SANKARAN, J.\n\n             ---------------------------------\n\n                   M.A.C.A.NO. 816 OF 2004\n\n          ---------------------------------\n\n        Dated this the 12th day of December,2006\n\n\n\n                            JUDGMENT\n<\/pre>\n<p>     The petitioner in O.P.(MV) No.2616 of 1998, on the<\/p>\n<p>file   of   the   Motor   Accidents   Claims   Tribunal,   Kottayam<\/p>\n<p>is the appellant in this appeal.  The appellant claimed<\/p>\n<p>a   sum   of   Rs.52,150\/-   as   compensation,   but   it   was<\/p>\n<p>limited   to   Rs.25,000\/-.               On   22.2.1998,   while   the<\/p>\n<p>appellant   was   travelling   in   an   autorickshaw,   owned   by<\/p>\n<p>one   Anil   Kumar   and   driven   by   Simon,   the   autorickshaw<\/p>\n<p>capsized   and   the   appellant   sustained   injuries.     It   is<\/p>\n<p>stated   in   the   claim   petition   that   the   appellant   was<\/p>\n<p>taken   to   Government   Hospital,   Kanjirappally   and   was<\/p>\n<p>later   referred   to   the   Medical   College   Hospital,<\/p>\n<p>Kottayam.     He   was   referred   back   to   the   Government<\/p>\n<p>Hospital,         Kanjirappally         and         was         discharged         on<\/p>\n<p>15.3.1998.     It   is   also   submitted   that   he   underwent<\/p>\n<p>outpatient   treatment  for  two  more  months.    The  further<\/p>\n<p>case   of   the   appellant   is   that   he   is   permanently<\/p>\n<p>disabled   and   it   has   affected   his   earning   power   and<\/p>\n<p>amenities of life.\n<\/p>\n<p>M.A.C.A. NO. 816 OF 2004<\/p>\n<p>                                     ::  2  ::\n<\/p>\n<p>      2.     Before   the   Tribunal,   four   cases   were   tried<\/p>\n<p>together,   including   the   one   filed   by   the   appellant.\n<\/p>\n<p>Exts.A8, A9 and A10 were the documents produced by the<\/p>\n<p>appellant herein.   No oral evidence was adduced by any<\/p>\n<p>of   the   claimants.       It   is   submitted   by   the   learned<\/p>\n<p>counsel   for   the   appellant   that   the   practice   that   was<\/p>\n<p>being followed by the Tribunal was that the case would<\/p>\n<p>be   disposed   of   on   the   basis   of   the   pleadings   and<\/p>\n<p>documentary   evidence.       Though   I   am   not   pronouncing<\/p>\n<p>upon   this   contention,   the   fact   remains   that   the<\/p>\n<p>discussion   in   respect   of   the   appellant&#8217;s   case   is<\/p>\n<p>contained   only   in   paragraph   10   of   the   Award   wherein<\/p>\n<p>there   is   no   consideration   of   the   case   put   forward   by<\/p>\n<p>the   appellant   in   a   proper   manner.     It   is   just   stated<\/p>\n<p>that   none   of   the   petitioners   produced   any   document   to<\/p>\n<p>show   the   expenses   of   treatment   and   the   claimants   in<\/p>\n<p>three   cases   were   allowed   a   total   compensation   of<\/p>\n<p>Rs.4,000\/-   each.                 On   what   basis   the   amount   of<\/p>\n<p>compensation   was   arrived   at   and   fixed   is   not   seen   in<\/p>\n<p>the   award.     There   is   no   discussion   at   all   as   to   the<\/p>\n<p>M.A.C.A. NO. 816 OF 2004<\/p>\n<p>                                   ::  3  ::\n<\/p>\n<p>various   claims   under   different   heads   made   by   the<\/p>\n<p>appellant.  The wound certificate or the injuries noted<\/p>\n<p>therein   are   not   referred   to.     The   award   passed   by   the<\/p>\n<p>Tribunal is, therefore, liable to be set aside and I do<\/p>\n<p>so.   The matter is remanded to the Claims Tribunal for<\/p>\n<p>disposal   afresh   after   affording   an   opportunity   to   both<\/p>\n<p>parties   to   produce   documents   and   to   adduce   evidence.\n<\/p>\n<p>The   Tribunal   shall   consider   the   different   claims   put<\/p>\n<p>forward by the appellant and dispose of the same after<\/p>\n<p>considering   the   documentary   and   oral   evidence,   if   any,<\/p>\n<p>in the case.\n<\/p>\n<p>            The   parties   shall   appear   before   the   Tribunal   on<\/p>\n<p>15.1.2007.\n<\/p>\n<p>                                                     (K.T.SANKARAN)<\/p>\n<p>                                                            Judge<\/p>\n<p>ahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court K.J.Baby vs M.V.Anil Kumar on 12 December, 2006 IN THE HIGH COURT OF KERALA AT ERNAKULAM MACA No. 816 of 2004() 1.
