DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 06\/04\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tHeard<br \/>\nMr R J Goswami, learned Advocate for the petitioners.\n<\/p>\n<p>2.\t\tMr<br \/>\nGoswami, learned Advocate for the petitioners submits that  the<br \/>\naverments made in the complaint are of general nature and vague.  The<br \/>\npetitioners do not reside with the complainant.  Besides, the<br \/>\ncomplainant was taken for check up for mental ailments and has<br \/>\nundergone treatment for such ailments with psychatrist and,<br \/>\ntherefore, the impugned  complaint is nothing but an abuse of process<br \/>\nof  law and, therefore, the complaint deserves to be quashed and set<br \/>\naside.\n<\/p>\n<p>3.\t\tConsidering<br \/>\nthe above, prima facie, the allegations are vague and of<br \/>\ngeneral nature.  On perusal of medical papers, it transpires that the<br \/>\ncomplainant has undergone treatment for being unsound mind  and due<br \/>\nto erratic behaviour of complainant-wife all the petitioners have<br \/>\nsuffered mental agony and once she had thrown her own child from the<br \/>\nfirst floor and, therefore, the complaint deserves to be stayed.<br \/>\nHence,<\/p>\n<p>4.\t\tRULE.\n<\/p>\n<p> Ad-interim relief in terms of para  11 (b) till final disposal of<br \/>\nthe matter.
