DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 30\/11\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tThis<br \/>\napplication is filed under Section 439 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nC.R.No.I-81\/2010 with Visavadar police station for the offences<br \/>\npunishable under Sections 365, 368, 376, 506(2) and 114 of the Indian<br \/>\nPenal Code.\n<\/p>\n<p>\tHeard<br \/>\nlearned counsel for the parties and perused the record.\n<\/p>\n<p>\tThe<br \/>\nlearned counsel for the applicant submits that considering the<br \/>\nversion of the prosecutrix and other attending circumstances, this<br \/>\napplication for bail may kindly be considered.\n<\/p>\n<p>\tThe<br \/>\nlearned Additional Public Prosecutor has opposed grant of bail<br \/>\nlooking to the nature and gravity of offence.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case and considering the nature of<br \/>\nallegations and the version of the prosecutrix,  without discussing<br \/>\nthe evidence in detail, prima facie, this Court is of the opinion<br \/>\nthat this is a fit case to exercise the discretion to enlarge the<br \/>\napplicant on bail.\n<\/p>\n<p>\tThe<br \/>\nparties do not press for further reasoned order.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be released on bail in connection<br \/>\nwith  first information report registered at C.R.No.I-81\/2010 with<br \/>\nVisavadar Police Station on his executing a bond of Rs.5,000\/-<br \/>\n(Rupees five thousand only) with one surety of the like amount to the<br \/>\nsatisfaction of the trial court and subject to the conditions that he<br \/>\nshall<\/p>\n<p> i.\tnot<br \/>\ntake undue advantage of his liberty or misuse his liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injuries to the interest of the prosecution;\n<\/p>\n<p>surrender<br \/>\n\this passport, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>mark<br \/>\n\this presence at the concerned police station on the first Sunday of<br \/>\n\tevery month between 10 a.m. And 3 p.m till commencement of the<br \/>\n\ttrial.\n<\/p>\n<p>furnish<br \/>\n\tthe present  address of his residence to the I.O. and also to the<br \/>\n\tCourt at the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p>\tThe<br \/>\nAuthorities will release the applicant only if he is not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>\tBail<br \/>\nbond to be executed before the lower court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>\tAt<br \/>\nthe trial, the trial court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>\tRule<br \/>\nis made absolute to the aforesaid extent.
