Justice ANTONY DOMINIC\n\n Dated :07\/08\/2009\n\n O R D E R\n                    ANTONY DOMINIC,J.\n                ---------------------\n                W.P.(C).No.20774 OF 2009\n             ------------------------\n           Dated this the 7th day of August, 2009.\n\n                         JUDGMENT\n<\/pre>\n<p>     In this writ petition the prayer sought for is to quash<\/p>\n<p>Ext.P3. There is a further prayer to declare that Ext.P3 order<\/p>\n<p>is not in consonance with the requirements of the law for<\/p>\n<p>the purpose of exercising powers under Section 101 of the<\/p>\n<p>Kerala Co-operative Societies Act and therefore bad in law.<\/p>\n<p>     2.   Petitioner is a Co-operative Society registered<\/p>\n<p>under the provisions of the Co-operative Societies Act and<\/p>\n<p>having its area of operation spread over ward Nos.2 to 8<\/p>\n<p>and 10 to 14 of the Muthalamada Grama Panchayat. It is<\/p>\n<p>stated that based on Ext.P4 made by the 2nd respondent<\/p>\n<p>and others, by Ext.P1 the petitioner was directed to amend<\/p>\n<p>the bye laws excluding ward No.11 from its area of<\/p>\n<p>operation. That was contested in Ext.P2 reply submitted by<\/p>\n<p>the petitioner and subsequently Ext.P3 order was issued by<\/p>\n<p><span class=\"hidden_text\">WP(c).No.20774\/09                2<\/span><\/p>\n<p>the first respondent exercising its powers under Section 101<\/p>\n<p>of the Kerala Co-operative Societies Act exempting the<\/p>\n<p>proposed Chappakkad Ksheerolpadaka Sahakarana Sangham<\/p>\n<p>in ward No.11 of Muthalamada Panchayat from the provisions<\/p>\n<p>of clause(c) of Sub Section (1) of Section 7 of the Act. It is<\/p>\n<p>challenging Ext.P3 and with the prayers as stated aforesaid<\/p>\n<p>this writ petition is filed.\n<\/p>\n<p>      3. The question that arises for consideration is, whether<\/p>\n<p>by the incorporation of another society, within its area of<\/p>\n<p>operation,     can the petitioner society be said to be legally<\/p>\n<p>aggrieved, to maintain a writ petition.    A reading of the writ<\/p>\n<p>petition shows that by the incorporation of a new society, over<\/p>\n<p>the area of operation of the petitioner society is not affected<\/p>\n<p>nor is it affected in any other manner. In such circumstances,<\/p>\n<p>it cannot be said that the petitioner society is legally aggrieved<\/p>\n<p>to maintain a challenge against Ext.P3, which in effect permits<\/p>\n<p>incorporation of another society.\n<\/p>\n<p><span class=\"hidden_text\">WP(c).No.20774\/09                3<\/span><\/p>\n<p>      4. This very issue came up for consideration of this court<\/p>\n<p>in     <a href=\"\/doc\/1308691\/\">Kunju Kunju, President, Alleppy Co-operative Land<\/p>\n<p>Mortgage Bank Ltd. V. State of Kerala and Ors.<\/a>(1971 KLT 350),<\/p>\n<p>where it is held that since no legal rights of the petitioner<\/p>\n<p>therein can be said to have been affected by the grant of<\/p>\n<p>registration to another society, there was no obligation to the<\/p>\n<p>State Government to give notice or offer a hearing. It has been<\/p>\n<p>stated thus in paragraph 3 as follows;\n<\/p>\n<blockquote><p>              &#8220;It may be that at the time when the petitioner<br \/>\n              society was registered it has framed its bye laws<br \/>\n              by including the Taluk of Shertallai also within the<br \/>\n              area of its operation since at that time there was<br \/>\n              no similar society functioning in Shertallai. Neither<br \/>\n              by reason of the inclusion of any particular locality<br \/>\n              as part of the area of operation of a society in the<br \/>\n              relevant clause in its bye-laws nor on account of<br \/>\n              the approval of such bye-law by the competent<br \/>\n              authority under the Act can it be said that a vested<br \/>\n              right of monopolistic banking activity has accrued<br \/>\n              to a particular society, so as to