PUBLIC PROSECUTOR for\nRespondent(s) : 1, \nMR YN RAVANI for Respondent(s) :\n2, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE JAYANT PATEL\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 10\/05\/2010\n \n\nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE JAYANT PATEL)<\/p>\n<p>Leave<br \/>\n\tto correct the title as Criminal Miscellaneous Application No.2925<br \/>\n\tof 2010 in Criminal Appeal No.304 of 2010.\n<\/p>\n<p>It<br \/>\n\tappears that so far as Criminal Appeal No.303 of 2010 is concerned,<br \/>\n\tthe same arises from the judgment passed by the learned Special<br \/>\n\tJudge, C.B.I. in Special Case No.47 of 1995, whereby the order for<br \/>\n\tconviction reads as under:\n<\/p>\n<blockquote><p>\t\t\t\t The<br \/>\n\t\t\taccused no.1 Shri Chhotubhai Jafarbhai Charania is directed to<br \/>\n\t\t\tundergo rigorous imprisonment for a period of ten years for the<br \/>\n\t\t\toffence under Sections 436 read with Section 201 of the IPC and is<br \/>\n\t\t\tdirected to undergo rigorous imprisonment for a period of seven<br \/>\n\t\t\tyears for the offence under Section 420 of the IPC and pay fine of<br \/>\n\t\t\tRs.2,00,000\/- for each of the substantive offences. The aggregate<br \/>\n\t\t\tamount of fine comes to Rs.4,00,000\/-, and in default of payment<br \/>\n\t\t\tof fine, he is directed to undergo imprisonment for a period of<br \/>\n\t\t\tsix months. However, it is clarified that all the substantive<br \/>\n\t\t\tsentences shall run concurrently. It is needless to say that the<br \/>\n\t\t\tperiod of detention, if any, undergone by the accused in this<br \/>\n\t\t\tcase, shall be set off against the term of imprisonment imposed on<br \/>\n\t\t\thim.\n<\/p><\/blockquote>\n<p>\tThe<br \/>\n\t\t\tamount of fine as and when deposited by the accused Shri Charania<br \/>\n\t\t\tin the Court, shall be applied in the payment to the Dena Bank<br \/>\n\t\t\ttowards the compensation for the damage suffered by its on account<br \/>\n\t\t\tof the fire caused by accused no.1, in view of Section 357(1) of<br \/>\n\t\t\tCr.P.C., subject to the provisions of Section 357(2) of the said<br \/>\n\t\t\tCode.\n<\/p>\n<p>\tSince<br \/>\n\t\t\tthe accused no.1 is on bail, he is directed to be taken into<br \/>\n\t\t\tjudicial custody.\n<\/p>\n<p>\t\t\t\tThe<br \/>\n\t\t\taccused no.1 has also been convicted and sentenced as per the<br \/>\n\t\t\tjudgments &amp; orders passed today in Special Case No.9\/96 &amp;<br \/>\n\t\t\t68\/95. However, the sentences imposed in the said two cases as<br \/>\n\t\t\twell as in the instant case shall run concurrently as contemplated<br \/>\n\t\t\tunder Section 427 of Criminal Procedure Code.\n<\/p>\n<p>\tThe<br \/>\n\t\t\toriginal documents produced in the case be returned to the<br \/>\n\t\t\tconcerned officer of the office, as the case may be, from which<br \/>\n\t\t\tthey were seized, by the Investigating Officer, after following<br \/>\n\t\t\tthe procedure, after the appeal period is over.\n<\/p>\n<p>\tCopy<br \/>\n\t\t\tof this order be sent to the Dena Bank, Local Head Office, Ashram<br \/>\n\t\t\tRoad, Ahmedabad.\n<\/p>\n<p>It<br \/>\n\tappears that so far as Criminal Appeal No.304 of 2010 is concerned,<br \/>\n\tthe same arises from the judgment passed by the learned Special<br \/>\n\tJudge, C.B.I. in Special Case No.09 of 1996, whereby the order for<br \/>\n\tconviction reads as under:\n<\/p>\n<p>\t The<br \/>\n\taccused no.1 Shri Chhotubhai Jafarbhai Charania is directed to<br \/>\n\tundergo rigorous imprisonment for a period of ten years for each of<br \/>\n\tthe offences under Sections 120B, 409 &amp; 467 of the IPC and is<br \/>\n\tdirected to undergo rigorous imprisonment for a period of seven<br \/>\n\tyears for each of the offences under Section 477A of the IPC and<br \/>\n\tunder Section 13(2) read with Sections 13(1)(c) and 13(1)(d) of the<br \/>\n\tPC Act and is directed to pay fine of Rs.1,00,000\/- for each of the<br \/>\n\tsubstantive offences. The aggregate amount of fine comes to<br \/>\n\tRs.5,00,000\/-, and in default of payment of fine, he is directed to<br \/>\n\tundergo imprisonment for a period of one year. However, it is<br \/>\n\tclarified that all the substantive sentences shall run concurrently.