SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 29\/08\/2008 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tPresent<br \/>\nappeal from order has been filed by the appellant-original plaintiff<br \/>\nchallenging the order passed by the learned trial court passed below<br \/>\nExh.5 dismissing the same, refusing to grant interim injunction in<br \/>\nfavour of the appellant by which it was prayed to restrain the<br \/>\nrespondents herein-original defendants to transfer and\/or alienate<br \/>\nthe property in question.\n<\/p>\n<p>2.\tIn<br \/>\nresponse to the notice issued by this Court, Shri J.B.Pardiwala,<br \/>\nlearned advocate has appeared on behalf of respondents No.4 to 6 ?<br \/>\noriginal defendants No.4 to 6 and has stated at the bar under the<br \/>\ninstructions from his client that the original defendants No.4 to 6 ?<br \/>\nrespondents No.4 to 6 herein do not propose to transfer and\/or<br \/>\nalienate the property in question in any manner whatsoever.<br \/>\nRespondents No. 4 to 6 are directed to act accordingly.\n<\/p>\n<p>3.\tIn<br \/>\nview of the above, Shri Dhaval D.Vyas, learned advocate appearing on<br \/>\nbehalf of the appellant does not press the present appeal from order.<br \/>\nAccordingly, present appeal from order is disposed of with no order<br \/>\nas to costs in view of the above statement made by Shri<br \/>\nJ.B.Pardiwala, learned advocate appearing on behalf of respondents<br \/>\nNo.4 to 6 ?  original defendants No.4 to 6.\n<\/p>\n<p>4.\tIn<br \/>\nview of the dismissal of appeal from order, no order in Civil<br \/>\nApplication No.6567 of 2008 and Civil Application No.6568 of 2008.\n<\/p>\n<p>(<br \/>\nM.R.
