VENKATASWAMI\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     These appeals  have been  filed, for  setting aside the<br \/>\norder dated  March  20,\t 1990,\tpassed\tby  the\t High  Court<br \/>\nallowing the civil revision application which had been filed<br \/>\non behalf of the respondent &#8211; decree holder.\n<\/p>\n<p>     There is  no dispute  that the  land  in  question\t was<br \/>\ntransferred in\tfavour of  the appellant  No.1 by one Kishan<br \/>\nChand and  Jagdish Chand in the year 1980. Thereafter a suit<br \/>\nfor pre-emption\t was filed on behalf of the respondent. That<br \/>\nsuit was decreed on 27.8.1983. The appeal filed on behalf of<br \/>\nthe appellants\twas dismissed  by the  court  of  appeal  on<br \/>\n30.11.1983. Second  appeal filed on behalf of the appellants<br \/>\nwas  also.   dismissed\tby   the  High\tCourt  on  5.4.1984.<br \/>\nThereafter, the\t decree holder\t&#8211; respondent  took steps for<br \/>\nexecution of  the decree  for pre-emption  of the  lands  in<br \/>\nquestion in the year 1984. An objection was taken before the<br \/>\nexecuting court\t that as  only share in the land in question<br \/>\nhad been  transferred  the  decree  passed  for\t pre-emption<br \/>\ncannot be  executed. That  objection found  favour with\t the<br \/>\nexecuting court.  Being aggrieved by the order passed by the<br \/>\nexecuting court\t the respondent\t filed civil revision before<br \/>\nthe High  Court which was allowed by the impugned order. The<br \/>\nHigh Court  after referring  to the earlier judgments of the<br \/>\nsaid court including the Full Bench judgment observed:\n<\/p>\n<blockquote><p>\t  The proposition  laid down  in<br \/>\n     the Full  Bench judgment,\treferred<br \/>\n     to above,\thas no\tapplicability to<br \/>\n     the facts\tof the\tpresent case. In<br \/>\n     that case\tthe question  was as  to<br \/>\n     whether the  sale was  of\tspecific<br \/>\n     khasra No.\t out of\t the joint land.<br \/>\n     The   question   of   getting   the<br \/>\n     physical possession of the specific<br \/>\n     khasra  nos.   out\t of   the  joint<br \/>\n     holding   is    governed\tby   the<br \/>\n     provisions of  the\t Code  of  Civil<br \/>\n     Procedure, which provides as to how<br \/>\n     the decree\t for immovable\tproperty<br \/>\n     is to  be executed. Admittedly, the<br \/>\n     decree is\tfor specific khasra nos.<br \/>\n     which were\t sold to  the vendee  by<br \/>\n     the  vendor.  That\t being\tso,  the<br \/>\n     decree-holder is  entitled\t to  the<br \/>\n     physical possession of the specific<br \/>\n     khasra nos.  though it  may be open<br \/>\n     to the  judgment  debtors\tto  make<br \/>\n     adjustments   at\t the   time   of<br \/>\n     partition, if any.&#8221;<\/p><\/blockquote>\n<p>     Faced with\t this situation\t aforesaid, on behalf of the<br \/>\nappellants it  was submitted  before the  High Court that as<br \/>\nthe relevant  provisions of the Punjab Pre-emption Act, 1913<br \/>\nhad been declared to be unconstitutional by the Constitution<br \/>\nBench of  this Court in the case of <a href=\"\/doc\/986432\/\">Atam Prakash v. State of<br \/>\nHaryana &amp;  Ors.,<\/a> reported  in 1986  (2) SCC  249, the decree<br \/>\npassed in  the suit  for pre-emption  filed on behalf of the<br \/>\nrespondent shall  be deemed to be nullity and as such decree<br \/>\ncannot\tbe  executed.  The  High  Court\t rejected  the\tsaid<br \/>\nobjection. This Court in the case of Atam Prakash v.State of<br \/>\nHaryana &amp;  Ors has  specifically said  in respect of decrees<br \/>\nwhich had become final as follows:\n<\/p>\n<blockquote><p>     &#8220;We are  told that\t in  some  cases<br \/>\n     suits are pending in various Courts<br \/>\n     and,  where   decrees   have   been<br \/>\n     passed,  appeals\tare  pending  in<br \/>\n     appellate Courts.