Sinha, J.\n<\/p>\n<p>1.\tLeave granted.\n<\/p>\n<p>2.\tThis appeal is directed against the orders dated 24.10.2005 and dated<br \/>\n1.12.2005 passed by the High Court of Kanataka at Bangalore whereby and<br \/>\nwhereunder delay of 2487 days in filing the appeal has been condoned and<br \/>\nthe said appeal has been allowed.\n<\/p>\n<p>3.\tThe basic fact of the matter is not in dispute.<br \/>\nThe brother of Madwaramanachar, father of the appellant, was<br \/>\nadmitted to S.D.S. TB Hospital at Bangalore.  All the articles from the body<br \/>\nof his brother were removed by the father of the appellant.  After his death,<br \/>\nthe father of the appellant requested the hospital authorities to hand over the<br \/>\nobsquecies seized wherefor a written request was made on 9.6.1981.<br \/>\nThe Superintendent of the said hospital passed an order that the<br \/>\narticles kept by the father of the appellants must be delivered back to the<br \/>\nhospital authorities for being kept in a safe custody so as to enable them to<br \/>\ndeliver the same to the persons entitled therefor.  Delivery of the articles was<br \/>\ninsisted before handing over the dead body.  The said articles were handed<br \/>\nover to the hospital authorities wherefor an acknowledgment was issued.\n<\/p>\n<p>4.\tAn application for grant of succession certificate was filed by the<br \/>\nfather of the appellants on 24.8.1981.  In the said proceedings, one<br \/>\nGowramma, wife of the deceased, was impleaded as a party.  She expired<br \/>\nduring the pendency of the said proceedings.  She, allegedly left behind one<br \/>\nS. Basavarajappa, who is said to be her adopted son.  By an order dated<br \/>\n5.7.1991, succession certificate was granted in favour of the appellant in<br \/>\nrespect of the following :\n<\/p>\n<p>1.<br \/>\nAmount in vijay Bank Togarsi<br \/>\nS.B. Account No.309 with<br \/>\ninterest<br \/>\nRs.5-00\n<\/p>\n<p>2.<br \/>\nAmount in Syndicate Bank,<br \/>\nShimoga S.B. Account No.27717<br \/>\nLedger Folio No.30 with interest<br \/>\nRs.318-65\n<\/p>\n<p>3.<br \/>\nAmount in syndicate Bank,<br \/>\nShimoga Koppa, S.B. Account<br \/>\nNo.7\/89 folio 4289\/17 with<br \/>\ninterest<br \/>\nRs.19379-59<br \/>\nGold Articles belonging to deceased in deposit in<br \/>\nthe Hospital at Bangalore.\n<\/p>\n<p>\t\t\t\t\tGram\t\tMgs<br \/>\nOne Sudarshan ring\t11\t&#8211;\t700<br \/>\nOne Ring with red Stones\t  5\t&#8211;\t300<br \/>\nOne Finb sing shigd stones\t  6\t&#8211;\t600<br \/>\nOne Bar\t46\t&#8211;\t800<br \/>\n\t39\t&#8211;\t450<br \/>\nCash\t160\t&#8211;\t  00\t<\/p>\n<p>5.\tDespite production of the said succession certificate, the hospital<br \/>\nauthorities did not return the said articles and documents to the appellant&#8217;s<br \/>\nfather, whereupon a suit in the court of Additional City Civil Judge,<br \/>\nBangalore seeking a direction to the hospital authorities-defendants to hand<br \/>\nover the articles to the appellants or in alternative pay the value thereof<br \/>\nwhich was assessed at Rs.45,000\/- was filed\n<\/p>\n<p>6.\tNo notice under Section 80 of the Code of Civil Procedure, however,<br \/>\nwas served upon the State.  An application under sub-section (2) of Section<br \/>\n80 of the Code was filed which is said to have been allowed.<br \/>\nBefore the learned Trial Judge, no written statement was filed by the<br \/>\nState.  It was decreed ex parte on decree was passed on 31.10.1997.\n<\/p>\n<p>7.\tAn execution case was filed in the year 2003 for execution of the said<br \/>\ndecree.  Upon receipt of the summons from the executing court, a first<br \/>\nappeal was preferred by the State of Karnataka.  As indicated hereinbefore,<br \/>\nthe same was barred by 2487 days.\n<\/p>\n<p>An application for condonation of delay was filed in the said appeal<br \/>\nbeing IA No.1 of 2005 which, by reason of a judgment dated 24.10.2005<br \/>\nwas allowed.  The High Court by reason of its judgment dated 1.12.2005<br \/>\npointed out various deficiencies in the said decree and opined that the<br \/>\njudgment and decree passed by the learned Trial Judge was not sustainable<br \/>\nin law, stating :\n<\/p>\n<p>(i)\tNo urgency was shown for filing the suit in terms of sub-section (2) of<br \/>\nSection 80 of the Code of Civil Procedure;\n<\/p>\n<p>(ii)\tSmt. Gowramma was a necessary party in the suit; and\n<\/p>\n<p>(iii)\tThe value of the articles was not mentioned in the succession<br \/>\ncertificate. There was nothing to show that the plaintiff was the only<br \/>\nheir of the deceased.\n<\/p>\n<p>It was directed :\n<\/p>\n<p>&#8220;The appeal is allowed an the impugned judgment<br \/>\nand decree dated 31.10.1997 made in O.S.\n<\/p>\n<p>No.3830\/1994 on the file of II Additional City<br \/>\nCivil Judge at Bangalore City, is set aside and the<br \/>\nmatter is remitted back to the Trial Court, with a<br \/>\ndirection to the parties to appear before the Trial<br \/>\nCourt for further proceedings on 23.12.2005,<br \/>\nwithout notice.  Further, the Trial Court is directed<br \/>\nto afford an opportunity to the defendants to file<br \/>\nthe written statement within 30 days from<br \/>\n23.12.205 and dispose of the suit in accordance<br \/>\nwith law.