Justice P.BHAVADASAN\n\n Dated :11\/02\/2010\n\n O R D E R\n                     P.BHAVADASAN, J.\n                 ---------------------------------\n                 Crl.M.C.No.406 OF 2010\n                 ----------------------------------\n        Dated this the 11th day of February, 2010\n\n                           O R D E R\n<\/pre>\n<p>                          ~~~~~~~<\/p>\n<p>      This is a petition filed under Section 482 of the Code<\/p>\n<p>of Criminal Procedure, seeking a modification of the<\/p>\n<p>condition imposed while granting bail to the petitioner.<\/p>\n<p>            2. The petitioner is the 3rd accused in Crime No.<\/p>\n<p>381\/2009 Nadapuram Police Station is alleged to have<\/p>\n<p>committed      offences       punishable        under  Sections<\/p>\n<p>143,147,148, 353      read with Section 149 of the Indian<\/p>\n<p>Penal Code and Sections 3 and 5 of the Explosive<\/p>\n<p>Substance Act and 3(10 of Prevention of Destruction of<\/p>\n<p>Public Property Act (PDPP Act).        Petitioner claims that he<\/p>\n<p>is falsely implicated. He had come home from the place of<\/p>\n<p>employment on 1.10.2009 and the incident took place on<\/p>\n<p>12.10.2009. He had no role to play in the incident and the<\/p>\n<p>allegation against him is totally false.<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.406\/2010                 2<\/span><\/p>\n<p>      3.    Whatever that be, the bail application was<\/p>\n<p>entertained by the court below and by order dated<\/p>\n<p>23.10.2009 bail was granted subject to the following<\/p>\n<p>conditions:\n<\/p>\n<blockquote><p>            &#8220;1.    The learned Magistrate is directed to<br \/>\n            release the petitioners on bail if they<br \/>\n            furnishes bond for Rs.25,000\/- each with two<br \/>\n            solvent sureties for the like amount to the<br \/>\n            satisfaction of the court below.<\/p>\n<\/blockquote>\n<blockquote><p>            2.     Petitioners  should   surrender   their<br \/>\n            passport or file affidavit.\n<\/p><\/blockquote>\n<blockquote><p>            3.     Petitioners should report before the<br \/>\n            Investigating Officer as and when required by<br \/>\n            the Investigating Officer in writing.<\/p>\n<\/blockquote>\n<blockquote><p>            4.     Petitioners should not enter into the<br \/>\n            limits of Nadapuram Police Station Circle<br \/>\n            Office without the previous permission of the<br \/>\n            court, except for reporting before the<br \/>\n            Investigating Officer.\n<\/p><\/blockquote>\n<blockquote><p>            5.     Petitioners  should   not   leave  the<br \/>\n            jurisdiction of Kozhikode District without the<br \/>\n            previous permission of the court below.<\/p>\n<\/blockquote>\n<blockquote><p>            6.     Petitioner should   not  tamper   with<br \/>\n            evidence or interfere in the investigation of<br \/>\n            the case.\n<\/p><\/blockquote>\n<blockquote><p><span class=\"hidden_text\">Crl.M.C.No.406\/2010                 3<\/span><\/p>\n<\/blockquote>\n<blockquote><p>            7.     Petitioner should not involve in any<br \/>\n            criminal case while on bail.&#8221;<\/p><\/blockquote>\n<p>      4.    Since the petitioner had to go back to the place<\/p>\n<p>of employment, he moved the Sessions Court for<\/p>\n<p>modification of the conditions. By the impugned order, the<\/p>\n<p>learned Sessions Judge dismissed the petition. Aggrieved<\/p>\n<p>by this, the petitioner comes up before this Court.<\/p>\n<p>      5.    It is pointed out by the learned counsel for the<\/p>\n<p>petitioner that the reason given by the Sessions Judge in<\/p>\n<p>dismissing the petition is unsustainable in law. There is no<\/p>\n<p>justification in directing the surrender of the passport and<\/p>\n<p>also observing that no documents have been produced<\/p>\n<p>showing that he is employed abroad.\n<\/p>\n<\/p>\n<p>      6.    The learned Public Prosecutor was also heard.<\/p>\n<p>      7.    Considering the facts and circumstances of the<\/p>\n<p>case, this Court felt that there is no justification in directing<\/p>\n<p>the surrender of passport of the petitioner and conditions can<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.406\/2010             4<\/span><\/p>\n<p>be imposed whereby his presence for trial can be ensured.<\/p>\n<p>Petition is allowed as follows:\n<\/p>\n<\/p>\n<blockquote><p>    1)Condition Nos. 1, 3, 6, 7 in the order dated<\/p>\n<p>       23.10.2009 shall remain as such.<\/p>\n<\/blockquote>\n<blockquote><p>    2)The petitioner shall give the address to which<\/p>\n<p>       communication shall be sent, to the court below<\/p>\n<p>       within two weeks from today.\n<\/p><\/blockquote>\n<blockquote><p>    3)The petitioner shall not tamper or attempt to tamper<\/p>\n<p>       with evidence or interfere in the investigation of the<\/p>\n<p>       case.\n<\/p><\/blockquote>\n<blockquote><p>    4)The petitioner shall leave Kozhikode District and the<\/p>\n<p>       State only with the previous sanction of the court<\/p>\n<p>       before which bond was executed.<\/p><\/blockquote>\n<p>                               (P.BHAVADASAN, JUDGE)<\/p>\n<p>ps<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Rasheed vs State Of Kerala on 11 February, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Crl.MC.No. 406 of 2010() 1.
