Appellant not present. The Department is represented by<br \/>\nShri Jagan Nath Baitha, Superintendent, Post Offices, Madhubani.\n<\/p>\n<p>2.     From the RTI application, it appears that the appellant had sought status<br \/>\nreport about the complaint dated 14.3.2009 lodged by certain persons against<br \/>\nBranch Post Master, Kaithnia, District Madhubani. The CPIO had informed the<br \/>\nappellant vide letter dated 6.11.2009 that the complaint had been inquired into<br \/>\nand was found to be false.\n<\/p>\n<p>3.     On appeal, the Appellate Authority, however, had taken a different view.<br \/>\nHe was of the opinion that the query raised in the RTI application did not fall in<br \/>\nthe ambit of RTI Act.\n<\/p>\n<p>4.       We have heard Shri Baitha. We have also gone through the material on<br \/>\nrecord, including, the Inquiry Report submitted by Shri S.K. Mishra, Inspector of<br \/>\nPosts. We are constrained to remark that the Appellate Authority&#8217;s conclusion<br \/>\nthat the query raised by the appellant does not fall in the ambit of RTI Act is not<br \/>\ncorrect. The appellant is entitled to know the outcome of the complaint. Even<br \/>\nthough he has already been informed that the complaint has been found to be<br \/>\nfalse, it would be appropriate to send him a copy of the Inquiry Report in 03<br \/>\nweeks time.\n<\/p>\n<p>5.