<br \/>\n\tIt is needless to say that the period of detention, if any,<br \/>\n\tundergone by the accused in this case shall be set off against the<br \/>\n\tterm of imprisonment imposed on him.\n<\/p>\n<p>\tThe<br \/>\n\taccused no.2 Shri Devendra S. Mehta is directed to undergo rigorous<br \/>\n\timprisonment for a period of five years for each of the offences<br \/>\n\tunder Sections 120B, 409, 467 &amp; 477A read with Section 109 of<br \/>\n\tthe IPC and for the offences under Section 13(2) read with Section<br \/>\n\t13(1)(c) &amp; 13(1)(d) of the PC Act read with Section 109 of the<br \/>\n\tIPC and is directed to pay fine of Rs.50,000\/- for each of the<br \/>\n\tsubstantive offences. The aggregate amount of fine comes to<br \/>\n\tRs.2,50,000\/- and in default of fine, he is directed to undergo<br \/>\n\timprisonment for a period of six months. However, it is clarified<br \/>\n\tthat all the substantive sentences shall run concurrently.\n<\/p>\n<p>\tSince<br \/>\n\tthe accused nos.1 and 2 are on bail, they are directed to be taken<br \/>\n\tinto judicial custody.\n<\/p>\n<p>\tThe<br \/>\n\taccused no.1 has also been convicted and sentenced as per the<br \/>\n\tjudgments &amp; orders passed today in Special Case No.47\/95 &amp;<br \/>\n\t68\/95. However, the sentences imposed in the said two cases as well<br \/>\n\tas in the instance case shall run concurrently as contemplated under<br \/>\n\tSection 427 of Criminal Procedure Code.\n<\/p>\n<p>\tThe<br \/>\n\toriginal documents produced in the case be returned to the concerned<br \/>\n\tofficer or the office, as the case may be, from which they were<br \/>\n\tseized, by the Investigating Officer, after following the procedure,<br \/>\n\tafter the appeal period is over.\n<\/p>\n<p>The<br \/>\n\tpresent applicant is the accused no.1 before the Trial Court, who is<br \/>\n\tappellant here in the present case seeking suspension of aforesaid<br \/>\n\tsentences.\n<\/p>\n<p>We<br \/>\n\thave heard Mr. Yogesh Lakhani with Mr. Ashish Dagli for the<br \/>\n\tapplicant, Mr.Y.N. Ravani for C.B.I.-opponent no.2 herein and<br \/>\n\tMr.L.B. Dabhi, learned Additional Public Prosecutor for the State.\n<\/p>\n<p>As<br \/>\n\tsuch at this stage it may not be required for this Court to<br \/>\n\telaborately consider the evidence on record, but the pertinent<br \/>\n\taspect is that there are two confessional statements of the<br \/>\n\tapplicant-accused wherein the commission of offence is admitted and<br \/>\n\tthe learned Special Judge upon the evidence on record after<br \/>\n\tappreciation has found the voluntariness and reliability of the said<br \/>\n\tconfessional statements. The contention of the applicant-accused<br \/>\n\tthat it was after surrendering to the police custody or that the<br \/>\n\tstatements were recorded in the police custody is not borne out from<br \/>\n\tthe question put to any witnesses nor such contention was raised<br \/>\n\tbefore the learned Trial Court. Further, it deserves to be recorded<br \/>\n\tthat if the matter is to be considered with the confessional<br \/>\n\tstatements, there is huge amount of misappropriation proved running<br \/>\n\tinto crores of rupees inasmuch as such amount was tendered to be<br \/>\n\tdeposited in the Bank, but the same has not been created in capacity<br \/>\n\tof the accused as Cashier of a Nationalise Bank. It is well settled<br \/>\n\tthat at the time of suspension of sentence for regular bail, it<br \/>\n\twould be required to consider gravity of the offences together with<br \/>\n\tother relevant circumstances and also the aspects that it is only in<br \/>\n\texceptional cases, sentence is to be suspended. The aforesaid would<br \/>\n\tbe applied with more vigour to cases where there is misappropriation<br \/>\n\tof amounts running into crores of rupees by a Cashier of Nationalise<br \/>\n\tBank and further, followed by another serious offences of destroying<br \/>\n\tthe record of the Bank by setting fire.\n<\/p>\n<p>Hence,<br \/>\n\tit appears to us that it could not be a case to exercise discretion<br \/>\n\tfor suspension of sentence and releasing the applicant-accused on<br \/>\n\tbail pending the appeal.\n<\/p>\n<p>Hence,<br \/>\n\tthe application does not deserve to be granted, therefore, rejected.\n<\/p>\n<p>(Jayant<br \/>\nPatel, J)<\/p>\n<p>(Z.\n<\/p>\n<p>K.