\tSuch  suits  and<br \/>\n     appeals will  now be disposed of in<br \/>\n     accordance\t with\tthe  declaration<br \/>\n     granted by\t us. We\t are  told  that<br \/>\n     there are\tfew  cases  where  suits<br \/>\n     have been\tdecreed and  the decrees<br \/>\n     have  become   final,  no\t appeals<br \/>\n     having  been  filed  against  those<br \/>\n     decrees.  The   decrees   will   be<br \/>\n     binding   inter-parties   and   the<br \/>\n     declaration granted  by us\t will be<br \/>\n     of\t no   avail   to   the\t parties<br \/>\n     thereto.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>\t\t     (emphasis supplied)<br \/>\nIt is,\ttherefore, apparent  that where\t the suits have been<br \/>\ndecreed and  such decrees have become final since no appeals<br \/>\nhave been  filed against  the same,  the  said\tdecrees\t are<br \/>\nbinding\t inter-parties\tand  the  declaration  made  by\t the<br \/>\nSupreme Court is of no avail to the parties thereto.<\/p><\/blockquote>\n<p>     In the  present case  as mentioned\t above the  suit for<br \/>\npre-emption  was  decreed  on  27.8.1983.  That\t decree\t was<br \/>\naffirmed by  the court\tof appeal  on 30.11.1983. The second<br \/>\nappeal filed  before the High Court against the judgment and<br \/>\ndecree of  the trial  court and\t the  court  of\t appeal\t was<br \/>\ndismissed on  5.4.1984. It  is admitted\t position that at no<br \/>\nstage the  appellants questioned  the validity of the decree<br \/>\nquestion before\t this Court.  We are  informed that after 12<br \/>\nyears in  the year  1996, a  Special Leave Petition has been<br \/>\nfiled against  order dated  5.4.1984 passed  in\t the  second<br \/>\nappeal by  the High  Court. However,  the fact\tremains that<br \/>\nwhen the  High Court  allowed the  civil revision  filed  on<br \/>\nbehalf of  the respondent  on 20.3.1990\t the decrees  of the<br \/>\ntrial court,  the court\t of appeal  and the  High  Court  in<br \/>\nsecond appeal  had become  final. As  such the\tdirection of<br \/>\nthis Court  in Atam Prakash&#8217;s case (supra) that such decrees<br \/>\nshall\tbe   binding   inter-parties   notwithstanding\t the<br \/>\ndeclaration of\tthis Court  in the  aforesaid judgment,\t was<br \/>\nfully applicable  in the  present case.\t The High  Court has<br \/>\nrightly come  to the  conclusion  that\tnotwithstanding\t the<br \/>\njudgment of  the Constitution  Bench in\t the  case  of\tAtam<br \/>\nPrakash (supra) the decree in the suit for pre-emption filed<br \/>\non behalf of the respondent was binding between the parties.\n<\/p>\n<p>     On behalf\tof the appellants our attention was drawn to<br \/>\nthe substituted\t Section 15  in the  Punjab Preemption\tAct,<br \/>\n1913 which  has been  notified on  7th May,  1995 and it was<br \/>\nurged that  after the said amendment no right of pre-emption<br \/>\ncan be enforced. Section 15 which has been substituted is as<br \/>\nfollows:\n<\/p>\n<blockquote><p>     &#8220;15. Right\t of pre-emption\t to vest<br \/>\n     in tenant:-\n<\/p><\/blockquote>\n<blockquote><p>     The right of Pre-emption in respect<br \/>\n     of sale  of agricultural  land  and<br \/>\n     village  immovable\t property  shall<br \/>\n     vest in  the tenant who holds under<br \/>\n     tenancy of\t the vendors the land or<br \/>\n     property sold or a part thereof.&#8221;<\/p><\/blockquote>\n<p>     On a  plain reading  the  aforesaid  section  has\tbeen<br \/>\nintroduced prospectively  and there  is no  question of\t the<br \/>\nsaid section affecting in any manner the judgment and decree<br \/>\npassed in  the suit  for pre-emption as early as in the year<br \/>\n1983 affirmed  by the High Court in the second appeal in the<br \/>\nyear 1984.\n<\/p>\n<p>     According to  us the  impugned order passed by the High<br \/>\nCourt is  in terms  of the  direction given by this Court in<br \/>\nthe judgment  of the Constitution Bench in Atam Prakash case<br \/>\n(supra) and we find no reason to take a contrary view.
