Jani, learned APP waives service of Rule on behalf of the<br \/>\nopponent-State.\n<\/p>\n<p>2.\tThis<br \/>\napplication has been preferred by the applicant under Section 439 of<br \/>\nthe Code of Criminal Procedure, 1973 in connection with the offence<br \/>\nbeing CR No.I-20\/2010 registered with Anand Railway Police Station,<br \/>\nfor the offences punishable under sections 326, 120-B and 114 of the<br \/>\nIndian Penal Code [&#8220;IPC&#8221; for short].\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate Mr. R.N. Singh for the applicant submitted that the<br \/>\napplicant is an innocent person and false case is foisted on him.<br \/>\nConsidering the role attributed to the applicant  as reflected in the<br \/>\nFIR at Annexure:A to the application,  the applicant may be enlarged<br \/>\non bail.\n<\/p>\n<p>4.\tLearned<br \/>\nAPP Mr. H.L. Jani, representing the opponent State, while opposing<br \/>\nthe bail application, submitted that the applicant is involved in the<br \/>\noffence punishable under Sections 326,<br \/>\n120-B and 114 of the IPC. Considering the role attributed to<br \/>\nthe applicant which is reflected in the FIR at Annexure:A to the<br \/>\napplication and the manner in which the offence is committed by the<br \/>\napplicant, no discretionary relief be granted to the applicant and<br \/>\nthe application may be dismissed.\n<\/p>\n<p>5.\tI<br \/>\nhave heard the learned advocates of both the sides at length and in<br \/>\ngreat detail. Considering the rival submissions and on perusal of the<br \/>\naverments made in the application, role attributed to the applicant<br \/>\nwhich is reflected in the FIR at Annexure:A to the application,<br \/>\nprovisions of Sections 326, 120-B and<br \/>\n114 of the IPC, quantum of punishment etc.,  I am of the view<br \/>\nthat the applicant deserves to be enlarged on bail without discussing<br \/>\nthe evidence in detail.\n<\/p>\n<p>6.\tConsidering<br \/>\nthe above, this application is allowed. The applicant is ordered to<br \/>\nbe released on bail in connection with CR No.I-20\/2010 registered<br \/>\nwith Anand Railway Police Station, for the offence alleged against<br \/>\nhim in this application on his executing a Bond of Rs.10,000\/-<br \/>\n(Rupees ten thousand only) with one solvent surety of the like amount<br \/>\nto the satisfaction of the trial Court and subject to the conditions<br \/>\nthat he shall-\n<\/p>\n<p>a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>b)\tnot<br \/>\nto try to tamper or pressurise the prosecution witnesses or<br \/>\ncomplainant in any manner;\n<\/p>\n<p>c)\tmaintain<br \/>\nlaw and order and should cooperate the Investigating Officer;\n<\/p>\n<p>d)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>e)\tmark<br \/>\npresence at the concerned police station on the last day of every<br \/>\nEnglish calendar month.\n<\/p>\n<p>f)\tnot<br \/>\nleave the country without the prior permission of the concerned<br \/>\nSessions Judge;\n<\/p>\n<p>g)\tfurnish<br \/>\nthe address of his residence to the I.O. and also to the Court at the<br \/>\ntime of execution of the bond and shall not change the residence<br \/>\nwithout prior permission of this Court;\n<\/p>\n<p>h)\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week.\n<\/p>\n<p>7.\tIf<br \/>\nbreach of any of the above conditions is committed, the concerned<br \/>\nSessions Judge will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>8.\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case. It would<br \/>\nbe open to the trial Court concerned to give time to furnish the<br \/>\nsolvency certificate if prayed for.\n<\/p>\n<p>9.\tRule<br \/>\nis made absolute.
