Pandya for the petitioner invited attention of<br \/>\nthe Court to the typed copy of deposition of the respondent &#8211;<br \/>\nworkman, which is produced at Pages 92 to 94.\n<\/p>\n<p>2.0\tThe<br \/>\npetitioner is before this Court being aggrieved by award and order<br \/>\ndated 31st December 2010, passed by the learned Judge of<br \/>\nLabour Court, Vadodara in Reference (LCV) No. 282 of 2001.\n<\/p>\n<p>2.1\tWhat<br \/>\nis required to be noted is, this is an award rendered after the<br \/>\nmatter was remanded by this Court by judgment and order dated 28th<br \/>\nApril 2010 in Special Civil Application No. 4189 of 2010.  Earlier<br \/>\naward and order passed in the same Reference i.e. Reference (LCV) No.<br \/>\n282 of 2001 dated 24th November 2009 was challenged before<br \/>\nthis Court and the Court remanded the matter with a direction that:\n<\/p>\n<p>&#8220;9.\n<\/p>\n<p> It is open to the petitioner to lead oral evidence to establish<br \/>\ninvolvement of respondent workman in a criminal case.  It is also<br \/>\nopen to the respondent to rebut the evidence before learned Labour<br \/>\nCourt, Vadodara.\n<\/p>\n<p>10.<br \/>\n It is made clear that the present order passed by this Court is<br \/>\nwithout expressing any opinion on merits and without prejudice to the<br \/>\nrights and contentions of the parties.&#8221;\n<\/p>\n<p>2.2\tEven<br \/>\nafter remand, the petitioner is not able to convince the learned<br \/>\nJudge to accept the Investigation Report from a private detective<br \/>\nproduced by the petitioner before the learned Judge of the Labour<br \/>\nCourt.\n<\/p>\n<p>2.3\tOn<br \/>\nperusal of the award and order, this Court finds that the learned<br \/>\nJudge has not committed any error in passing award of reinstatement<br \/>\nwith 40% back wages, because, the learned Judge has rightly held that<br \/>\nit cannot be believed that from the date of termination i.e. 3rd<br \/>\nOctober 2010, the respondent &#8211; workman would have remained<br \/>\ntotally unemployed.  At the same time, the petitioner is also not<br \/>\nable to produce and convince the learned Judge that he was gainfully<br \/>\nemployed and earning more than the amount paid by the present<br \/>\npetitioner.\n<\/p>\n<p>3.0\tIn<br \/>\nview of the above discussion, the petition, having found without any<br \/>\nsubstance, is dismissed.\n<\/p>\n<p>[<br \/>\nRavi R.