precludefrom    the<br \/>\n              Registrar<br \/>\n              subsequently grantingState<br \/>\n                          or   the           Government<br \/>\n              society to operate in anyregistration said area. In<br \/>\n                                                      to another<br \/>\n              my view, no legal right ofpart society can be said<br \/>\n                                              of the<br \/>\n                                          the<br \/>\n              to have been affected by the grant of registration<br \/>\n              to another society to function in a locality which<br \/>\n              for the time being stands included within the area<br \/>\n              of operation of the former society. I find that I am<\/p>\n<p><span class=\"hidden_text\">WP(c).No.20774\/09                  4<\/span><\/p>\n<p>              supported in this view by the decision of Krishna<br \/>\n              Rao, J of the Andhra Pradesh High Court reported in The<br \/>\n              Bheeminipatnam Co-operative Land Mortgage Bank Ltd. V.<br \/>\n              The government of Andhra Pradesh(1967) 1 An. WR. 244,<br \/>\n              which has been subsequently affirmed on appeal<br \/>\n              by a Division Bench of that High Court in The<br \/>\n              Vizianagaram Co-operative Land Mortgage Bank Ltd. V.<br \/>\n              The Bheeminipatnam Co-operative Land Mortgage Bank<br \/>\n              Ltd.(1968) 1 An. WR. 52.&#8221;<\/p><\/blockquote>\n<p>      5. Again in the judgment in <a href=\"\/doc\/779674\/\">Kasaragod Co-operative<\/p>\n<p>Land Mortgage Bank V. State of Kerala &amp; Ors.<\/a> (1976 KLT 437<\/p>\n<p>it has been held as follows;\n<\/p>\n<blockquote><p>               The question arises in this case in regard to the<br \/>\n               affairs of the Kasaragod Co-operative Land<br \/>\n               Mortgage Bank, whose area of operation falls in<br \/>\n               part within the area of operation of the Hosdrug<br \/>\n               Taluk Land Mortgage Bank, which has been<br \/>\n               directed to be registered under S.7(1) of the Co-<br \/>\n               operative Societies Act. The contention raised by<br \/>\n               the petitioner&#8217;s counsel is that the Registrar ( in<br \/>\n               this case, actually the action was taken by the<br \/>\n               Deputy Registrar) has not applied his mind to, or<br \/>\n               been satisfied about, the condition under S.7(1)\n<\/p><\/blockquote>\n<blockquote><p>               (c) of the Act, namely, that the areas of the two<br \/>\n               Societies should not overlap before registration<br \/>\n               could be granted. For the one thing, we are not<br \/>\n               prepared to accept this on the averment of the<br \/>\n               petitioner, for another, assuming that this is so,<br \/>\n               and that he granted registration overlooking this<br \/>\n               requirement, it appears to us that a Society like<br \/>\n               the petitioner cannot have any legal grievance<br \/>\n               against the action which can be redressed under<\/p>\n<p><span class=\"hidden_text\">WP(c).No.20774\/09                   5<\/span><\/p>\n<p>               Article 226. To that effect is the recent decision of<br \/>\n               the Supreme Court in J.M. Desai V. Roshan Kumar(AIR<br \/>\n               1976 SC 578) following the principle of the earlier<br \/>\n               decision in N.R. &amp; F. Mills V. NTC and Bros.(AIR<br \/>\n               1971 SC 246). To that effect was also the decision<br \/>\n               of Eradi J. in 1971 KLT 350 referred to earlier and<br \/>\n               noticed in my earlier judgment in O.P. Nos.1285<br \/>\n               and 1488 of 1974. On this principle, we are of the<br \/>\n               opinion that the petitioner in this case cannot<br \/>\n               have any grievance.
