATTANAIK\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t      J U D G M E N T<br \/>\n     PATTANAIK, J.\n<\/p>\n<p>     Leave granted.\n<\/p>\n<p>     This appeal  by special  leave is\tdirected against the<br \/>\norder  of   the\t Andhra\t  Pradesh  AdmInistrative   Tribunal<br \/>\ndismissing the\tappellant&#8217;s application\t registered as\tO.A.<br \/>\nNo. 40498  of 1990  and\t the  order  dismissing\t the  review<br \/>\napplication filed  by the  appellant which was registered as<br \/>\nM.A. No. 2191 of 1994 by order dated 24th August, 1994.\n<\/p>\n<p>     The Secretary, Andhra Pradesh Public Service Commission<br \/>\nhas issued  an advertisement  for the  20 posts\t in Group  I<br \/>\nservices  in   the  cadre   of\tDeputy\t Collector  for\t the<br \/>\nrecruitment  year  1980-81  by\ta  Notification\t dated\t28th<br \/>\nJanuary, 1980.\tThe appellant who was qualified and eligible<br \/>\nto  apply  for\tthe  same,  appeared  at  the  written\ttest<br \/>\nconducted by the Public Service Commission and also appeared<br \/>\nin the\tinterview which\t was held  on 19th January, 1981. It<br \/>\nwas decided  to fill-up\t 10 posts of Deputy Collector out of<br \/>\nwhich two  posts were  meant for  Scheduled Castes,  one for<br \/>\nBackward Class\tGroup &#8216;A&#8217;  and two  for Backward Class Group<br \/>\n&#8216;D&#8217; and\t rest 5\t for candidates\t from open  competition. The<br \/>\nappellant belong  to the last category whereas respondents 4<br \/>\nto 9  belong to the Backward Classes category. The appellant<br \/>\nchallening the\tappointment of the respondents on the ground<br \/>\nthat in\t making\t the  appointment  the\tconcerned  authority<br \/>\nviolated the  provisions of the Rules of Reservations and in<br \/>\nfact appointed\tpersons from reserved category more than the<br \/>\npercentage of reservation meant, filed an application in the<br \/>\nNadir Prates Administrative Tribunal which was registered as<br \/>\nR.P. No. 6652. The Tribunal, however, did not interfere with<br \/>\nthe appointments  made in  the year  1981 on  the ground  of<br \/>\nlatches on  the\t part  of  the\tappellant  to  approach\t the<br \/>\nTribunal  but\tobserved  that\tthe  representation  of\t the<br \/>\nappellant may  be considered  for any  future  vacancy.\t The<br \/>\nappellant thereafter  made a  representation to\t the  Public<br \/>\nService Commission  and the  Commission\t rejected  the\tsame<br \/>\nholding\t that\tthe  Comission\thas  no\t power\tto  consider<br \/>\nanybody&#8217;s application on compassionate ground. The appellant<br \/>\nthen filed  a fresh  petition before  the Tribunal which was<br \/>\nregistered  as\t O.A.  No.   40498  of\t1990  and  the\tsaid<br \/>\napplication was\t dismissed by  Tribunal\t on  the  ground  of<br \/>\nlatches taking\tinto account  the fact that a selection made<br \/>\nas early  as in the year 1980 cannot be annulled in the year<br \/>\n1994 when the application challenging the said selection was<br \/>\nfiled as  late as  in 1990.  The appellant  then  filled  an<br \/>\napplication for\t review and  the review\t application  having<br \/>\nbeen rejected by the impugned order dated 24th August, 1994,<br \/>\nhas approached this Court.\n<\/p>\n<p>     The appellant  appeared in\t person in  this  Court\t and<br \/>\ncontended that\tappointments having  been   made contrary to<br \/>\nthe Rules  of  Reservations,  the    said  appointments\t are<br \/>\ninvalid and  inoperative. The\t  appellant&#8217;s  right  to  be<br \/>\nappointed was illegally\t taken away and therefore this Court<br \/>\nshould annul   the appointment of the respondents forthright<br \/>\nand   direct reconsideration of the appellant&#8217;s appointment.<br \/>\nWe are\tunable to  accept this\t contention  at this belated<br \/>\nstage. As  has been  stated earlier the appellant challenged<br \/>\nthe  appointment of the respondents before the Tribunal<br \/>\nin the\tyear 1987  and the  Tribunal did not interfere\twith<br \/>\nthe appointments  made in  the year 1981 and the  said order<br \/>\nbecame final  not being\t challenged in any higher court. The<br \/>\nappellant then\tfiled second   round of petition in the year<br \/>\n1990 which  was\t  rejected by  the Tribunal on the ground of<br \/>\nlatches\t and the application for review stood dismissed on<br \/>\nthe ground  that there\tis no  error of\t law apparent on the<br \/>\nface of the order which can be reviewed by  the Tribunal. On<br \/>\nthe admitted  facts that   appointment of respondents to the<br \/>\npost of\t Deputy Collector  was made  in the  year  1981,  an<br \/>\napplication   before the Tribunal in the year 1990 could not<br \/>\nhave been  entertained after  lapse of\t9 years. Then  again<br \/>\nthere is  an additional\t hurdle on the part of the appellant<br \/>\nnamely\taffected   persons  are\t not  made  parties  to\t the<br \/>\nproceedings. It\t is too well settled that without impleading<br \/>\na person  as a\tparty whose  rights would  be  affected,  no<br \/>\nCourt\/Tribunal can  pass  any  order  against  him.  In\t the<br \/>\naforesaid  premises   we  find\t no  justification  for\t our<br \/>\ninterference under  Article 136 of the Constitution with the<br \/>\nimpugned order\tof the\tTribunal.
