PRAKASH TATIA, J.\n<\/pre>\n<p>Mr.Manish Shishodia, for the appellant.<br \/>\nMs. Aruna Negi, for the respondent.\n<\/p>\n<p>     Heard learned counsel for the parties.\n<\/p>\n<p>     The appellant- wife is aggrieved against the divorce<\/p>\n<p>decree granted by the trial court vide judgment and decree<\/p>\n<p>dated 19th March, 2004 in a case where the marriage was<\/p>\n<p>solemnized on 9th May, 1984 and as per the finding of the<\/p>\n<p>trial court, the appellant and respondent are living separate<\/p>\n<p>since 1997.\n<\/p>\n<p>     The decree for divorce was granted on the ground of<\/p>\n<p>cruelty and desertion.   While deciding the prayer of the<\/p>\n<p>appellant under Section 25 of the Hindu Marriage Act, the<\/p>\n<p>maintenance for the appellant was denied by the trial court.<\/p>\n<p>However, the trial court granted maintenance for Rs.750\/-<\/p>\n<p>per month for each of the child till the children attain the<br \/>\n                                                        SBCMA No.565\/2004<br \/>\n                                         Smt. Meenakshi Vs. Sukhdev Dwivedi<\/p>\n<p><span class=\"hidden_text\">                                     2<\/span><br \/>\nage of majority.\n<\/p>\n<p>        Learned     counsel    for       the    appellant    vehemently<\/p>\n<p>submitted that as per the facts pleaded by the respondent-<\/p>\n<p>husband himself it is clear that he himself created the<\/p>\n<p>situation wherein the appellant had to leave the house of<\/p>\n<p>the respondent.       The respondent pleaded in the divorce<\/p>\n<p>petition itself that situation created reached to the extent<\/p>\n<p>that the applicant-husband may commit suicide. In view of<\/p>\n<p>the above pleading of the respondent it is clear that the<\/p>\n<p>respondent himself was responsible for all wrong.                     The<\/p>\n<p>appellant was severely tortured and appellant had to lodged<\/p>\n<p>a criminal case under Section 498A IPC.\n<\/p>\n<p>        According to learned counsel for the appellant, the<\/p>\n<p>appellant is yet ready to go and live with the respondent.<\/p>\n<p>In the alternative, it is prayed that the decree may be<\/p>\n<p>passed in favour of the appellant for maintenance amount<\/p>\n<p>as well as for the marriage expenses for appellant and<\/p>\n<p>respondent&#8217;s children.\n<\/p>\n<p>        Learned counsel for the respondent submitted that<\/p>\n<p>false    criminal    case     was    got       registered   against    the<br \/>\n                                                SBCMA No.565\/2004<br \/>\n                                 Smt. Meenakshi Vs. Sukhdev Dwivedi<\/p>\n<p><span class=\"hidden_text\">                             3<\/span><br \/>\nrespondent by the appellant wherein respondent has been<\/p>\n<p>acquitted. Learned counsel for the respondent vehemently<\/p>\n<p>submitted that in a case of marriage of 1984 and appellant<\/p>\n<p>and respondent not living together since 1997, the decree<\/p>\n<p>was passed in the year 2004 and in case, the decree will be<\/p>\n<p>reversed then no useful purpose can be served as the<\/p>\n<p>appellant and respondent cannot live together.         It is also<\/p>\n<p>submitted that from the evidence it is fully proved that it<\/p>\n<p>was a case of grave cruelty by the appellant against the<\/p>\n<p>respondent.   It is also submitted that appellant herself is<\/p>\n<p>self-dependent and is maintaining herself and appellant<\/p>\n<p>cannot claim any maintain for herself. It is also submitted<\/p>\n<p>that at the time of marriage of the children whatever the<\/p>\n<p>respondent can do he will do and for that no order be<\/p>\n<p>passed at this stage.\n<\/p>\n<p>     I considered the submissions of learned counsel for<\/p>\n<p>the parties and perused the record.         There are serious<\/p>\n<p>allegations levelled by the respondent against the appellant-<\/p>\n<p>wife. In the divorce petition in support of his plea, he gave<\/p>\n<p>his statement in detail narrating the facts by which<br \/>\n                                                SBCMA No.565\/2004<br \/>\n                                 Smt. Sukhdev Dwivedi<\/p>\n<p><span class=\"hidden_text\">                             4<\/span><br \/>\naccording to him he was cruelly treated by the appellant.