GAURAVBHAI JERAMBHAI PRAJAPATI - Petitioner(s)\n \n\nVersus\n \n\nCOMMISSIONER\nOF POLICE &amp; 2 - Respondent(s)\n \n\n=========================================================\n \nAppearance\n: \nMR\nCHETAN B RAVAL for\nPetitioner(s) : 1, \nMR\nUMANG OZA, AGP for\nRespondents \n=========================================================\n\n\n \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE MD SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 30\/06\/2008 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>Leave<br \/>\nto amend the date of detention.\n<\/p>\n<p>1.\tHeard<br \/>\nthe learned advocate for the petitioner and the learned AGP for the<br \/>\nrespondents.\n<\/p>\n<p>2.\tThe<br \/>\npetitioner-detenue has preferred this petition under Article 226 of<br \/>\nthe Constitution of India, for appropriate writ, order or direction<br \/>\nfor quashing and setting aside the impugned order dated 10.12.2007<br \/>\npassed by the respondent No.1-Commissioner of Police, Ahmedabad City,<br \/>\n in exercise of power under sub-section(2) of Section (3) of the<br \/>\nGujarat Prevention of Anti Social Activities Act, 1985 (\u00fdSPASA Act\u00fd\u00fd<br \/>\nfor short) whereby the petitioner has been detained as a<br \/>\n\u00fdSbootlegger\u00fd\u00fd.  In pursuance of the said impugned order, the<br \/>\npetitioner is detained in Himmatnagar Sub-Jail, Himmatnagar.\n<\/p>\n<p>3.\tFrom<br \/>\nthe grounds of detention, it appears that out of the four offences,<br \/>\nthree Prohibition cases being CR Nos.308 of 2006, 481 of 2006 and<br \/>\n1108 of 2006 have been registered at South Prohibition Station and<br \/>\none case being CR No. 5212 of 2007 has been registered at Vatva<br \/>\nPolice Station, under the provisions of Sections 66B and 66E  under<br \/>\nthe Bombay Prohibition Act, wherein a quantity of total 67  ltrs. of<br \/>\ncountry made liquor were found from the possession of the detenue. On<br \/>\nthe basis of registration of these cases, the detaining authority<br \/>\nheld that the present detenue was carrying on activities of selling<br \/>\ncountry made liquor which is harmful to the health of the public. It<br \/>\nis held by the detaining authority that as the detenue is indulged in<br \/>\nillegal activities, it is required to restrain her from carrying out<br \/>\nfurther illegal activities, i.e. selling of liquor. The detaining<br \/>\nauthority has placed reliance on the above registered offences and<br \/>\nstatements of unnamed witnesses.  In the opinion of this Court, the<br \/>\nactivities of the detenue can, by no stretch of imagination, be said<br \/>\nto be disturbing the \u00fdSpublic order.\u00fd\u00fd It is seen from the grounds<br \/>\nthat a general statement that has been made by the detaining<br \/>\nauthority that consuming liquor is injurious to health.  In fact, a<br \/>\nperusal of the order passed by the detaining authority shows that the<br \/>\ngrounds which  are mentioned in the order are in reference to the<br \/>\nsituation of \u00fdSlaw and order\u00fd\u00fd and not \u00fdSpublic order\u00fd\u00fd.<br \/>\nTherefore, on this ground, the subjective satisfaction arrived at by<br \/>\nthe detaining authority is vitiated on account of non-application of<br \/>\nmind and the impugned order, therefore, deserves to be quashed and<br \/>\nset aside.\n<\/p>\n<p>4.\tExcept<br \/>\nthe statements of some anonymous witnesses, there is no material on<br \/>\nrecord which shows that the petitioner-detenue is carrying on<br \/>\nactivities of selling country made liquor which is harmful to the<br \/>\nhealth of the public. In the case of Ashokbhai Jivraj @ <a href=\"\/doc\/687998\/\">Jivabhai<br \/>\nSolanki v. Police Commissioner, Surat<\/a> [(2001)(1)GLH 393)], having<br \/>\nconsidered the decision of the Hon&#8217;ble Apex Court in the case of Ram<br \/>\nManohar Lohia v. State of Bihar (AIR 1966 SC 740), this Court<br \/>\nheld that the cases wherein the detention order passed on the basis<br \/>\nof the statements of the witnesses falls under the maintenance of<br \/>\n\u00fdSlaw and order\u00fd\u00fd and not \u00fdSpublic order\u00fd\u00fd.\n<\/p>\n<p>5.\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing an<br \/>\norder of detention  of a detenue, the detaining authority must come<br \/>\nto a definite finding that there is threat to the \u00fdSpublic  order\u00fd\u00fd<br \/>\nand it is very clear that the present would not fall within the<br \/>\ncategory of threat to \u00fdSpublic order\u00fd\u00fd. In that view of the matter,<br \/>\nwhen the order of detention has been passed by the detaining<br \/>\nauthority without having adequate grounds for passing the said order,<br \/>\ncannot be sustained and, therefore, it deserves to be quashed and set<br \/>\naside.\n<\/p>\n<p>6.\tIn<br \/>\nthe result, this Special Civil<br \/>\nApplication is allowed. The impugned order of detention passed by the<br \/>\ndetaining authority is hereby quashed and set aside. The detenue is<br \/>\nordered to be set at liberty forthwith, if not required in any other<br \/>\ncase. Rule is made absolute accordingly.
