Both parties<br \/>\nwere present.\n<\/p>\n<p>2.    Appellant&#8217;s RTI-application dated 05.09.2008 contained the<br \/>\nfollowing requests for information:-\n<\/p>\n<p>3.     This information was declined to the appellant citing commercial<br \/>\nconfidence of the public authority under Section 8(1)(d) of the Act.<br \/>\nBesides, the respondents also cited Section 8(1)(j) of the Act to decline<br \/>\nto disclose the information.\n<\/p>\n<p>4.    Appellant, in his second-appeal, has stated that the information<br \/>\nhe requested pertains to a Mediclaim policy he had taken in the name<br \/>\nof his parents.       Such information can scarcely be described as<br \/>\n&#8216;commercial confidence&#8217; of the public authority or &#8216;personal&#8217; to the<br \/>\nthird-party. It is his argument that the public authority was declining to<br \/>\ndisclose the information to the appellant even when they knew fully<br \/>\nwell that appellant was seeking this information relating to his parents.<br \/>\nAT-18052009-21.doc<br \/>\n<span class=\"hidden_text\">                                                               Page 1 of 3<\/span>\n<\/p>\n<p> 5.    Respondents pointed out during the hearing that New India<br \/>\nAssurance Company Ltd as a service-provider had issued a group<br \/>\ninsurance mediclaim policy to a group of officers and employees of the<br \/>\nLIC of India. They (Respondents) had no way of finding out whether<br \/>\nMr.V.S.Srivastava was a member of the said group.\n<\/p>\n<p>6.    It is somewhat surprising that New India Assurance Company Ltd<br \/>\ndespite being the service-provider for the health insurance policy to the<br \/>\ngroup of employees of the LIC of India, does not have a record about<br \/>\nwho all comprised the group.\n<\/p>\n<p>7.   It is their argument nevertheless that they had issued the policy<br \/>\nto a group of employees of LIC of India and not to its individual<br \/>\nmembers.\n<\/p>\n<p>8.    A plea that the service-providers will not share an insurance-<br \/>\nrelated information with a member of a group of policyholders is an<br \/>\nuntenable argument. Even if the contract is between the service-<br \/>\nprovider and the group of policyholders, an individual member of that<br \/>\ngroup has every right to seek insurance-related information about<br \/>\nhimself or his own medical claim. In this particular case, it is an<br \/>\nadmitted fact that the matter relates to information about the medical<br \/>\nclaim for the treatment of one, Mr.V.S. Srivastava, his wife, Mrs.Raj<br \/>\nKumari Srivastava, who happen to be the father and the mother of the<br \/>\npresent appellant. Respondents have argued that even if the matter<br \/>\nrelates to his parents, appellant had no right to seek insurance-related<br \/>\ninformation of the former as within the meaning of the RTI act<br \/>\nappellant is only an outsider and his parents are the third-parties to the<br \/>\nRTI-proceeding.\n<\/p>\n<p>9.    This argument of the respondents, though technically correct, is<br \/>\nhollow in substance. It was open to them to consult the so-called<br \/>\nthird-parties about disclosure of information, which they believed<br \/>\npertained exclusively to those third-parties and even that parties&#8217; son<br \/>\n\u23af the present appellant \u23af have had no right to access this information<br \/>\nwithout their consent. Given the fact that the third-parties are none<br \/>\nother than the parents of the appellant, it was more likely than not that<br \/>\nthey would have given their consent to the disclosure of information.\n<\/p>\n<p>10. I would have expected the respondents to come forward with<br \/>\ndisclosure of the requested information to the appellant recognizing his<br \/>\nclaim as the son of Mr. and Mrs.Srivastava. Having not done so on<br \/>\nAT-18052009-21.doc<br \/>\n<span class=\"hidden_text\">                                                               Page 2 of 3<\/span><br \/>\n technical grounds of the parents being third-parties to an information<br \/>\nrequested by their own son, respondents could at least have initiated<br \/>\nproceedings under Section 11(1) of the Act to obtain the consent of the<br \/>\nthird-parties. Their inability to do so remains unexplained.\n<\/p>\n<p>11. Respondents cannot claim the information to be both relating to a<br \/>\nthird-party and the respondents&#8217; own commercial confidence. If the<br \/>\ninformation is exclusively of the third-party, there is very little chance<br \/>\nthat it will also be commercially critical to the respondents. It is not<br \/>\nfor the respondents again to decide whether the information is personal<br \/>\nto the third-party without even consulting that third-party.\n<\/p>\n<p>12.   In view of the above, the following directives are issued:-\n<\/p>\n<blockquote><p>      (i)     Respondents     are  directed to   ascertain  whether<br \/>\n              Mr.S.K.Srivastava was a member of the group of LIC<br \/>\n              employees in whose name the Mediclaim policy was taken<br \/>\n              out.\n<\/p><\/blockquote>\n<blockquote><p>      (ii)    Respondents will then start proceedings under Section 11(1)<br \/>\n              of the RTI Act to consult the third-party about disclosure of<br \/>\n              information.\n<\/p><\/blockquote>\n<blockquote><p>      (iii)   If the third-party expresses its concurrence to the<br \/>\n              disclosure of information to the appellant, respondents<br \/>\n              shall take appropriate action under the RTI Act to process<br \/>\n              the information.\n<\/p><\/blockquote>\n<blockquote><p>      (iv)    This will be finalized within two weeks of the receipt of this<br \/>\n              order by the respondents.\n<\/p><\/blockquote>\n<p>13.
