Joseph J.\n<\/p>\n<\/p>\n<p>      The appellant is the petitioner in a petition filed under<\/p>\n<p>Section 166 of the Motor Vehicles Act. Aggrieved by the<\/p>\n<p>adequacy in quantum of compensation awarded, he had filed<\/p>\n<p>this appeal.\n<\/p>\n<p>      2. We heard the learned counsel for the appellant and the<\/p>\n<p>learned counsel for the second respondent Insurance Company.<\/p>\n<p>      3. The injuries allegedly suffered by the appellant are as<\/p>\n<p>follows:\n<\/p>\n<blockquote><p>       &#8220;Comminuted fracture right femur, head injury,<\/p>\n<p>       subdural haematoma, frontal contusion, post<\/p>\n<p>       traumatic      bitemperal         hemiunopia,          fracture<\/p>\n<p>       fibula, lacerated wound scalp, lacerated wound<\/p>\n<p>M.A.C.A . NO: 799 OF 2007<br \/>\n<span class=\"hidden_text\">                                   :2:<\/span><\/p>\n<p>           chin,  frontal    bone    fracture, extra   dural<\/p>\n<p>           haematoma, and considerable loss of vision due<\/p>\n<p>           to damage of opthalmic nerve.&#8221;<\/p><\/blockquote>\n<p>      4. The learned counsel for the appellant would essentially<\/p>\n<p>raise three issues before us. Firstly, he would contend that the<\/p>\n<p>Tribunal has awarded only Rs.55,000\/- towards disability. The<\/p>\n<p>appellant was working as a peon in an aided school, and he<\/p>\n<p>continues in his work.         The appellant intends to apply for<\/p>\n<p>Voluntary retirement, it is submitted. But as on the date when the<\/p>\n<p>Tribunal took the decision, the appellant was continuing in his<\/p>\n<p>work. The Tribunal has proceeded to determine compensation on<\/p>\n<p>the basis of disability certificate, in which the disability was 35%.<\/p>\n<p>This court has referred the appellant to the Medical Board. A<\/p>\n<p>certificate has been issued by the Government Medical College<\/p>\n<p>Hospital, Kottayam.      Therein it is stated that the appellant is<\/p>\n<p>having 85% permanent disability, out of which 70% is visual<\/p>\n<p>disability and 15% is neuro surgical disability.     Learned counsel<\/p>\n<p>M.A.C.A . NO: 799 OF 2007<br \/>\n<span class=\"hidden_text\">                                  :3:<\/span><\/p>\n<p>for the appellant submits that the appellant is not able to recognise<\/p>\n<p>people because of loss of vision to his eyes. Secondly, he would<\/p>\n<p>contend that the appellant has not been awarded any compensation<\/p>\n<p>towards loss of amenity. Thirdly, he submitted that no amount is<\/p>\n<p>awarded towards future medical bills.\n<\/p>\n<p>      5. Learned counsel for the Insurance Company supported the<\/p>\n<p>award.\n<\/p>\n<p>      6. In the light of the assessment of the disability assessed by<\/p>\n<p>the Medical Board members directed by this court, we think that<\/p>\n<p>the appellant is entitled for enhancement of compensation on the<\/p>\n<p>basis of the assessment for the post retirement period. In this<\/p>\n<p>regard, we have to ascertain his income. The appellant is a peon.<\/p>\n<p>Already the appellant is having disability. Having regard to his<\/p>\n<p>condition and the nature of the employment that he is likely to be<\/p>\n<p>engaged in, we can safely fix the income of the appellant as<\/p>\n<p>Rs.2,000\/- per month.      Next question to be considered is the<\/p>\n<p>percentage of disability. No doubt, the learned counsel for the<\/p>\n<p>M.A.C.A . NO: 799 OF 2007<br \/>\n<span class=\"hidden_text\">                                 :4:<\/span><\/p>\n<p>Insurance company points out that the percentage of disability<\/p>\n<p>certified and produced in the Tribunal was 35%. But there is an<\/p>\n<p>assessment by the Medical board, wherein the total disability is 70<\/p>\n<p>+ 15 = 85%. We can safely fix the disability as 70%. On this<\/p>\n<p>basis and taking the multiplier of 8, and as the appellant is to retire<\/p>\n<p>at the age of 55 and taking the income as Rs.2,000\/- per month, the<\/p>\n<p>appellant would be entitled for Rs.1,34,400\/-. After deducting the<\/p>\n<p>amount already awarded, the appellant would be entitled for a sum<\/p>\n<p>of Rs.79,400\/- more. We also note that the appellant is having<\/p>\n<p>15% neurological disability, on account of injuries sustained by<\/p>\n<p>him, which is assessed by the Medical Board. No amount has<\/p>\n<p>been awarded towards loss of amenity. Also we note that no<\/p>\n<p>amount is granted for future medical bills. Considering the nature<\/p>\n<p>and after effects of the injuries, we think that the appellant is<\/p>\n<p>awarded an amount of Rs.15,000\/- more. Thus, the appellant is<\/p>\n<p>allowed to realise an amount of Rs.94,400\/- more. The learned<\/p>\n<p>counsel for the appellant has complained that the Tribunal has<\/p>\n<p>M.A.C.A . NO: 799 OF 2007<br \/>\n<span class=\"hidden_text\">                                :5:<\/span><\/p>\n<p>awarded only 6% interest. We modify and order interest at 7.5%<\/p>\n<p>on the amount already awarded by the Tribunal.<\/p>\n<p>      Accordingly, this appeal is allowed and the appellant is<\/p>\n<p>allowed to realise an amount of Rs.94,400\/- along with interest at<\/p>\n<p>the rate of 7.5% interest from the date of petition till the date of<\/p>\n<p>realisation from the respondents. The appellant is also awarded<\/p>\n<p>interest at 7.5% from the date of petition till the date of realisation<\/p>\n<p>on the amount already awarded.\n<\/p>\n<\/p>\n<p>                                  K.