<\/p>\n<p>The   respondent   was   thoroughly      cross-examined       and<\/p>\n<p>respondent also produced witness PW-2 Dhanji, who was<\/p>\n<p>neighour of the respondent. In rebuttal the appellant gave<\/p>\n<p>her statement in the court and in cross-examination, the<\/p>\n<p>appellant clearly admitted that since April, 1997 appellant<\/p>\n<p>and respondent both are living separately and she also<\/p>\n<p>admitted that she joined the service in the Cooperative<\/p>\n<p>Bank. She served there for 5 years. However, she denied<\/p>\n<p>allegation of cruelty, but in cross-examination, she admitted<\/p>\n<p>that because of the dispute between the appellant and<\/p>\n<p>respondent the persons of their community were called<\/p>\n<p>wherein she and her father also appeared wherein Ex.2 was<\/p>\n<p>written which bears the signature of the appellant and her<\/p>\n<p>husband.    She admitted her signature on Ex.3 also.<\/p>\n<p>However, she stated that those signatures were obtained by<\/p>\n<p>her husband forcibly. It is also admitted case of the<\/p>\n<p>appellant that thereafter, she joined service as para teacher<\/p>\n<p>and was getting salary of Rs.1200\/- per month. The<\/p>\n<p>appellant&#8217;s father Manohar Lal appeared as NAW-2. Sukhdev Dwivedi<\/p>\n<p><span class=\"hidden_text\">                               5<\/span><br \/>\nadmitted that appellant and respondent are living separate.<\/p>\n<p>However, he stated that the appellant was thrown out and<\/p>\n<p>before that she was tortured. He also admitted holding of<\/p>\n<p>meeting of the members of the community because of the<\/p>\n<p>dispute between the appellant and respondent. In fact, from<\/p>\n<p>evidence, it appears that the respondent&#8217;s allegation of<\/p>\n<p>cruelty levelled in his statement have not been rebutted<\/p>\n<p>except the vague denial by the appellant and her father.<\/p>\n<p>     In view of the above detail reasons given by the trial<\/p>\n<p>court for holding the appellant guilty for committing cruelty<\/p>\n<p>upon respondent appears to be just and based on sufficient<\/p>\n<p>evidence.   The appellant failed to show just cause for her<\/p>\n<p>living separate from the respondent and, therefore, ground<\/p>\n<p>of divorce due to desertion is also fully established.<\/p>\n<p>     In view of the above, I do not find any illegality in the<\/p>\n<p>impugned judgment and decree so far as decree for divorce<\/p>\n<p>is concerned.\n<\/p>\n<p>     The trial court also considered the evidence of both<\/p>\n<p>the parties and found that respondent was getting salary of<\/p>\n<p>Rs.3555\/- whereas the appellant was getting salary of<br \/>\n                                                   SBCMA No.565\/2004<br \/>\n                                    Smt. Meenakshi Vs. Sukhdev Dwivedi<\/p>\n<p><span class=\"hidden_text\">                                6<\/span><br \/>\nRs.2400\/-.    The   appellant   was      not    entitled    to   any<\/p>\n<p>maintenance in the facts of the case as she was self-<\/p>\n<p>dependent. She had income almost equal to the income of<\/p>\n<p>the husband but yet she has been awarded maintenance for<\/p>\n<p>her children @ Rs.750\/- per month amounting to Rs.1500\/-<\/p>\n<p>per month then in that situation, the sufficient maintenance<\/p>\n<p>has been awarded for maintaining the children.              In case<\/p>\n<p>appellant contacted marriage of children then at that time,<\/p>\n<p>the respondent undertake to contribute as per his own<\/p>\n<p>means then I do not find that the appellant can be granted<\/p>\n<p>more benefit then awarded by the trial court.<\/p>\n<p>     There in no merit in this appeal and the same is<\/p>\n<p>hereby dismissed.\n<\/p>\n<p>                                         (PRAKASH TATIA), J.\n<\/p>\n<p>c.p.goyal\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court &#8211; Jodhpur Smt.