&#8221;\n<\/p>\n<p>8.\tMs. Kiran Suri, learned counsel appearing on behalf of the appellant,<br \/>\nwould submit that the High Court committed a serious error in condoing the<br \/>\ndelay of 2487 days in preferring the appeal by the State.  It was furthermore<br \/>\nurged that the appellant has failed to prove any cause far less any sufficient<br \/>\ncause therefor.  The learned counsel contended that the High Court should<br \/>\nnot have remitted the matter back to the trial court keeping in view the fact<br \/>\nthat the short question which arose for its consideration was as to whether<br \/>\nthe hospital authorities having asked the appellants&#8217; father to obtain a<br \/>\nsuccession certificate was bound to return the articles to him him on<br \/>\nproduction thereof.\n<\/p>\n<p>9.\tMr. Hegde, learned counsel appearing on behalf of the respondents,<br \/>\nhowever, supported the impugned judgment.\n<\/p>\n<p>10.\tOne Gowramma, as noticed hereinbefore, was impleaded as a party in<br \/>\nthe proceedings for grant of succession certificate.  She claimed herself to be<br \/>\nthe wife of the deceased.  Appellant knew that the hospital authorities had<br \/>\nhanded over the documents and goods to her.  She was, therefore, a<br \/>\nnecessary party.  As she expired during the pendency of the proceedings, her<br \/>\nheirs and legal representatives should have been impleaded as parties in the<br \/>\nsaid proceedings.\n<\/p>\n<p>The decree might have been passed ex parte but when the same has<br \/>\nbeen brought to the notice of this Court, in our opinion, in exercise of our<br \/>\ndiscretionary jurisdiction under Article 136 of the Constitution of India, we<br \/>\nshould not interfere therein.\n<\/p>\n<p>It is now a well settled principle of law that this Court would not<br \/>\nexercise its extraordinary jurisdiction only because it is lawful to do so.  <a href=\"\/doc\/77516\/\">(See<br \/>\nM\/s. Tanna &amp; Modi v. C.I.T. Mumbai XXV &amp; Ors.<\/a> [2007 (8) SCALE 511]<br \/>\nThis Court has the power to pass necessary orders for doing complete justice<br \/>\nto the parties.  The High Court, in our opinion, has rightly held that in the<br \/>\naforementioned situation, Gowramma was a necessary party.<br \/>\nA succession certificate is granted for a limited purpose.  A Court<br \/>\ngranting a succession certificate does not decide the question of title. A<br \/>\nnominee or holder of succession certificate has a duty to hand over the<br \/>\nproperty to the person who has a legal title thereto.<br \/>\nBy obtaining a succession certificate alone, a person does not become<br \/>\nthe owner of the property.\n<\/p>\n<p>11.\tIn Vidhyadhari &amp; Ors. v. Sukhrana Bai &amp; Ors. [(2008) 2 SCC 238],<br \/>\nthis Court held :\n<\/p>\n<p>&#8220;14. Therefore, though we agree with the High<br \/>\nCourt that Sukhrana Bai was the only legitimate<br \/>\nwife yet, we would choose to grant the certificate<br \/>\nin favour of Vidhyadhari who was his nominee and<br \/>\nthe mother of his four children.  However, we must<br \/>\nbalance the equities as Sukhrana Bai is also one of<br \/>\nthe legal heirs and besides the four children she<br \/>\nwould have the equal share in Sheetaldeen&#8217;s estate<br \/>\nwhich would be 1\/5th.  To balance the equities, we<br \/>\nwould, therefore, choose to grant succession<br \/>\ncertificate to Vidhyadhari but with a rider that she<br \/>\nwould protect the 1\/5th share of Sukhrana Bai in<br \/>\nSheetaldeen&#8217;s properties and would hand over the<br \/>\nsame to her.  As the nominee she would hold the<br \/>\n1\/5th share of Sukhrana Bai in trust and would be<br \/>\nresponsible to pay the same to Sukhrana Bai.  We<br \/>\ndirect that for this purpose she would give a<br \/>\nsecurity in the trial court to the satisfaction of the<br \/>\ntrial court.&#8221;\n<\/p>\n<p>(Emphasis added)<\/p>\n<p>12.\tIt may be true that there was enormous delay in filing the appeal.<br \/>\nOrdinarily, this Court would not have condoned the said delay in filing the<br \/>\nappeal but in this case, the First Appeal filed by the State has also been<br \/>\nallowed by the High Court.\n<\/p>\n<p>Keeping in view the nature of the order passed by the High Court, we<br \/>\nare of the opinion that it is not a fit case where we should interfere with the<br \/>\njudgment of the High Court dated 24.10.2005 which will have the effect of<br \/>\nsetting aside its order dated 1.12.2005 also.  We, however, are of the opinion<br \/>\nthat the State must pay a sum of Rs.10,000\/- by way of costs to the<br \/>\nappellant.  We further direct that Basavarajappa should be impleaded as a<br \/>\nparty in the suit.  It will also be open to the appellant to pray for such other<br \/>\nrelief or reliefs in the suit as she may be advised in the matter.\n<\/p>\n<p>13.\tThe appeal is dismissed with the aforementioned directions.  In the<br \/>\nfacts and circumstances of the case, however, there shall be no order as to<br \/>\ncosts.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India C.K.
