J.. delivered the following\u00bb<\/p>\n<p>)unA3A44<\/p>\n<p>such a course is not at all required to be<br \/>\nadopted, inasmuch as, once a notice is issued<br \/>\nbefore taking possession, the observation made<\/p>\n<p>by the Tribunal that only if there<br \/>\nobstruction recourse could be had to Sectiszirip\u00bb  &#8221;<br \/>\nof the Act, is incorrect. It is to be  n<br \/>\nthe borrower is required tomybe put&#8221;&#8221;o&#8217;11.:&#8217;_notice&#8217;<br \/>\nbefore possession is being taken..yvfhich&#8217;:couldabel A ivy f<br \/>\ndone under Section l:3_{4.-) of lthelSA_ct.  it<br \/>\nnot be any obstruction,:Vpl5y theV&#8217;borroyve:r&#8221;before:<br \/>\npossession is taken under&#8217;-Section .14\u00bb thef%Act.<br \/>\nIndeed, the Division  Coiirt has<br \/>\nalso ruled that theirrpossession<\/p>\n<p>is also not VentitiedV&#8221;tt&gt;:befcrelinitiation of<\/p>\n<p>1&#8217;Vproceedingsyfuiider:Sectilon&#8221;l4 of the Act.\n<\/p>\n<p>2. Thelearned&#8217; &#8216;&amp;3idge&#8217; has observed in the operative<\/p>\n<p>portion of theluorder.thatlonly that part of the order passed by<\/p>\n<p>dhthe  which\ufb02insists that there must be an obstruction<\/p>\n<p>  Section 14 of the Act was liable to be set aside<\/p>\n<p>andl&#8217;accordi}figlly*i:the said order was set aside and rest of the<\/p>\n<p> . reorder passed by the Tribunal hoiciing that the respondent bank<\/p>\n<p>  to have proceeded first under Section 13(4) of the Act and<\/p>\n<p> .___'&#8221;later under Section 14 of the Act has been confirmed.
