3.   16.09.2011.               Heard learned counsel for the petitioner and<\/p>\n
                   the State.\n<\/p>\n
                                2. Petitioner was engaged to work as a<\/p>\n
                   Watchman in the godown of the Sub-Divisional Officer,<\/p>\n
                   Minor Irrigation, Jhanjharpur with effect from June,<\/p>\n
                   1981. According to the petitioner he continued to<\/p>\n
                   discharge the duties of the Watchman in the aforesaid<\/p>\n
                   godown until 30.9.1996 but was paid wages until<\/p>\n
                   20.1.1982. From 21.1.1982 he has not been paid<\/p>\n
                   wages although he served as Watchman in the godown<\/p>\n
                   until 30.9.1996. This writ petition has been filed for a<\/p>\n
                   direction     to   the   Sub-Divisional   Officer,   Minor<\/p>\n
                   Irrigation, Jhanjharpur to make payment of the<\/p>\n
                   arrears of wages for the period between 21.1.1982-<\/p>\n
                   30.9.1996. Further prayer is also made to consider the<\/p>\n
                   case of the petitioner for regularization in the light of
\n                    2<\/span><\/p>\n
the Government circular to consider the regularization<\/p>\n
of the daily wage earners.\n<\/p>\n
         3. Aforesaid prayer is being refuted by the<\/p>\n
counsel for the State with reference to the averments<\/p>\n
made in the counter affidavit on the basis of the<\/p>\n
contents of Letter No. 734 dated 26th November, 1998<\/p>\n
of the Executive Engineer, Minor Irrigation Division,<\/p>\n
Madhubani addressed to the Superintending Engineer,<\/p>\n
Minor Irrigation Circle, Darbhanga in response to the<\/p>\n
request of the Sub-Divisional Officer, Minor Irrigation,<\/p>\n
Jhanjharpur to make payment of wages to the<\/p>\n
petitioner for the period between 21.1.1982-30.6.1986.<\/p>\n
Such request of the Sub-Divisional Officer was not<\/p>\n
favourably   considered   and   recommended      by   the<\/p>\n
Executive Engineer as no records indicating marking<\/p>\n
of attendance by the petitioner for the period between<\/p>\n
21.1.1982-30.6.1986 was available in the Division<\/p>\n
although records were available to suggest discharge<\/p>\n
of duty by the petitioner from 1.7.1986 as has been<\/p>\n
reported by the Junior Engineer under Letter No. 0<\/p>\n
dated 1.7.1986. The authorities desire that the prayer<\/p>\n
of the petitioner for arrears of wages be rejected on the<\/p>\n
basis of the non-availability of the attendance-sheet<\/p>\n
showing marking of attendance by the petitioner in the<\/p>\n
Division. Petitioner was working as a Watchman in the<\/p>\n
Sub-Division. His attendance-sheet must be available<\/p>\n
in the Sub-Division.\n<\/p>\n
                               3<\/span><\/p>\n
                  4. In the circumstances, I dispose of the writ<\/p>\n
         petition directing the Executive Engineer to verify from<\/p>\n
         the   Attendance-Register      maintained   in the       Sub-<\/p>\n
         Division as to whether petitioner was present during<\/p>\n
         the period between 21.1.1982-30.9.1996 in the Sub-<\/p>\n
         Division and if he was so present and serving as<\/p>\n
         Watchman in the godown of the Sub-Division, he be<\/p>\n
         paid his arrears of wages for the said period. The other<\/p>\n
         prayer of the petitioner for regularization be also<\/p>\n
         considered in accordance with the resolution of the<\/p>\n
         State Government as petitioner was engaged to serve<\/p>\n
         as a Watchman in June, 1981 prior to the cut off date.<\/p>\n
         Necessary order concerning the payment of arrears of<\/p>\n
         wages be passed by the Executive Engineer after<\/p>\n
         verifying the attendance record of the Sub-Division<\/p>\n
         and if any wage is found due to the petitioner, same be<\/p>\n
         paid as early as possible, in any case within a period<\/p>\n
         of two months from the date of receipt\/production of a<\/p>\n
         copy of this order before the Executive Engineer. The<\/p>\n
         prayer   of   the    petitioner   for   regularization     be<\/p>\n
         considered    by    the    competent    authority   in    the<\/p>\n
         department within another three months.<\/p>\n
