KURIAKOSE &amp; K.SURENDRA MOHAN JJ.\n            -----------------------------------------------\n                     L.A.A.No. 1024 OF 2009\n            -----------------------------------------------\n           Dated this the 27th day of August, 2009\n\n                          J U D G M E N T\n<\/pre>\n<p>PIUS C.KURIAKOSE,J.\n<\/p>\n<p>     Even though Sri.Basant Balaji, learned senior Government<\/p>\n<p>Pleader has addressed us          very persuasively, having gone<\/p>\n<p>through the impugned judgment, we are not inclined to<\/p>\n<p>entertain this appeal. The property was in Thodupuzha Village<\/p>\n<p>and was obviously situated within the area of the Thodupuzha<\/p>\n<p>Municipality. Relevant Section 4(1) notification was published on<\/p>\n<p>12\/6\/2002. The Land Acquisition Officer awarded land value at<\/p>\n<p>the rate of Rs.19,512\/- per Are. This was             refixed by the<\/p>\n<p>reference court under the impugned judgment to Rs.57,773\/- per<\/p>\n<p>Are. Taking into account various other judgments of this court<\/p>\n<p>pertaining to acquisition of land in Thodupuzha Village including<\/p>\n<p>the judgment     in <a href=\"\/doc\/907571\/\">State of Kerala v. Jose Simon<\/a>(2009 (1) KLT<\/p>\n<p>760), we are of the view that the value awarded for the acquired<\/p>\n<p>property, which was within the area of the Thodupuzha<\/p>\n<p>Municipality and was already enjoying the frontage of road, is<\/p>\n<p>not excessive.\n<\/p>\n<p>    The appeal wills stand dismissed.\n<\/p>\n<\/p>\n<p>                               (PIUS C.KURIAKOSE, JUDGE)<\/p>\n<p>                             ( K.SURENDRA MOHAN,JUDGE)<\/p>\n<p>dpk<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court State Of Kerala Rep.
