\n\tRule. Mr.Dabhi learned APP waives service of notice of rule
\nfor respondent-State.\n<\/p>\n
2.\tThis
\napplication seeking regular bail under Section 439 of the Code of
\nCriminal Procedure, 1973 has been preferred by applicant in
\nconnection with the offence registered with Pradyumannagar Police
\nStation, Dist: Rajkot bearing CR No.I-342 of 2010 for the
\noffence punishable under Sections 307, 147, 148, 149, 323, 504, 188,
\n143 and 304 of the Indian Penal Code.\n<\/p>\n

\n\tHeard learned counsel for both the sides. Ms.Subhadra Patel, learned
\nadvocate for the applicant, inter alia, submitted that the applicant
\nhas been falsely involved in this case. She further submitted that
\nall the injured persons including the complainant are released from
\nthe hospital after short treatment of two or three days upon full
\nrecovery. She submitted that there is no serious injury sustained by
\nthe accused.  She further stated that against the petitioner, there
\nare no criminal antecedents.\n<\/p>\n
4.\tOn
\nthe other hand, Mr.Dabhi, learned APP, has opposed the submission of
\nthe applicant on the ground that the applicant has committed serious
\noffence and the incident is not in dispute. He has requested that
\npresent application may not be entertained.\n<\/p>\n
5.\tHaving
\nheard the learned counsel for both the sides and considering the
\nfacts and circumstances of the case as well as the documents and
\nother material produced on record of this case, the gravity of the
\noffence, the quantum of punishment, the allegations against the
\napplicant, the manner in which the applicant is allegedly involved in
\nthe case as per the allegation of the prosecution, coupled with the
\nfact that the investigation is over and charge-sheet is filed and it
\nhas come out from the submission that the co-accused persons have
\nbeen released by order dated 29.04.2011 in Criminal Misc. Application
\nNo.5133 of 2011 and also the fact that there is no antecedent of
\npresent applicant, the prosecution has not voiced any grievance or
\nexpressed any apprehension that he is likely to flee from justice, if
\nthe applicant is released on bail, I am inclined to allow this
\napplication and release the applicant.\n<\/p>\n

\n\tHence,
\nthis application is allowed and it is directed that in the event of
\nthe arrest of the abovenamed applicant in connection with CR No.I-342
\n of 2010 registered with Pradyumannagar Police Station, District
\nRajkot, he shall be released on bail, in respect of the offences
\nalleged against him in this application, on his executing and
\nfurnishing a bond of Rs.5,000\/- (Rupees: Five Thousand Only) with one
\nsolvent surety of like amount, by the concerned Police Officer, and
\non condition that he shall:-\n<\/p>\n
\t(a)
\nnot take undue advantage of or abuse the liberty.\n<\/p>\n
(b)
\nnot act in manner injurious to the interest of the prosecution.\n<\/p>\n
(c)
\nmaintain law and order.\n<\/p>\n
(d)
\nnot leave the State of Gujarat without prior permission of the
\nSessions Court concerned.\n<\/p>\n
(e)
\nfurnish the address of his residence at the time of execution of bond
\nand shall not change the residence without prior permission of the
\nSessions Court\/this Court.\n<\/p>\n
(f)
\nsurrender his passport, if any, to the lower court within 4 days from
\nthe date of this order.\n<\/p>\n
(g)
\nmark his presence at the Pradyumannagar
\nPolice Station,
\nDist: Rajkot
\ninitially
\non 6th
\nMay, 2011 and
\nthereafter on every first day of every month,
\nbetween
\n11.00 a.m. to 3.00 p.m.<\/p>\n
(h)
\nnot enter the revenue limit of Rajkot District till the trial is over
\nwithout prior permission of the Sessions Court, but for marking his
\npresence and attending the Court in connection with this case the
\napplicant will be free to enter the limits for a period to the extent
\nnecessary and will leave the limits of Rajkot District immediately
\nafter the case is adjourned.\n<\/p>\n
(i)
\nnot enter the area of Pradyumannagar Police Station till the framing
\nof charge.\n<\/p>\n
7.\tThe
\nauthorities will release the applicant only if he is not required in
\nany other offence for the time being.\n<\/p>\n
8.\tIf
\nbreach of any of the above conditions is committed the Sessions Judge
\nconcerned will be free to issue warrant or take any appropriate
\naction in the matter.\n<\/p>\n
9.\tBail-bond
\nbefore the lower Court having jurisdiction to try the case.\n<\/p>\n
10.\tAt
\nthe trial, the trial Court shall not be influenced by the
\nobservations, which are purely prima facie, tentative and preliminary
\nnature and have been made only for the purpose of examining prayer
\nfor bail pending the trial. The Court shall arrive at its own
\nconclusion independently on the basis of the evidence and other
\naspects of the case.\n<\/p>\n
11.\tRule
\nis made absolute to the aforesaid extent. Direct service is
\npermitted.\n<\/p>\n
